Abstract
การศึกษาค้นคว้าอิสระเรื่อง “การทุเลาการบังคับตามคำสั่งทางปกครอง” มีวัตถุประสงค์เพื่อ (1) เพื่อศึกษาแนวคิด ทฤษฎี และหลักการทุเลาการบังคับตามคำสั่งทางปกครองตามกฎหมายต่างประเทศ (2) เพื่อศึกษาหลักกฎหมายที่เกี่ยวข้องกับการทุเลาการบังคับตามคำสั่งทางปกครองตามกฎหมายไทย (3) เพื่อศึกษาวิเคราะห์ปัญหาเกี่ยวกับหลักการทุเลาการบังคับตามคำสั่งทางปกครองตามกฎหมายที่เกี่ยวข้อง (4) เพื่อหาแนวทางในการปรับปรุงแก้ไขหลักการทุเลาการบังคับตามคำสั่งทางปกครอง การศึกษาค้นคว้าอิสระนี้เป็นการวิจัยเชิงคุณภาพ ด้วยวิธีการวิจัยทางเอกสาร โดยการรวบรวมข้อมูลต่าง ๆ ซึ่งได้แก่ งานวิจัย วิทยานิพนธ์ หนังสือ ตำรา บทความทางวิชาการ ตัวบทกฎหมาย คําพิพากษาของศาลและเอกสารในรูปแบบอื่น รวมทั้งแหล่งข้อมูลจากอินเตอร์เน็ต ผลการศึกษาพบว่า ในระบบกฎหมายของไทยการอุทธรณ์คำสั่งทางปกครองไม่เป็นเหตุให้มีการทุเลาการบังคับตามคำสั่งทางปกครอง เว้นแต่จะมีการสั่งให้ทุเลาการบังคับไว้ก่อน โดยเจ้าหน้าที่ หรืออาจจะเป็นกรณีที่มีกฎหมายเฉพาะในเรื่องนั้นบัญญัติให้การอุทธรณ์คำสั่งทางปกครองเป็นการทุเลาการบังคับตามคําสั่งทางปกครองโดยอัตโนมัติ แต่การมีผลเป็นการทุเลาการบังคับตามคำสั่งทางปกครองตามพระราชบัญญัติเหล่านั้น มีผลเพียงเพื่อรอผลการวินิจฉัยอุทธรณ์ของผู้มีอำนาจวินิจฉัยอุทธรณ์เท่านั้น จึงควรแก้ไขหลักการ โดยให้มีผลเป็นการทุเลาการบังคับตามคำสั่งทางปกครองไปจนกว่าจะพ้นระยะเวลา 1 เดือน เมื่อผู้รับคําสั่งได้รับแจ้งผลการวินิจฉัยอุทธรณ์ และให้การฟ้องคดีตามพระราชบัญญัติดังกล่าวมีผลเป็นการทุเลาการบังคับตามคําสั่งทางปกครองและให้มีผลเป็นการทุเลาการบังคับตามคำสั่งทางปกครองไปจนกว่าคดีจะถึงที่สุด ซึ่งจะทำให้สิทธิของบุคคลได้รับการคุ้มครองต่อเนื่อง ส่วนของพระราชบัญญัติฉบับทบัญญัติให้การอุทธรณ์คำสั่งทางปกครอง ไม่มีผลเป็นการทุเลาการบังคับตามคำสั่งทางปกครองนั้น เมื่อได้เข้าสู่การพิจารณาของศาล ก็ให้เป็นอำนาจของศาลในการพิจารณาว่าควรจะมีคำสั่งทุเลาการบังคับตามคําสั่งทางปกครองให้หรือไม่ แต่ทั้งนี้ควรมีหลักเกณฑ์ในการพิจารณาเพื่อให้เป็นไปในทิศทางเดียวกันและมีมาตรฐานในการมีคำสั่งเกี่ยวกับการทุเลาการบังคับตามคำสั่งทางปกครอง
This study of “Respite in Respect to Administrative Orders” aims to (1) study the thought, theory, and rule of the Respite in Respect to Administrative Orders of International Laws; (2) to study the rule of the Respite in Respect to Administrative Orders of Thai Laws; (3) to analyze the problems related to the Respite in Respect to Administrative Orders; and (4) to find approaches to develop the Respite in Respect to Administrative Orders. This interdependent study is the qualitative and documentary research by gathering the data from several sources including researches, thesis, books, journals, laws, judgments of the Court, the Internet, and other sources. The study revealed that the appeal of Administrative orders of Thai laws was not the case against the Respite in Respect to Administrative Orders unless there was the previous order for the Respite of Execution by officers, or there was the specific law in that case legislating that the appeal of Administrative Orders was the Respite in Respect to Administrative Orders automatically. However, the result of the Respite in Respect to Administrative Orders according to the Act was decided by of the person in authority who could determine of the appeal only. For this reason, the result of the Respite in Respect to Administrative Orders should be extended up to a month. In other words, when the authorized person received the result of the determination of the appeal, the accusation according to the Act should be resulted in the Respite in Respect to Administrative Orders until the final case. Thus, the right of people will be protected continuously. Regarding to the Act legislating that the appeal of Administrative Orders would not be resulted in the Respite in Respect to Administrative Orders, it would be considered by the Court if there should be have the order to Respite in Respect to Administrative Orders or not. Nevertheless, the Respite in Respect to Administrative Orders should have the rules of consideration in the same direction and standard.
