Abstract
การศึกษาค้นคว้าอิสระในเรื่องนี้ มีวัตถุประสงค์เพื่อศึกษาถึงความหมายความเป็นมาแนวคิด และทฤษฎีของกฎหมายคุ้มครองผู้บริโภค ศึกษาและวิเคราะห์ปัญหากฎหมายคุ้มครองผู้บริโภคของต่างประเทศและประเทศไทย ศึกษาถึงปัญหาของคำนิยาม "ผู้บริโภค" "คดีผู้บริโภค" และปัญหาในการฟ้องคดีผู้บริโภค เพื่อหาแนวทางในการแก้ไขเกี่ยวกับปัญหา ดังกล่าว การศึกษาค้นคว้าอิสระนี้เป็นการศึกษาวิจัยทางกฎหมาย เป็นการวิจัยเชิงคุณภาพ ด้วยการค้นคว้าข้อมูลทางเอกสาร โดยการศึกษาค้นคว้าจากกฎหมายเกี่ยวกับการคุ้มครองผู้บริโภค ตำราของนักวิชาการ บทความเกี่ยวกับการคุ้มครองผู้บริโภค และเอกสารอื่น ๆ ทั้งในประเทศและต่างประเทศ ผลการศึกษาพบว่าพระราชบัญญัติคุ้มครองผู้บริโภค พ.ศ.2522 ซึ่งแก้ไขเพิ่มเติม โดยพระราชบัญญัติคุ้มครองผู้บริโภค (ฉบับที่ 2) พ.ศ.2541 นิยามคำว่า "ผู้บริโภค" หมายความว่า ผู้ซื้อหรือผู้ได้รับบริการจากผู้ประกอบธุรกิจ ซึ่งมีความหมายกว้างมาก โดยไม่มีข้อความที่กำหนด วัตถุประสงค์ของการบริโภคไว้ให้ชัดเจน และนิยามคำว่า "คดีผู้บริโภค" ตามพระราชบัญญัติวิธีพิจารณาคดี ผู้บริโภค พ.ศ.2551 บัญญัติว่าคดีผู้บริโภคเป็นคดีแพ่งที่พิพาทกันระหว่างผู้บริโภคกับผู้ประกอบธุรกิจ นอกจากนี้บัญญัติว่า การฟ้องคดีผู้บริโภค โจทก์จะฟ้องด้วยวาจาหรือเป็นหนังสือก็ได้ ทำให้โจทก์ในคดีผู้บริโภคจะเป็นผู้บริโภคหรือเป็นผู้ประกอบธุรกิจก็ได้ เมื่อวิเคราะห์คำนิยามทั้งสองแล้ว บุคคลที่จะเป็นผู้บริโภคจึงเป็นผู้ที่ซื้อสินค้าหรือบริการ ซึ่งจะเพื่อวัตถุประสงค์ใดก็ตาม ก็ถือเป็นผู้บริโภค และผู้เป็นโจทก์ที่จะนำคดีมาฟ้องก็เป็นผู้ประกอบธุรกิจเสียส่วนใหญ่ ซึ่งไม่เป็นไปตามเหตุผลในการประกาศใช้พระราชวิธีพิจารณาคดีผู้บริโภค พ.ศ.2551 ที่บัญญัติเพื่อให้ผู้บริโภคได้รับการเยียวยาด้วยความรวดเร็ว ประหยัด และมีประสิทธิภาพอันเป็นการคุ้มครองสิทธิของผู้บริโภค ด้วยเหตุนี้ผู้ศึกษาเห็นว่ามีประเด็นปัญหาที่ต้องเสนอแนะแนวทางแก้ไขบทบัญญัติดังกล่าว เพื่อคุ้มครองผู้บริโภคให้มากยิ่งขึ้นและเป็นไปตามเจตนารมณ์ของกฎหมายต่อไป
The objective of the independent study to study meanings, backgrounds, concepts and theories of consumer protection law, study and analyze foreign and Thailand consumer protection law problems, study problems on the definition of "Consumer", "Consumer Case", and problems of consumer case litigation, to find the corrective guideline for such problems This independent study is the legal qualitative research conducted through searches of documentary data, and researches from both domestic and foreign consumer protection-related laws, textbooks of the scholars, consumer protection-related articles, and other documents. The finding of the studying result indicated that Consumer Protection Act B.E. 2522 (A.D. 1979) amended by Consumer Protection Act (No. 2) B.E. 2541 (A.D.1998), defines the term of "Consumer" meaning the buyer or the user of services from the business entrepreneur. The meaning is very comprehensive without statement that clearly determines consumption objective. The term of " Consumer Case" is defined in accordance with Consumer Case Procedure Act B.E. 2551 (A.D. 2008) being enacted that consumer case is a civil case for dispute between consumer and business entrepreneur. In addition, the Act is also enacted that according to consumer case litigation, the plaintiff shall litigate by oral or by writing, resulting in the possibility that the plaintiff in consumer case can be the consumer or business entrepreneur. After analyzing both definitions, the person who is the consumer is the buyer of goods or services. For whatever purpose, the said person is considered as consumer. The plaintiffs who sued in a court of justice have mostly been the business entrepreneurs. This has not been rational in promulgation of Consumer Act Procedure Act B.E. 2 5 5 1 (A.D. 2008) being enacted for rapid, save and efficient remedy for consumers as protection of the consumer's right. Therefore, the researcher deemed that there have been the problematic issues requiring suggestion of corrective guideline for such legal provisions for more consumer protection in accordance with the spirit of law accordingly.
