Abstract
การศึกษาค้นคว้าอิสระนี้มีวัตถุประสงค์เพื่อ (1) ศึกษาแนวคิด และทฤษฎีเกี่ยวข้องกับการปล่อยชั่วคราว (2) ศึกษากฎหมายที่เกี่ยวข้องกับการปล่อยชั่วคราวโดยใช้อุปกรณ์อิเล็กทรอนิกส์ทั้งกฎหมายไทยและกฎหมายต่างประเทศ (3) ศึกษาวิเคราะห์ถึงสภาพปัญหาที่เกิดขึ้นในศาลอาญาตลิ่งชัน กรณีการยื่นคำร้องขอปล่อยชั่วคราวโดยใช้อุปกรณ์อิเล็กทรอนิกส์ และ (4) เสนอแนะแนวทางการปรับปรุงแก้ไขปัญหาดังกล่าว การศึกษาค้นคว้าอิสระนี้เป็นการวิจัยเชิงคุณภาพ ด้วยวิธีการวิจัยเอกสาร และการสัมภาษณ์เชิงลึก อาทิเช่น บทบัญญัติของกฎหมาย หนังสือ บทความ วิทยานิพนธ์ รายงานการศึกษาวิจัยข้อมูลทางสื่ออิเล็กทรอนิกส์ เอกสารที่เกี่ยวข้อง รวมทั้งการเก็บข้อมูลจากผู้ให้ข้อมูลสำคัญ แล้วนำข้อมูลที่ได้มาวิเคราะห์เชิงเนื้อหาผลการวิจัยพบว่า(1) แนวคิดว่าด้วยการปล่อยชั่วคราวมีเจตนารมณ์เพื่อคุ้มครองสิทธิมนุษยชนในกระบวนการยุติธรรมทางอาญา (2) ในต่างประเทศได้นำอุปกรณ์อิเล็กทรอนิกส์มาใช้ในการปล่อยชั่วคราวในกรณีที่ศาลเห็นว่าไม่มีเงื่อนไขอื่นใดที่มีความเข้มงวดเพียงพอที่จะควบคุมมิให้ผู้ที่ได้รับการปล่อยชั่วคราวหลบหนีไปในระหว่างการพิจารณำแต่ (3) ศาลได้นาอุปกรณ์อิเล็กทรอนิกส์มาใช้ในการปล่อยชั่วคราวกับความผิดทุกประเภท และเปิดโอกาสให้ศาลสามารถเรียกประกันหรือหลักประกันร่วมด้วย ดังนั้น (4) ผลการวิจัยจึงเสนอแนะว่าควรแก้ไขข้อบังคับหลักเกณฑ์และเงื่อนไขเกี่ยวกับการเรียกประกันหรือหลักประกันในการปล่อยชั่วคราวผู้ต้องหาหรือจำเลยในคดีอาญา (ฉบับที่ 3) พ.ศ.2562 ข้อ 3 โดยยกเลิกการเรียกหลักประกันร่วมกับการใช้อุปกรณ์อิเล็กทรอนิกส์ สาหรับคดีที่มีอัตราโทษจำคุกอย่างสูงไม่เกิน 10 ปี และควรนำอุปกรณ์อิเล็กทรอนิกส์มาใช้ต่อเมื่อ ศาลพิจารณาเห็นว่าหากไม่ใช้อุปกรณ์ดังกล่าว ศาลจะสั่งไม่อนุญาตให้ปล่อยชั่วคราว ซึ่งจะก่อให้เกิดความเป็นธรรมมากยิ่งขึ้น
The purposes of this independent study were (1) to examine the concepts and theories related to the provisional release. (2) to examine the laws related to the provisional release of electronic monitoring devices of Thai law comparing to other countries. (3) to study and analyze the problems in Taling Chan Criminal Court and (4) to suggest solution for such problems. This independent study is qualitative research by studying and collecting data from relevant documents (Document Research) such as laws, books, articles, thesis, research, media and collecting information with in-depth interviews key informants for analyzing. It was found that (1) the concepts of provisional release has an intention to protect human rights in the criminal justice system. (2) in foreign countries, electronic monitoring devices was used for provisional release if the court deems that no other condition is rigorous enough to restrict the provisionally released person during the procedure, but (3) the court use electronic monitoring devices in the provisional release all of offences and it use their discretion to claim a bail or security as well. Therefore, (4) the results suggest that the laws and conditions to release with bail and security alleged offender or accused in the criminal case (No. 3), B.E. 2562, Article 3 should be revised to canceling the required bail with the use of electronic monitoring devises for cases with imprisonment not exceeding 10 years, and should be used only electronic monitoring devices when the court deems that if not use this, the court has not been granting provisional release.
