Abstract
การวิจัยเรื่องกระบวนการยุติธรรมชุมชนในประเทศไทยวัตถุประสงค์เพื่อศึกษาความหมาย ความสําคัญ บทบาทและแนวคิดทฤษฎีรูปแบบของยุติธรรมชุมชน บทบาทการแก้ไขวิกฤตของกระบวนการยุติธรรม กระแสหลักและเพื่อศึกษารูปแบบของยุติธรรมชุมชนประเทศไทยเปรียบเทียบกับต่างประเทศ ตลอดจนศึกษา ปัญหาและแนวทางแก้ไขปัญหาเกี่ยวกับการนํายุติธรรมชุมชนมาของสํานักงานปลัดกระทรวงยุติธรรม การวิจัยนี้เป็นการวิจัยทางกฎหมายโดยวิธีวิจัยเชิงคุณภาพ ด้วยการศึกษาค้นคว้าจากเอกสารทาง วิชาการที่เกี่ยวข้องกับกระบวนการยุติธรรมชุมชน เช่น วารสารทางวิชาการ บทความวิชาการ และ บทความวิจัย จากการศึกษาพบว่า 1) กระบวนการยุติธรรมชุมชน คือ กระบวนการที่มีขึ้นเพื่อป้องกันอาชญากรรม ไม่ให้เกิดขึ้นในชุมชน และการร่วมกันเยียวยาความเสียหายจากอาชญากรรมที่เกิดขึ้น 2) มีการนํา กระบวนการยุติธรรมชุมชนมาใช้ใน 3 รูปแบบ ได้แก่ เครือข่ายยุติธรรมชุมชน ศูนย์ยุติธรรมชุมชน และการไกล่ เกลี่ยข้อพิพาท ทั้งสามรูปแบบล้วนมีบทบาทในการแก้ไขวิกฤตกระบวนการยุติธรรมกระแสหลักเป็นอย่างมาก 3) การนํากระบวนการยุติธรรมชุมชนมาใช้ในรูปแบบต่าง ๆ ของต่างประเทศ แบ่งออกได้เป็น 2 กลุ่มใหญ่ คือ กลุ่มที่นํากระบวนการยุติธรรมชุมชนมาใช้โดยตรง ได้แก่ สหรัฐอเมริกา ประเทศแคนาดา และสหราชอาณาจักร และกลุ่มที่นํากระบวนการยุติธรรมชุมชนมาใช้ในรูปแบบการจัดการความขัดแย้งเชิงสมานฉันท์ในลักษณะการไกล่เกลี่ยข้อพิพาท ได้แก่ สาธารณรัฐเกาหลี และประเทศฟิลิปปินส์ เมื่อทําการเปรียบเทียบพบว่าทุกประเทศล้วนมีรูปแบบ พื้นฐานการนํากระบวนการยุติธรรมชุมชนมาใช้ที่เหมือนกัน คือกระบวนการยุติธรรมชุมชนสามารถนํามาใช้กับความผิดที่เล็กน้อยเท่านั้น ด้านความแตกต่างพบว่าแตกต่างในเรื่องของแนวทางปฏิบัติบางประการ อาทิ สหราชอาณาจักร ผู้พิพากษาและสถาบันการศึกษาเข้ามามีบทบาทเกี่ยวข้องกับยุติธรรมชุมชน แต่ประเทศไทยผู้พิพากษา ไม่ได้เข้ามามีบทบาทเกี่ยวข้องและสถาบันการศึกษามีบทบาทในการเรียนการสอนและศึกษาวิจัยด้าน กระบวนการยุติธรรมชุมชนเท่านั้น ส่วนสาธารณรัฐเกาหลี มีกฎหมายรองรับการไกล่เกลี่ยข้อพิพาทในคดีอาญา ขณะที่ประเทศไทยยังไม่มีกฎหมายดังกล่าว 4) ปัญหาอุปสรรคการนํากระบวนการยุติธรรมชุมชนไปใช้คือ การไม่มีกฎหมายที่สมบูรณ์แบบที่จะใช้กับกระบวนการยุติธรรมชุมชน การดําเนินงานต่างๆ อยู่ภายใต้คําสั่ง กระทรวงยุติธรรมซึ่งมีฐานะเป็นเพียงกฎหมายรองทําให้เกิดผลเสียตามมา ได้แก่ ความไม่ชัดเจนในอํานาจหน้าที่ และการขาดสภาพบังคับใช้ในผลการดําเนินงานด้านการไกล่เกลี่ยข้อพิพาท ผู้ศึกษามีข้อเสนอแนะว่าควรมีพระราชบัญญัติกระบวนการยุติธรรมชุมชน เพื่อแก้ไขปัญหาข้างต้นและเพื่อการดําเนินงานด้านกระบวนการยุติธรรมชุมชนอยางมีประสิทธิภาพ
This thesis aims to investigate the meaning, importance, role and theories of the community justice. It compared the community justice in Thailand with foreign countries. It also aims to study about the problems and solution as per community justice in Thailand. The qualitative approach was performed in the study, using the documentary source such as academic journal, academic papers and research papers. It was found that 1) Community justice is a crime prevention activities that include the community in the process to heal the damages from crimes already commited 2) There are three types of community justice which are community justice network, community justice center and mediation 3) As for the foreign countries, community justice can be classified into two groups. The first group directly uses the community justice; the United States of America, United Kingdom and Canada are in the first group. The second group uses community justice as a conflict resolution. Republic of Korea and the Philippines are in the second group. However, it was also found that community justice in every country can only be used with petty offenses. Community justice practice can vary from country to country. For example, in the UK, judges and educational institutes are involved in the community justice whereas in Thailand judges are not involved and educational institutes involve only in the teaching and research about community justice. In the Republic of Korea, there is a law about criminal mediation whereas Thailand does not have this kind of law 4) As for the problems of community justice is the lack of law for community justice. The practice of community justice is unclear and lack enforcement because there is no law for it. Thus, there should be an Act for community justice for the efficiency of community justice.
