Abstract
การศึกษาค้นคว้าอิสระนี้มีวัตถุประสงค์เพื่อ (1) ศึกษาแนวคิด ทฤษฎี เกี่ยวกับมาตรการของการคุ้มครองพยานจากการค้ามนุษข์ ตามกฎหมายว่าด้วยการคุ้มครองพยานในคดีอาญาทั้งกฎหมายไทยและกฎหมายต่างประเทศ (2) เพื่อนำผลการวิเคราะห์และกำหนดแนวทางการแก้ไขปัญหามาตรการในการคุ้มครองพยานในคดีค้ามนุษข์ ตลอดจนเสนอแนะการปรับปรุงกฎหมาย (3) เพื่อให้การบังคับใช้กฎหมายเกี่ยวกับการมาตรการ ในการคุ้มครองพยาน ในคดีค้ามนุษย์ตามพระราชบัญญัติคุ้มครองพยานในคดีอาญา พ.ศ.2546 มีประสิทธิภาพสอดคล้องกับสภาพสังคมในปัจจุบันมากยิ่งขึ้นการศึกษาค้นคว้าอิสระนี้เป็นการวิจัยเชิงคุณภาพ โดยการวิจัยเอกสารด้วยการศึกษาค้นคว้าและรวบรวมข้อมูลจากหนังสือ ตำรา บทความทางวิชาการ รายงานการวิจัย ประมวลกฎหมาย คำพิพากษาของศาล วิทยานิพนธ์ สารนิพนธ์ ข้อมูลทางสื่ออิเล็กทรอนิกส์และเครือข่ายอินเตอร์เน็ต ตลอดจนบทบัญญัติของกฎหมายที่เกี่ยวข้องทั้งของไทยและต่างประเทศ ผลการศึกษาพบว่า ประเทศไทยยังมีประเด็นปัญหาบางประการ คือ (1) ไม่มีกฎหมายคุ้มครองพยานที่เกี่ยวกับการค้ามนุษข์ในเรื่องกันพยาน (2) ประเด็นเรื่องค่าสินไหมทดแทน (3) มาตรการพิเศยในการคุ้มครองพยานค้ามนุยย์ในกรณีฉุกเฉิน ดังนั้น การ ให้ความคุ้มครองเพื่อให้พยานรู้สึกว่าตนเองและบุคคลในครอบครัวได้รับความปลอดภัยและเกิดความเชื่อมั่นในกระบวนการยุติธรรม เพื่อให้การปฏิบัติงานของเจ้าหน้าที่ผู้รับผิดชอบและการบังคับใช้กฎหมายเกี่ยวกับมาตรการในการคุ้มครองพยานในคดีค้ามนุษย์เป็นไปอย่างมีประสิทธิภาพและสอดคล้องและรองรับกับสถานการณ์ปัจจุบัน จึงควรปรับปรุงแก้ไขพระราชบัญญัติคุ้มครองพยานในคดีอาญาพ.ศ. 2546 และพระราชบัญญัติป้องกันและปราบปรามการค้ามนุษย์ พ.ศ. 2551
The objective of this independent study is ( 1 ) to study the concepts and theories relating to the witness protection from human trafficking measure pursuant to both Thai and foreign laws on witness protection in criminal case, ( 2 ) to apply the analysis result, determine a corrective guideline for the problems in the witness protection in the human trafficking case measure, as well as suggest the law amendment, and (3) to efficiently enforce the laws relating to the witness protection in the human trafficking case measure pursuant to the Witness Protection in Criminal Case Act B.E. 2546 (200) to be more consistent with the current state of society. This independent study is a qualitative research using the documentary research through the study, search and collection of data from books, textbooks, academic articles, research reports, codes of law, court sentences, dissertations, thesis, electronic media and internet data, as well as legislations of both Thai and foreign relevant laws. The finding of the studying results indicated that some of Thailand problem issues included (1) none of the laws on witness protection relating to human trafficking in the matter of witness retention, (2) compensation issue, and (3) special witness protection in human trafficking measure in case of emergency. Therefore, the witnesses have been protected to make them feel that they themselves and their family members have been secure and confident on the justice process. For the efficiency and consistency of the responsible officer’s operation and the enforcement of laws relating to the witness protection in human trafficking case measure, to support the current situations, the Witness Protection in Criminal Case Act B.E. 2546 (2003) and AntiHuman Trafficking Act B.E. 2551 (2008) should be amended.
