Abstract
การศึกษาค้นคว้าอิสระเรื่อง การบังคับใช้บทบัญญัติว่าด้วยสิทธิพิทักษ์รัฐธรรมนูญมีวัตถุประสงค์เพื่อศึกษา แนวคิด ทฤษฎีที่เกี่ยวกับสิทธิพิทักษ์รัฐธรรมนูญ บทบัญญัติเกี่ยวกับสิทธิพิทักษ์รัฐธรรมนูญทั้งในประเทศไทยและต่างประเทศ หลักการให้ประชาชนมีสิทธิยื่นคำร้องต่อศาลรัฐธรรมนูญ โดยตรงกรณีการใช้สิทธิและเสรีภาพอื่น ๆ วิเคราะห์ปัญหาที่เกิดขึ้นจากกฎหมาย และคำวินิจฉัยของศาลรัฐธรรมนูญของประเทศไทย เพื่อหาแนวทางที่เหมาะสมในการบัญญัติบทบัญญัติเกี่ยวกับสิทธิพิทักษ์รัฐธรรมนูญไว้ในรัฐธรรมนูญแห่งราชอาณาจักรไทย การศึกษาค้นคว้าอิสระนี้เป็นการวิจัยเชิงคุณภาพด้วยวิธีการวิจัยเอกสาร โดยรวบรวมข้อมูลที่เกี่ยวข้องทั้งหมดไม่ว่าจะเป็นรัฐธรรมนูญของประเทศไทยและต่างประเทศ ตำรา บทความจากเอกสารต่าง ๆ วิทยานิพนธ์ งานวิจัย และข้อมูลอิเล็กทรอนิกส์ต่าง ๆ ผลการศึกษาพบว่า บทบัญญัติเกี่ยวกับสิทธิพิทักษ์รัฐธรรมนูญในรัฐธรรมนูญแห่งราชอาณาจักรไทย พุทธศักราช ๒๕๕๐ มาตรา ๖๘ มีความไม่ชัดเจนจนทําให้เกิดปัญหาในการ ความของศาลรัฐธรรมนูญ แม้ว่าต่อมาได้มีการร่างรัฐธรรมนูญแห่งราชอาณาจักรไทย ฉบับลงประชามติเมื่อวันที่ 6 สิงหาคม ๒๕๕๕ ซึ่งร่างรัฐธรรมนูญฉบับดังกล่าวได้มีบทบัญญัติเกี่ยวกับสิทธิพิทักษ์รัฐธรรมนูญไว้ในมาตรา ๔๕ และมาตราดังกล่าวได้บัญญัติแก้ไขปัญหาความไม่ชัดเจนในบทบัญญัติเดิมไว้แล้ว แต่ยังพบว่าบทบัญญัติดังกล่าวไม่ได้บัญญัติให้ครอบคลุมไปถึงกรณีที่บุคคลจะใช้สิทธิหรือเสรีภาพเพื่อให้ได้มาซึ่งอำนาจในการปกครองประเทศ โดยวิธีการ ซึ่งไม่ได้เป็นไปตามวิถีทางที่บัญญัติไว้ในรัฐธรรมนูญ ทั้งยังมีความไม่เหมาะสมในส่วนขององค์กรที่ทำหน้าที่กลั่นกรองเรื่องเบื้องต้นที่กำหนดให้เป็นอำนาจหน้าที่ของอัยการสูงสุดซึ่งอาจทําให้เกิดความสับสนในตัวองค์กรวินิจฉัยปัญหาเกี่ยวกับรัฐธรรมและยังเป็นการสร้างภาระขั้นตอนให้แก่บุคคลผู้ใช้สิทธิพิทักษ์รัฐธรรมนูญมากเกินไป ทำให้การพิทักษ์รัฐธรรมนูญ ไม่มีประสิทธิภาพที่ดีพอจึงเห็นสมควรให้มีการแก้ไขเพิ่มเติมบทบัญญัติเกี่ยวกับสิทธิพิทักษ์รัฐธรรมนูญดังกล่าวให้มีความเหมาะสมโดยบัญญัติให้ครอบคลุมถึงกรณีที่บุคคลจะใช้สิทธิหรือเสรีภาพเพื่อให้ได้มาซึ่งอำนาจในการปกครองประเทศโดยวิธีการ ซึ่งไม่ได้เป็นไปตามวิถีทางที่บัญญัติไว้ในรัฐธรรมนูญด้วย และให้ผู้ทราบการกระทำดังกล่าวมีสิทธิยื่นคําร้องต่อศาลรัฐธรรมนูญ เพื่อวินิจฉัยสั่งการได้โดยตรง แล้วจึงบัญญัติไว้ในรัฐธรรมนูญแห่งราชอาณาจักรไทยฉบับใหม่ต่อไป
The purposes of study are to study: the principles and theoretical concepts concerning the rights to protect constitution: the legislation on the rights to protect constitution in Thailand and foreign countries: the concept of the rights for a person to directly submit a motion to the Constitutional Court and analyze the usage problem from the legislation and the Constitutional Court sentences to amend and develop the law which related the issue. This study is a qualitative research based on documentary study on a data compilation and analysis of the constitution, research reports, journal articles, various electronic data, internet and legal concept on Thai law and foreign law. The study found that the legislation on the rights to protect constitution in section 68 of Constitution of the Kingdom of Thailand B.E. 2550 (2007) is unclear which caused the interpretation problem for the Constitutional Court. Although section 49 of the constitution draft has solved the issue, but section 49 does not cover the case of the usage of the rights to acquire the power to rule the country by any means which is not in accordance with the modes provide in the constitution draft. Moreover, the Attorney General as the screening agency in section 49 of constitution draft is unnecessary procedure and may cause confusion about the ruling agency which affect the efficiency of the rights to protect constitution. Therefore, Thailand should amend the legislation on the rights to protect constitution in the constitution draft by enact such legislation to cover the case of the usage of the rights to acquire the power to rule the country any means which is not in accordance with modes provide in the constitution draft and the person knowing of such act shall have the right to submit a motion to the Constitutional Court directly.
