Abstract
การศึกษาค้นคว้าอิสระนี้มีวัตถุประสงค์เพื่อศึกษาแนวคิด ทฤษฎี เกี่ยวกับหลักความชอบด้วยกฎหมายของการกระทำทางปกครอง และหลักเกณฑ์ในการมอบอำนาจ เพื่อวิเคราะห์หลักเกณฑ์และปัญหาเกี่ยวกับการมอบอำนาจในการปฏิบัติราชการแทนตามมาตรา 38 แห่งพระราชบัญญัติระเบียบบริหารราชการแผ่นดิน (ฉบับที่ 7) พ.ศ. 2550 และเพื่อเสนอแนะแนวทางแก้ไขปรับปรุงหลักเกณฑ์ในการมอบอำนาจตามบทบัญญัติดังกล่าวต่อไป การศึกษาค้นคว้าอิสระนี้เป็นการวิจัยเชิงคุณภาพโดยวิธีวิจัยเอกสารซึ่งได้มาจากการศึกษาค้นคว้าจากตัวบทกฎหมาย ตำรา ผลงานทางวิชาการ วิทยานิพนธ์ สารนิพนธ์ คำวินิจฉัยของคณะกรรมการกฤษฎีกา และคณะอนุกรรมการพัฒนาระบบราชการเกี่ยวกับการตีความและวินิจฉัยปัญหากฎหมายในการบริหารราชการแผ่นดิน และเอกสารเผยแพร่อื่นที่เกี่ยวข้องของหน่วยงานหรือสื่ออิเล็กทรอนิกส์ ผลการศึกษาพบว่า พระราชบัญญัติระเบียบบริหารราชการแผ่นดิน (ฉบับที่ 7) พ.ศ. 2550 มิได้ มีการกำหนดระบุเจาะจงตำแหน่งของผู้มอบอำนาจและผู้รับมอบอำนาจไว้เป็นการเฉพาะ อีกทั้งผู้มอบอำนาจยังสามารถมอบอำนาจดังกล่าวให้แก่ผู้ดำรงตำแหน่งในส่วนราชการเดียวกันหรือส่วนราชการอื่นได้ จึงทำให้บทบัญญัติดังกล่าวไม่สอดคล้องกับหลักความชอบด้วยกฎหมายของการกระทำทางปกครอง และไม่ตรงตามเจตนารมณ์ของฝ่ายนิติบัญญัติซึ่งเป็นผู้ออกกฎหมาย ซึ่งอาจจะส่งผลต่อการใช้ดุลพินิจในการพิจารณาของผู้มีอำนาจในเรื่องนั้น อีกทั้งเมื่อพิจารณาลักษณะของอำนาจที่จะมอบก็เห็นว่าบทบัญญัติดังกล่าวได้กำหนดประเภทของการมอบอำนาจไว้เป็นสองประเภท ได้แก่ การมอบอำนาจการปฏิบัติราชการทั่วไป และการมอบอำนาจการอนุญาตตามกฎหมาย แต่มิได้มีการวางหลักเกณฑ์การแยกประเภทในเรื่องที่มอบอำนาจ ทำให้บทบัญญัติเกิดความไม่ชัดเจนและการแบ่งประเภทดังกล่าวก็ไม่สอดคล้องกับประเภทของการกระทำทางปกครองตามพระราชบัญญัติวิธีปฏิบัติราชการทางปกครอง พ.ศ. 2539 และพระราชบัญญัติจัดตั้งศาลปกครองและวิธีพิจารณาคดีปกครอง พ.ศ. 2542 จนสร้างความสับสนให้แก่ผู้อยู่ใต้บังคับกฎหมายฉบับดังกล่าว ดังนั้น จึงสมควร วางหลักเกณฑ์ ในการมอบอำนาจโดยแก้ไขปรับปรุงพระราชบัญญัติระเบียบบริหารราชการแผ่นดิน พ.ศ...... การมอบอำนาจให้สอดคล้องกับกฎหมายปกครองด้วย 2534 โดยกำหนดตำแหน่งของผู้มอบอำนาจและผู้รับมอบอำนาจให้ชัดเจน รวมทั้งกำหนดประเภทของการมอบอำนาจให้สอดคล้องกับกฎหมายปกครองด้วย
The independent study on delegation of acting authority according to the State Administration Act (Issue 7), B.E. 2550 (2007) aims to study concepts and theories of legality of administrative acts, and authorization criteria in order to analyze criteria and problems on authorization according to Section 38 of the State Administration Act (Issue 7), B.E. 2550 (2007) and propose a guideline to amend this act. This independent study is a qualitative research based on documentary research including laws, textbooks, academic articles, theses, dissertations, legal comments from the Council of State and the Public Sector Development Subcommission on decision and comment on legal problems in the government administrative laws, and other related publications or electronic media. The study revealed that the State Administration Act (Issue 7), B.E. 2550 (2007) did not specify positions of grantors and recipients of authority. Also, the authority grantors can designate power to government officials in the same division or in other divisions. This is in contrast with principles of government administration, legality of administrative act and does not meet the intention of the legislative branch who is the legislator. This may affect discretion of the person of authority. In considering the delegated authority in such act, delegated authority is categorized in two groups: authorization to general action and an authorization to legality permission. However, the Act does not prescribe any categorization criteria of the authorization which causes the unclarity. In addition, the categorization is not in accordance with that of the administrative act according to the Administrative Procedure Act, B.E. 2539 (1996) and the Act on Establishment of Administrative Court and Administrative Court Procedure, B.E. 2542 (1999), which causes confusion to the subjection under this Act. Thus, the authorization criteria should be prescribed through an amendment of the State Administration Act (Issue 7), B.E. 2550 (2007): positions of grantors and recipients of authority should be clearly specified, and types of delegation of authority should be categorized in accordance with the administrative laws.
