นิติพยาธิแพทย์กับการชันสูตรพลิกศพตามประมวลกฎหมายวิธีพิจารณาความอาญา

Abstract

การวิจัยเรื่อง นิติพยาธิแพทย์กับการชันสูตรพลิกศพตามประมวลกฎหมายวิธีพิจารณา ความอาญานี้ มีวัตถุประสงค์ เพื่อศึกษาแนวคิดทฤษฎีการชันสูตรพลิกศพ กฎหมายชันสูตรพลิกศพของประเทศไทยและต่างประเทศที่เกี่ยวข้องกับนิติพยาธิแพทย์ เพื่อนำมาวิเคราะห์ปัญหาและอุปสรรคในการชันสูตรพลิกศพ อันนำไปสู่ข้อสรุป และการเสนอแนวทางแก้ไขกฎหมายชันสูตรพลิกศพของประเทศไทยการวิจัยนี้เป็นการวิจัยเชิงคุณภาพ โดยการรวบรวมและศึกษาจากเอกสาร หนังสือ ตำรา บทความ วิทยานิพนธ์ บทวิเคราะห์ทางกฎหมาย บทบัญญัติกฎหมายที่เกี่ยวข้องกับการชันสูตรพลิกศพ ได้แก่ ประมวลกฎหมายวิธีพิจารณาความอาญา ร่างพระราชบัญญัติว่าด้วยการ ชันสูตรพลิกศพ พ.ศ. .... รวมทั้งสื่ออิเล็กทรอนิกส์ และเอกสารอื่น ๆ ทั้งภาษาไทยและต่างประเทศ ผลการวิจัยพบว่า ประมวลกฎหมายวิธีพิจารณาความอาญา และร่างพระราชบัญญัติว่าด้วยการชันสูตรพลิกศพ พ.ศ. .... ยังขาดความเหมาะสม เมื่อทำการศึกษาเปรียบเทียบแนวคิดทฤษฎีและกฎหมายชันสูตรพลิกศพของต่างประเทศ ได้แก่ รัฐแมสซาชูเซตส์ ประเทศสหรัฐอเมริกาประเทศอังกฤษ และประเทศญี่ปุ่น พบว่ากฎหมายชันสูตรพลิกศพของประเทศไทยควรปรับปรุงเนื้อหาในส่วนของการกำหนดหลักเกณฑ์ที่ต้องชันสูตรพลิกศพ การลดความเหลื่อมล้ำระหว่างองค์กรวิชาชีพที่ทำหน้าที่ชันสูตรพลิกศพ การกำหนดเงื่อนไขที่เป็นธรรมแก่แพทย์ผู้ปฏิบัติงานชันสูตรพลิกศพ การกำหนดบทบัญญัติให้ครอบคลุมถึงผู้ปฏิบัติงานที่เกี่ยวข้องทั้งหมดกำหนดหลักเกณฑ์การบริหารจัดการองค์กรชันสูตรพลิกศพ การสร้างระบบตรวจสอบถ่วงดุลอำนาจ และการตรวจสอบความพร้อมของบุคลากรฝ่ายต่าง ๆ ก่อนที่ร่างพระราชบัญญัติว่าด้วยการชันสูตรพลิกศพ พ.ศ. .... จะได้รับการตราเป็นกฎหมายต่อไป

The purposes of this research on “Forensic Pathologists in Medicolegal Autopsy according to The Criminal Procedure Code” are; to study concepts and theories about Medicolegal Autopsy, to study Thai and foreign Autopsy laws related to Forensic Pathologists, to analyze problems and obstacles in Medicolegal Autopsy, and leading to conclusions and revisions the Autopsy laws of Thailand. This research is qualitative research by collecting and studying data from documents, books, textbooks, legal articles, theses, legal analyses, legal provisions related to Medicolegal Autopsy, namely Criminal Procedure Code, Draft of Autopsies Act B.E. …., electronic media and other documents including both of Thai and foreign languages.The research found that Criminal Procedure Code and Draft of Autopsies Act B.E. …. are still inappropriate comparing to theoretical concepts and foreign autopsy laws including the state of Massachusetts - USA, England, and Japan. There is found that Thai Autopsy laws should improve the contents about the guideline for post-mortem examinations, reducing disparity between professional organizations performing Autopsy, determining fair conditions for medical examiners, determining legal provisions covering all relevant practitioners, established criteria for Autopsy organization management, creating checks and balances system, and checking availability of various personnel before the Draft of Autopsies Act B.E. …. will be promulgated
