การกำหนดหน้าที่ของผู้เกี่ยวข้องกับการศึกษาภาคบังคับตามพระราชบัญญัติการศึกษาภาคบังคับ พ.ศ.2545

Abstract

การศึกษาค้นคว้าอิสระนี้ มีวัตถุประสงค์ เพื่อกำหนดหน้าที่ของผู้เกี่ยวข้องกับการศึกษาภาคบังคับ ซึ่งประกอบด้วย พ่อแม่ ผู้ปกครอง ครู สถานศึกษาและองค์กรปกครองส่วนท้องถิ่น ให้ชัดเจน เพื่อแก้ไข กฎหมาย กฎ ระเบียบ ประกาศ ที่เกี่ยวกับการศึกษาภาคบังคับให้มีสภาพที่ทันสมัยและมีสภาพบังคับชัดเจน เพื่อยกเลิก กฎหมาย กฎระเบียบ ข้อบังคับที่เป็นอุปสรรคต่อการจัดการศึกษาภาคบังคับตามพระราชบัญญัติและรัฐธรรมนูญ การศึกษาค้นคว้าอิสระฉบับนี้ใช้วิธีวิจัยเชิงคุณภาพ ด้วยวิธีการวิจัยเอกสาร โดยศึกษาค้นคว้ารวบรวมข้อมูลจากแหล่งต่างๆ ได้แก่ กฎหมาย หนังสือ ข้อหารือ ความเห็นทางกฎหมาย วิทยานิพนธ์ สารนิพนธ์ บทความ และสื่อต่าง ๆ ที่เกี่ยวข้องกับการศึกษาภาคบังคับ ทั้งไทยและต่างประเทศ ผลการศึกษา พบว่า การกำหนดหน้าที่ของผู้เกี่ยวข้องกับการจัดการศึกษาภาคบังคับยังไม่ชัดเจน มีช่องว่างให้มีการละเลย ละเมิดไม่ปฏิบัติตามขั้นตอน และขาดสภาพบังคับในบางเรื่อง จึงจำเป็นต้องยกเลิกประกาศกระทรวงศึกษาธิการลงวันที่ 20 ตุลาคม 2554 เรื่อง การเก็บเงินบำรุงการศึกษาของสถานศึกษาสังกัดสำนักงานคณะกรรมการ การศึกษาขั้นพื้นฐานและออกกฎหมายที่ใช้บังคับกับผู้เกี่ยวข้องกับการศึกษาภาคบังคับ โดยกำหนดหน้าที่ของ 5 ฝ่ายหลักที่เกี่ยวข้องกับการศึกษาภาคบังคับ คือ 1) บิดา-มารดา 2) ผู้ปกครอง ที่ไม่ใช่บิดามารดา 3) ครู 4) สถานศึกษาและ 5) องค์กรปกครองส่วนท้องถิ่น ให้ปฏิบัติหน้าที่ตามเจตนารมณ์ของพระราชบัญญัติการศึกษาภาคบังคับ พ.ศ. 2545 และรัฐธรรมนูญแห่งราชอาณาจักรไทย

The objective of this independent study is to clearly assign duties to the related parties of Compulsory Education, consisting of parent, guardian, teacher, educational establishment, and local administrative organization, in order to amend laws, regulations, rules, and notifications related to compulsory education to have up-to-date condition and clear sanction, and in order to repeal of laws, regulations and rules, and by-law that have been obstacles toward compulsory education management under acts and constitutions. Qualitative research method was applied in this independent study using documentary research method whereas data from various sources consisting of laws, books, points of discussions, legal opinions, dissertations, thesis, articles and media related to compulsory education both in Thai and foreign language, were collected and analysed. The finding indicated unclear duty assignment to the related parties of the compulsory education management, available gap for omission, violation and breach of procedures, and lack of sanction in some matters. It is therefore are commind that the notification of the Ministry of Education dated 20 October 2011 on Collection of Educational Maintenance of the Educational Establishment under Office of the Basic Education Commission, and the enactment of the applicable laws for the related parties of the compulsory education have been required. The duties should be assigned to five key related parties of the compulsory education: father-mother, guardian who is not parent, teacher, educational establishment, and local administrative organization, to perform duties under intent of Compulsory Education Act B.E. 2545 (2002), and Constitution of the Kingdom of Thailand.
