Abstract
การศึกษาเรื่อง ปัญหาการใช้มาตรการบังคับเจ้าหน้าที่กรณีการทําละเมิดตามพระราชบัญญัติความรับ ผิดทางละเมิดของเจ้าหน้าที่ พ.ศ. 2539 นี้มีวัตถุประสงค์เพื่อ (1) ศึกษาแนวคิดทฤษฎีและหลักการบังคับทาง ปกครองและหลักกฎหมายของไทยและต่างประเทศที่ให้อํานาจในการดําเนินการกับเจ้าหน้าที่ผู้กระทําละเมิด และไม่ปฏิบัติตามคําสั่งทางปกครอง (2) ศึกษาแนวคิดทฤษฎีและหลักกฎหมายในการใช้มาตรการบังคับทาง ปกครองตามพระราชบัญญัติวิธีปฏิบัติราชการทางปกครอง พ.ศ. 2539 และการใช้บังคับมาตรการบังคับทาง ปกครองกับเจ้าหน้าที่ตามพระราชบัญญัติความรับผิดทางละเมิดของเจ้าหน้าที่ พ.ศ. 2539 (3) เพื่อศึกษาวิเคราะห์เกี่ยวกับกระบวนการบังคับทางปกครองของเจ้าหน้าที่โดยหน่วยงานของรัฐศึกษาเปรียบเทียบกับการใช้สิทธิฟ้องคดีต่อศาลเพื่อให้มีคําบังคับให้เจ้าหน้าที่ผู้กระทําละเมิดปฏิบัติตามคําสั่ง และปัญหาข้อกฎหมายที่ เกี่ยวข้อง (4) เพื่อเสนอแนะแนวทางแก้ไขปัญหาเกี่ยวกับการใช้มาตรการบังคับทางปกครองแก่เจ้าหน้าที่ ผู้กระทําละเมิดที่อยู่ภายใต้บังคับของคําสั่งทางปกครองและบุคคลภายนอกที่ได้รับผลกระทบจากการใช้ มาตรการบังคับทางปกครอง งานวิจัยเรื่องนี้เป็นการวิจัยทางกฎหมาย โดยใช้การวิจัยเชิงคุณภาพ ด้วยการวิจัยทางเอกสารจากหนังสือ ตํารา บทความ คําพิพากษา วารสาร และเอกสารข้อมูลจากสื่ออีเล็กทรอนิกส์ ทั้งกฎหมายของประเทศไทย และกฎหมายของต่างประเทศ โดยนําข้อมูลทั้งหมดมาวิเคราะห์และเปรียบเทียบเพื่อหาข้อสรุปและข้อเสนอแนะ จากการศึกษาพบว่า ปัญหาการใช้มาตรการบังคับทางปกครองกับเจ้าหน้าที่ของรัฐตามคําสั่งให้ชดใช้ ค่าเสียหายที่เกิดจากการกระทําละเมิดที่เจ้าหน้าที่ต้องรับผิดตามพระราชบัญญัติความรับผิดทางละเมิดของเจ้าหน้าที่ พ.ศ. 2539 นั้น สืบเนื่องจากบางหน่วยงานของรัฐไม่สามารถใช้มาตรการบังคับทางปกครองกับเจ้าหน้าที่ให้บรรลุผลตามคําสั่งดังกล่าวได้หน่วยงานของรัฐ จึงยื่นฟ้องต่อศาลปกครองเพื่อขอให้ศาลมีคําบังคับเรื่องมาตรการบังคับทางปกครองเพื่อใช้บังคับกับเจ้าหน้าที่ที่กระทําละเมิดจึงทําให้เกิดความล่าช้า จึงขอเสนอแนะแนวทางแก้ไขดังนี้ (1) หน่วยงานของรัฐต้องใช้มาตรการบังคับทางปกครองก่อนฟ้องคดีต่อศาล (2) จัดทําระเบียบกลางในการใช้มาตรการ บังคับทางปกรอง (3) แก้ไขกฎหมายและจัดทําระเบียบปฏิบัติการใช้มาตรการบังคับทางปกครอง (4) จัดตั้งหน่วยงานกลางเพื่อใช้มาตรการบังคับทางปกครอง (5) จัดทําข้อตกลงระหว่างหน่วยงานของรัฐเพื่อใช้มาตรการบังคับทางปกครอง
The objectives of this thesis on Problems on Applications of Administrative Enforcement Measures on State Officials under the Act on Liability for Wrongful Act of Officials B.E. 2539 are to (1) study theories and principles of administrative enforcement measures in Thailand and in foreign jurisdictions where state agencies are allowed to unilaterally take actions on tortfeasing state officials who refuse to comply with the enforcing administrative orders, (2) study theories and legal principles on the use of administrative enforcement measures under the Administrative Procedure Act B.E. 2539 and the use of administrative enforcement measures on tortfeasing state officials under the Act on Liability for Wrongful Act of Officials B.E. 2539, (3) analyze legal matters in relation to administrative enforcement procedures by state agencies on tortfeasing state officials by comparing with the process where state agencies choose to file a lawsuit to the Court enforcing the tortfeasing state official to comply with the enforcing administrative order, and ( 4 ) give suggestions and solutions to legal problems arising from the use of administrative enforcement measures on the tortfeasing officials and third persons who may be affected by the use of such measures This thesis uses a qualitative legal research approach through scholarly findings, judgments of Courts, digital and print media, and Thai and foreign laws to analyze, compare, and provide recommendation The study found that for the use of administrative enforcement measures on state officials of the administrative orders to make a payment for damages arising from state official’s tortious acts under the Act on Liability for Wrongful Act of Officials B.E. 2539 (1996), some state agencies that cannot effectively apply the enforcement measures on liable state officials have to file lawsuits to the Administrative Court asking for court’s decree on measure of enforcement to enforce such tortfeasing state officials. This causes the delay to the process. The proposed solutions are that: (1 ) state agencies have to use the administrative enforcement measures on state officials before filing a lawsuit to the Court; (2) there should be a general regulations on applications of administrative enforcement measures; (3) there should have law amendments and practice guidelines on applications of administrative enforcement measures on state officials; (4 ) the clearinghouse on applications of administrative enforcement measures on state officials should be set up; and (5) mutual agreements among state agencies on applications of administrative enforcement measures on state officials should be introduced.
