Abstract
การวิจัยเรื่อง การลงโทษที่เหมาะสมกรณีผู้เสพยาเสพติดนี้ มีวัตถุประสงค์เพื่อศึกษาถึง ความรู้ทั่วไป และแนวคิดทฤษฎีที่เกี่ยวกับการลงโทษผู้เสพยาเสพติด และศึกษาวิเคราะห์กฎหมายที่เกี่ยวข้องทั้งกฎหมายของประเทศไทย และ กฎหมายต่างประเทศ เพื่อนำมาศึกษาเปรียบเทียบและหาแนวทางในการลงโทษที่เหมาะสมสำหรับผู้เสพยาเสพติดในประเทศไทยอันจะนำไปสู่การลดจำนวน ของผู้กระทำผิดฐานเป็นผู้เสพและเพื่อลดจำนวนผู้ที่ผ่านการบำบัดฟื้นฟูสมรรถภาพตามกฎหมายพระราชบัญญัตฟื้นฟูสมรรถภาพผู้ติดยาเสพติด พ.ศ. 2545 ไม่ให้กลับมากระทำความผิดซ้ำอีก การวิจัยนี้เป็นการศึกษาวิจัยเชิงคุณภาพโดยการค้นคว้าจากเอกสารที่เกี่ยวข้องทั้ง ภาษาไทยและภาษาต่างประเทศได้แก่กฎหมายที่เกี่ยวข้อง ตำรา หนังสือ บทความ วิทยานิพนธ์ รายงาน การวิจัย รวมถึงข้อมูลทางสื่ออิเล็กทรอนิกส์โดยนำข้อมูลที่ได้มาประกอบการศึกษา
ผลการวิจัยพบว่าการบำบัดรักษาผู้เสพยาเสพติดตามพระราชบัญญัตฟื้นฟูสมรรถภาพ ผู้เสพยาเสพติด พ.ศ. 2545 นั้นเป็นรูปแบบการลงโทษเพื่อแก้ไขฟื้นฟูเพียงด้านเดียวไม่อาจเป็นผลให้ จำนวนผู้เสพลดลงได้ อีกทั้งวัตถุประสงค์ของการลงโทษนั้นควรมีจุดมุ่งหมายเพื่อเป็นการป้องกันสังคม การลงโทษจึงควรมีผลเป็นการเลิกเสพอย่างถาวรของผู้ที่ผ่านการบำบัด และป้องปรามผู้ที่คิดจะเป็นผู้เสพรายใหม่ เมื่อศึกษารูปแบบการลงโทษผู้เสพยาเสพติดของต่างประเทศจะเห็นได้ว่า การลงโทษกลุ่มผู้เสพของต่างประเทศเป็นการลงโทษที่ใช้ทฤษฎีแบบผสมกล่าวคือเป็นการลงโทษแบบแก้ไขฟื้นฟู กับการลงโทษเพื่อข่มขู่ยั้บยั้ง เช่นการลงโทษของประเทศสิงคโปร์ มาเลเซีย บรูไน เป็นต้น ซึ่งประเทศเหล่านี้สามารถลดจำนวนผู้เสพได้จริงผู้วิจัยจึงเสนอให้มีการลงโทษกลุ่มผู้เสพในกฎหมาย พระราชบัญญัตฟื้นฟูสมรรถภาพผู้ติดยาเสพติด พ.ศ.2545 ให้มีบทลงโทษเพื่อเป็นการแก้ไขฟื้นฟูในครั้งแรกและครั้งที่สองเท่านั้นโดยกำหนดไว้ใน มาตรา 19 ตามพระราชบัญญัตฟื้นฟูสมรรถภาพผู้ติดยาเสพติด พ.ศ.2545 หากมีการกระทำความผิดเป็นครั้งที่สามต้องมีการกำหนดโทษที่หนักขึ้น และ ต้องมีการกำหนดหน่วยงานที่ทำหน้าที่ ดูแล ติดตามผู้เสพหลังผ่านการบำบัดเป็นการเฉพาะ เพื่อมิให้ผู้เสพที่ผ่านการบำบัดแล้วกลับมาเสพซ้ำอีกและเป็นการลดจำนวนกลุ่มผู้เสพให้ได้อย่างแท้จริง
This research is concern about punishment for drug addicted. The objective to study general knowledge and general related punishment for drug addicted and to analyze related laws. This research compere Thai Law and Foreign Law to find guideline for appropriate punishment for drug addicted in Thailand so that may lead to decreasing amount of Culprit of drug addicted and decreasing in number of those who passed rehabilitation course of NARCOTIC ADDICT REHABILITATION ACT B.E. 2545 (2002) preventing from repeat violation This research is qualitative research by searching from related documents both Thai and foreign languages such as related Acts, textbook, journal, Thesis, Research report, include electronic information. From the research, found that the drug addict rehabilitation as accordance to NARCOTIC ADDICT REHABILITATION ACT B.E. 2545 (2002) is the punishment form which is only resolve or rehabilitate but does not effect to decrease number of drug addict. Moreover the propose of punishment should be social prevention so the punishment should effect on permanently stop using drugs on these who rehabilitated and prevent those who about to be new drug addict. By studied the drug addict punishment according to Foreign Law clearly found that the punishment of drug addicts is the integrated punishment between rehabilitation and threatening such as Singapore, Malaysia, Brunei. These countries can really reduce members of drug addicts. Consequently, The researcher purpose to add the punishment by the way of rehabilitation according to NARCOTIC ADDICT REHABILITATION ACT B.E. 2545 (2002) for only the drug addict for first and second time. By specific in section 19 of NARCOTIC ADDICT REHABILITATION ACT B.E. 2545 (2002) that if there is third time violation, such violation must be punished with harder punishment and must specify the agency who look after drug addict who has passed the rehabilitation course to repeat using drug. And that will actually decrease the numbers of drug addicts.
