Abstract
การศึกษาค้นคว้าอิสระเรื่องการใช้มาตรการบังคับทางปกครองเกี่ยวกับที่ดินสาธารณประโยชน์ประเภทพลเมืองใช้ประโยชน์ร่วมกันนั้น มีวัตถุประสงค์เพื่อ (1) ศึกษาถึงแนวคิดที่เกี่ยวกับการใช้มาตรการบังคับทางปกครองในการแก้ไขปัญหาการบุกรุกที่ดินสาธารณประโยชน์ประเภทพลเมืองใช้ประโยชน์ร่วมกัน (2) ศึกษา และวิเคราะห์ถึงมาตรการทางกฎหมายหรือมาตรการอื่น ๆ ที่นำไปใช้ในการแก้ไขปัญหาบุกรุกที่ดินสาธารณประโยชน์ประเภทพลเมืองใช้ประโยชน์ร่วมกัน การศึกษาค้นคว้าอิสระนี้ เป็นการวิจัยเชิงคุณภาพด้วยวิธีการวิจัยแบบเอกสาร โดยวิเคราะห์จากกฎหมายปกครอง พระราชบัญญัติวิธีปฏิบัติราชการทางปกครอง พ.ศ. 2539 ประมวลกฎหมายที่ดิน พระราชบัญญัติที่เกี่ยวข้อง พระราชกฤษฎีกา กฎกระทรวง ประกาศ ระเบียบ คำสั่ง และแนวทางปฏิบัติที่เกี่ยวข้องกับที่ดินสาธารณประโยชน์ ผลการศึกษาพบว่า การใช้มาตรการบังคับทางปกครองในการแก้ไขปัญหาการบุกรุกที่ดินสาธารณะไม่ได้บัญญัติไว้อย่างเป็นรูปธรรม อีกทั้งไม่ได้บัญญัติไว้ในกฎหมายที่เกี่ยวกับที่ดินสาธารณะ แต่ให้ใช้มาตรการบังคับทางปกครองโดยนำกฎหมายกลางมาเทียบเคียง ซึ่งกรณีดังกล่าวอาจเป็นปัญหาต่อการปฏิบัติ และขาดสภาพบังคับใช้อย่างจริงจัง เนื่องจากเกิดความไม่เหมาะสมกับสภาวการณ์ในปัจจุบัน ที่สำคัญกฎหมายเกี่ยวกับที่ดินสาธารณะได้ปรากฏอยู่ในความรับผิดชอบในหน่วยงานหลายหน่วยงาน จนเกิดความซ้ำซ้อนในการดำเนินการ จึงสมควรแก้ไขเพิ่ม และบัญญัติกฎหมายเพื่อประโยชน์ต่อการดำเนินงานในปัจจุบันและอนาคต ดังนี้ (1) ให้มีหน่วยงานหลักสำหรับการแก้ไขปัญหาความซ้ำซ้อนของหน่วยงานของรัฐในการดูแลรักษาที่ดินสาธารณะ และแก้ไขปัญหาการตีความกฎหมายเกี่ยวกับอำนาจหน้าที่ในการดูแลรักษาที่ดินสาธารณะ (2) การใช้มาตรการทางกฎหมายโดยเคร่งครัด โดยเฉพาะการใช้มาตรการบังคับทางปกครอง สำหรับแก้ไขปัญหาการบุกรุกที่ดินสาธารณประโยชน์ประเภทพลเมืองใช้ประโยชน์ร่วมกัน
The purpose of this research to study Enforcement of laws relating to land encroachment in public of Thailand. The purpose of this study. (1) To study is a law on the management of public lands similar to Thailand in the concept of the law relating to public land how to enforce the laws on the prevention and invasion of public land. (2) To study and analyze the use of the public Enforcement of laws or other measures to solve the invasion of public land. The result found that management public land in Thailand provisions appeared in many laws. To appear the responsible for several departments resulting in duplication of actions. The refore appropriate to amend and legislation for the benefit of the present and the future as following: 1) An update the law and regulations on the management of public lands. To resolve the problem of public land is unclear to solve problems caused by the lack of public participation in the management of public lands and resolve conflicts between the invaders and the people that want to use the land or the people with government agencies. 2) The primary agency for resolving the redundancy of government agencies in the maintenance of public lands. This causes problems in interpreting the law on the powers and duties of care. The use of legal measures strictly the problem for law enforcement government agencies.
