Abstract
การศึกษาค้นคว้าอิสระเรื่อง การกำหนดสิทธิในที่ดินของคนต่างด้าวนี้ มีวัตถุประสงค์เพื่อศึกษาแนวคิด ประวัติความเป็นมา หลักการและเหตุผล ในการกำหนดสิทธิในที่ดินของคนต่างด้าวตามหลักสากลในต่างประเทศและกฎหมายกำหนดสิทธิของประเทศไทย ตลอดจนแนวคิดที่ยินยอมให้คนต่างด้าวมีสิทธิในที่ดิน
ภายในประเทศได้ เพื่อศึกษาวิเคราะห์หาเหตุผลความจำเป็นที่ประเทศไทยต้องมีกฎหมายกำหนดสิทธิในที่ดินของคนต่างด้าวตามประมวลกฎหมายที่ดิน รวมถึงขั้นตอนการจดทะเบียนสิทธิและนิติกรรมการขอได้มาซึ่งสิทธิ ในที่ดินของคนต่างด้าวตลอดจนมาตรการทางกฎหมายที่ใช้บังคับอยู่ในปัจจุบันเพื่อการควบคุม กำกับ ดูแล
เกี่ยวกับการได้มาซึ่งสิทธิในที่ดินของคนต่างด้าว การป้องกันการถือครองที่ดินโดยไม่ถูกต้องตามกฎหมายและปัญหาการหลบเลี่ยงกฎหมายกำหนดสิทธิ ผลกระทบอันเกิดจากแนวคิดการให้สิทธิในที่ดินแก่คนต่างด้าวที่ส่งผลต่อประเทศไทยและชีวิตความเป็นอยู่ของคนในชาติ เพื่อเสนอแนะแนวทางแก้ไขปัญหาและหามาตรการ
บังคับทางกฎหมายให้มีสภาพบังคับอย่างเหมาะสมและสอดรับกับสภาพการณ์ในปัจจุบันการศึกษาค้นคว้าอิสระนี้ เป็นการวิจัยเชิงคุณภาพโดยวิธีวิจัยเอกสารจากการศึกษาค้นคว้า ตำรากฎหมาย กฎ ระเบียบ ข้อบังคับที่เกี่ยวข้อง บทความทางวิชาการ คำพิพากษาฎีกา ตลอดจนเก็บรวบรวมข้อมูลจากเอกสารทางกฎหมาย หนังสือเวียน หนังสือสั่งการ และประกาศ ของหน่วยงานราชการที่เกี่ยวข้องผลการศึกษาพบว่า กฎหมายกำหนดสิทธิในที่ดินของคนต่างด้าวเป็นการยินยอมให้คนต่างด้าวมี
สิทธิในที่ดินได้ภายใต้หลักเกณฑ์ เงื่อนไข และจำนวนเนื้อที่ที่กำหนด ตามประมวลกฎหมายที่ดิน และกฎกระทรวง โดยต้องได้รับอนุญาตจากพนักงานเจ้าหน้าที่ก่อนการจดทะเบียนสิทธิขอได้มาซึ่งที่ดิน หากกระทำการฝ่าฝืนครอบครองที่ดินโดยไม่ได้รับอนุญาตหรือครอบครองจำนวนเนื้อที่เกินกว่าจำนวนที่กฎหมายกำหนด มีมาตรการลงโทษทางอาญาและการบังคับขายที่ดิน ซึ่งถือว่าเป็นมาตรการทางกฎหมายที่ใช้กำกับดูแลและป้องกันไม่ให้ที่ดินต้องตกไปอยู่ในมือของต่างชาติโดยไม่อาจควบคุมได้ เพื่อความมั่นคงของประเทศและความมั่นคงทางเศรษฐกิจ ทั้งนี้จากการศึกษาพบว่ายังมีที่ดินจำนวนไม่น้อยที่ถูกครอบครองโดยต่างชาติและโดยฝ่าฝืนข้อกำหนด
สิทธิในที่ดิน โดยอาศัยช่องว่างของกฎหมายทั้งที่เป็นกฎหมายเฉพาะและกฎหมายทั่วไป และถือเป็นสาเหตุสำคัญที่ทำให้มาตรการตรวจสอบป้องกันไม่อาจใช้บังคับได้อย่างเป็นผล นอกจากนี้ผู้กระทำไม่เกรงกลัวโทษและความผิดเพราะมีโทษเพียงเล็กน้อยเมื่อเทียบกับประโยชน์ที่จะได้รับ ดังนั้น แนวทางแก้ปัญหาผู้มีหน้าที่เกี่ยวข้อง
ต้องร่วมมือกันทำให้มาตรการป้องกันและตรวจสอบมีความชัดเจนและเข้มแข็ง และทบทวนสภาพบังคับและมาตรการลงโทษกรณีฝ่าฝืนในลักษณะเบี้ยปรับให้มีระดับความเสียหายที่เหมาะสมกับมูลค่าที่ดิน
The objective of this independent study titled "The Determination of Foreigners' Land Rights under the Land Code" was to study the general concept of the determination of foreigners' land rights in foreign countries, its historical backgrounds, including major principle and its rationale, in comparative with relevant Thai laws and regulations, its concept in permitting foreigners to have land rights, to analyze the necessities of laws required for the determination of foreigners' land rights under the Land Code, together with the rules and procedures for the registration and transaction thereofand the existing legal measures governing such determination to prevent unlawful land possession by taking advantage of some loophole in the laws, and the impact on the living of Thai people and society. Hence, the recommendation was made to propose the way to solve problems, with effective legal measures appropriated with the present situation. This independent study was a qualitative research method conducted by documentary research from such various sources as textbooks, relevant laws and regulations, articles, supremecourtjudgements, data and information from other legal documents, circulation letters, orders and regulations of concerning authorities. The findings showed that the Land Code and its Ministerial Regulations prescribing the determination of foreigners' land rights had granted their rights to acquire land, in accordance with the rules and regulations, conditions and determined amount of land, with the permission of competent officials before registration. Any person fails to comply with the law to possess land without permission or acquire the exceedingamount of land, shall be subject to penalties and compulsory disposal of land in excess. These legal measures are enforced to prevent foreigners from acquiring the land without supervision for the sake of security and economy of the country. It was, however, significantly found that there was a lot of land possessed by foreigners against the laws by means of using the gap in the law, either in general or specific laws. These were the major causes that preventive measures could not be enforced efficiently and effectively. Furthermore, the offenders rather felt no shame or guilty of punishment for penalty in gainingback of benefits. Given the results from this study, it is proposed that concerned authorities have to cooperate to enable preventive and review of enforcement and supervisory measures. For example, fines, as penalty against offenders, are to be adjusted and increased to meet the level of damageand in appropriate with the value of the land.
