Abstract
การวิจัยเรื่อง ปัญหาการนำประมวลกฎหมายวิธีพิจารณาความแพ่งมาใช้ในมาตรการบังคับทาง ปกครอง ศึกษาเฉพาะกรณีการบังคับชำระหนี้เงิน มีวัตถุประสงค์เพื่อ 1) ศึกษาความเป็นมาของแนวคิดทฤษฎี เกี่ยวกับมาตรการบังคับทางปกครอง 2) ศึกษาวิธีการบังคับตามมาตรการบังคับทางปกครองที่กำหนดให้ชำระหนี้เงิน 3) ศึกษากฎหมายที่เกี่ยวข้องกับมาตรการบังคับทางปกครองที่กำหนดให้ชำระหนี้เงิน 4) ศึกษาแนวทางในการแก้ไขปัญหาการนำการบังคับคดีตามประมวลกฎหมายวิธีพิจารณาความแพ่งมาใช้กับกรณีมาตรการบังคับทางปกครองที่บังคับให้ชำระเงิน 5) วิเคราะห์ถึงปัญหาการบังคับใช้มาตราบังคับทางปกครองกรณีการบังคับชำระหนี้เงิน 6) เสนอแนวทางที่เหมาะสมในการแก้ไขเพิ่มเติม บทบัญญัติในประมวลกฎหมายวิธีพิจารณาความแพ่ง มาตรา 290 เรื่องอำนาจในการยึด หรืออายัดทรัพย์สิน ระหว่างเจ้าพนักงานผู้มีอำนาจใช้มาตรการบังคับทาง ปกครองและเจ้าพนักงานบังคับคดีตามคำสั่งศาล หรือแม้แต่ในระหว่างเจ้าพนักงานผู้มี อำนาจใช้มาตรการบังคับทางปกครองด้วยกันเอง 7) เผยแพร่แนวคิดและทฤษฎีในการบังคับคดี ตามประมวลกฎหมายวิธีพิจารณาความแพ่ง ภาคบังคับคดี เพื่อประโยชน์ในการนำมาประยุกต์ใช้กับการบังคับตามมาตรการบังคับทางปกครอง กรณีบังคับชำระหนี้เงิน การวิจัยครั้งนี้เป็นการวิจัยเชิงคุณภาพ ด้วยวิธีการวิจัยเอกสาร จากคำพิพากษาของศาลฎีกา ตำรา กฎหมาย บทความทางวิชาการ เอกสารประกอบการสัมมนา เพื่อนำมาเป็นฐานในทางทฤษฎี และนำข้อมูลที่ได้ทั้งหมดมาวิเคราะห์เพื่อนำไปสู่บทสรุปโดยวิธีพรรณา ผลการวิจัยพบว่า ปัญหาการใช้มาตรการบังคับทางปกครอง ที่ให้บังคับชำระหนี้เงินนั้น มีทั้งหมด 3 ปัญหา คือ 1) ปัญหาความซ้ำซ้อนกันของการยึดหรืออายัดทรัพย์สิน 2) ปัญหาเกี่ยวกับกำหนดระยะเวลาในการบังคับคดีโดยนำประมวลกฎหมายวิธีพิจารณาความแพ่งมาใช้บังคับในคำสั่งให้ใช้เงินของผู้มีอำนาจบังคับทางปกครอง 3 ) ปัญหาเกี่ยวกับความไม่เชื่อถือในอำนาจบังคับตามคำสั่งทางปกครอง ในปัญหาดังกล่าวผู้วิจัยขอเสนอให้แก่ ประมวลกฎหมายวิธีพิจารณาความแพ่ง มาตรา 290 โดยเพิ่มเติมให้มีเจ้าพนักงานผู้มีอำนาจตามกฎหมายอื่น ลงไปในมาตรา 290 ต่อจากเจ้าพนักงานผู้มีอำนาจทางภาษีอากรเพื่อให้เกิดความชัดเจนในการปฏิบัติและเสนอข้อแก้กฎหมายให้กรมบังคับคดีมีอำนาจบังคับคดีปกครองได้ด้วย เพราะเป็นหน่วยงานที่มีความชำนาญในการยึด อายัด และขายทอดตลาด ทั้งยังมีหน่วยงานกระจายอยู่ทุกศาลทั่วประเทศอยู่แล้ว
The purpose of this research on problems of applying the Code of Civil Procedure to Administrativee Measures. Case Study: Forced Repayment, are: 1) to study of the theory on administrative measures; 2) to study how to enforce the compulsory rules requiring repayment; 3) to study the laws relating to compulsory rules requiring repayment; 4) to study the problem of bringing a case under the Code of Civil Procedure applicable to cases of administrative measures to enforce payment; 5) to analyze the problem of enforcing the applicable statute governing the enforcement of repayment; 6) to propose appropriate amendments the provisions of the Code of Civil Procedure Section 290 on the power to seize or freeze assets the official authority compulsory administrative and official court order even during officially authorized the use of administrative measures themselves; 7) to disseminate ideas and theories in court according to the Code of Civil Procedure in order to bring cases to apply to enforcement of administrative measures for forced repayment. This research is a qualitative study. Documents from the judgment of the Supreme Court, legal texts, technical articles and seminar documents were studied. Data were analyzed to bring about descriptive conclusion. The research found three problems of applying administrative measures for forced repayment as follows. 1) The problem of duplicated seizure or attachment. 2) The problems with the timing of the execution and the Code of Civil Procedure and authorities forcing the repayment. 3) The problem with incredibility in the enforcement of the administrative order. In such problems, the researchers proposed to solve the Code of Civil Procedure Section. Officers authorized by the law in Section 290 should be added for clarity when operating. The law should be amended so the Legal Execution Department has the authority of the enforcement of the administrative order because it is an agency specialized in seizure, the court ruling as well. Because the agency has the expertise to seizure, freezing and auction. In addition, it has other sub-units in all courts in the country.
