Abstract
การศึกษารื่องนี้มีวัตถุประสงค์ 3 ประการคือ 1. เพื่อศึกษาถึงลักษณะการถูกละเมิดสิทธิมนุษยชนที่แรงงานต่างด้าวสัญชาติพม่าประสบอยู่ ในเขตอำเภอแม่แตง จังหวัดเชียงใหม่ 2. เพื่อศึกษาอุปสรรคขัดขวางในการที่แรงงามต่างค้าวสัญชาติพม่าจะได้รับผลประโยชน์ตามสิทสิทธิมนุยชน และ 3. เพื่อเสนอแนะมาตรการที่เหมาะสมสำหรับการป้องกันและแก้ไขปัญหาการละเมิดสิทธิมนุษยขนของแรงงานต่างด้าวสัญชาติพม่า การวิจัยครั้งนี้ เป็นการวิจัยเชิงคุณภาพ การเลือกกลุ่มตัวอย่างแบบเฉพาะเจาะจง จำนวน 5 กลุ่ม กลุ่มตัวอย่างที่ใช้ในการศึกษา คือ กลุ่มที่ 1 แรงงานต่างด้าวสัญชาติพม่า ในพื้นที่อำเภอแม่แตง จังหวัดเชียงใหม่ กลุ่มที่ 2 นายข้างในพื้นที่อำเภอแม่แตง จังหวัดเชียงใหม่ กลุ่มที่ 3 เจ้าหน้าที่ที่เกี่ยวข้องกับแรงงานต่างด้าว กลุ่มที่ 4 นักปกป้องสิทธิมนุษยชนในจังหวัดเชียงใหม่ และกลุ่มที่ 5 กำนัน/ผู้ใหญ่บ้านในอำเภอแตง จังหวัดเชียงใหม่ ผลการศึกษาพบว่า การละเมิดสิทธิมนุษยยชนของแรงงานต่างด้าว อำเภอเมืองแม่แตง ยังคงมีการละเมิดสิทธิมนุษยชนอยู่ เช่น 1.เรื่องค่าตอบแทน 2.เรื่องสวัสติการ แรงงานต่างด้าวบางส่วนที่ทำงานในสถานประกอบการขนาดเล็ก เช่น คนรับใช้ในบ้าน ทำงานมากกว่า & ชั่วโมงต่อวันและไม่มีค่าล่วงเวลา ตลอดอดจนสวัสติการใดๆ และสถานที่ทำงานบางแห่ง มีการทำงานที่เสี่ยงอันตราย โดยไม่มีอุปกรณ์ป้องกันให้ เช่น แรงงานก่อสร้าง และ 3.เรื่องความรุนแรง การด่าทออันเกิดจากชาตินิยมของคนไทย ในส่วนของกลไกของรัฐ ไทยและนโยบายที่เกี่ยวข้องกับแรงงานต่างด้าว มีความสอดดล้องกับหลักสิทธิมนุษยชนและหลักสิทธิแรงงาน แต่ในทางปฏิบัติยังไม่สามารถใช้ได้ผล เนื่องจากในสถามประกอบการบางแห่ง โดยเฉพาะสถานประกอบการขนาดเล็กนายข้างมักจะเป็นเข้าของคนๆ เดียว และมีอำนาจตัดสินใจในการบริหารงาน รัฐตรวจสอบได้ยาก จึงนำไปสู่การละเมิดสิทธิมนุษยชนในที่สุด
This study has three objectives: 1.to study the nature of human rights violationexperienced by Myanmar migrant workers in the district of Mae Taeng; 2. to study the obstruction Burmese migrant workers faced in accessing human rights benefits; and 3. to recommend appropriate measures for preventing and resolving Myanmar migrant workers' human rights violation. This research employs qualitative method. A specific sample group was selected for five groups. The samples used in the study are as follow: group 1- Myanmar migrant workers in the Mae Taeng district area Chiang Mai Province; group 2- Employers in Mae Taeng District Chiang Mai Province; group 3- Staff related to foreign workers; Group 4 -Human Rights Defenders in Chiang Mai Province and group 5 -Kamnan / Village Headman in Mae Taeng District Chiang Mai Province. The study found that Human Rights violation againstforeign workers Mueang Mae Taeng District Human rights continued in such areas as 1. Compensation. 2. Welfare, for example some migrant workers in small establishments, such as domestic workers, work more than 8 hours a day and do not havetheir overtime pay, neitheras any benefits. Also some workplaces have harzadousworkwithout protective equipment such as construction workers. And 3. violenceandrebuke caused by Thais. Regarding the Thai state mechanism and policies relating to foreign workers, they are consistent with human rights and labor rights principles. But in practice, they are not effectivedue to the fact that in some establishments especially small establishments the employersareusually owned by one person who has sole management decision making power.
