Abstract
การศึกษาค้นคว้าอิสระนี้มีวัตถุประสงค์เพื่อ 1. ศึกษาปัญหาพระราชบัญญัติรับราชการทหาร พ.ศ. 2497 ที่มีมาตรการเกณฑ์ทหารโดยวิธีบังคับ ซึ่งนับว่าไม่สอดคล้องกับบริบทของสังคมและโครงสร้างทางเศรษฐกิจของไทยในปัจจุบัน เมื่อเปรียบเทียบกับประเทศที่เปลี่ยนไปใช้การเกณฑ์ทหารด้วยวิธีสมัครใจแล้ว 2. เสนอมาตรการทางกฎหมายให้ยกเลิกการเกณฑ์ทหารโดยวิธีบังคับแล้วไปใช้ด้วยวิธีสมัครใจ อย่างเป็นระบบแบบไม่จำกัดเวลา เพื่อรักษาไว้ซึ่งศักยภาพของกองทัพ การศึกษาค้นคว้าอิสระนี้เป็นการวิจัยเชิงคุณภาพ ด้วยวิธีวิจัยทางเอกสารโดยศึกษาพระราชบัญญัติรับราชการทหาร พ.ศ. 2497 กฎหมายเกณฑ์ทหารของประเทศสหรัฐอเมริกา กฎหมายเกณฑ์ทหารของประเทศสิงคโปร์ หนังสือ บทความ เอกสารวิจัย วิทยานิพนธ์ คำพิพากษาศาล และข้อมูลจากเว็บไซต์ที่เกี่ยวข้อง นำมาเรียบเรียงศึกษาวิเคราะห์อย่างเป็นระบบ เพื่อให้ได้มาซึ่งข้อสรุปและข้อเสนอแนะ ผลการศึกษาพบว่า 1. การเกณฑ์ทหารไม่ว่าจะเป็นด้วยวิธีบังคับหรือด้วยวิธีสมัครใจขึ้นอยู่กับบริบทของสังคมและโครงสร้างทางเศรษฐกิจของแต่ละประเทศเป็นสำคัญ มิได้มีเหตุปัจจัยมาจากระบบกฎหมายแต่อย่างใด 2. ผู้ศึกษาจึงเสนอให้ประเทศไทยยกเลิกระบบการเกณฑ์ทหารจากวิธีบังคับที่ใช้อยู่ในปัจจุบันเป็นวิธีสมัครใจ โดยการปรับลดขนาดโครงสร้างกองทัพให้เล็กลง แต่ยังคงศักยภาพและประสิทธิภาพไว้ แล้วนำงบประมาณส่วนนี้ไปเพิ่มเป็นอัตราเงินเดือนและสวัสดิการของทหารให้มากขึ้น เพื่อเป็นการสร้างแรงจูงใจให้กับคนที่จะสมัครใจเข้ารับราชการทหาร ทั้งนี้เพื่อให้กฎหมายเกณฑ์ทหารของไทย มีพลวัตทันกับความเปลี่ยนแปลงโครงสร้างทางสังคมและเศรษฐกิจของประเทศ
This Independent Study is intended to study: 1. The problems of the Military Service Act B.E. 2497 which is system of conscription on draft by force. At present such system does not comply with the social and economic structure of Thailand when compared with some other countries that has changed to voluntary military service system. 2. The proposed solution to abolish conscription in the system on draft by force then changed to a voluntary method and not limited by time so that the potential of the army remains the same. This Independent Study is a qualitative research with documentary research methods from the Military Service Act B.E. 2497, military conscription law of the United States of America, military conscription law of the Singapore, books, articles, research papers, theses, and information from related websites, then study and systematic analysis the data in order to obtain conclusions and suggestions. The study indicated that: 1. Conscription whether it is with how to force or with how to voluntarily depending on the context of the society and the economic structure of each country. It does not have the factors from the legal system. 2. The study therefore proposes to abolish the conscription in the system on draft by force then changed to a voluntary method. By the restructuring of the army into small size and must not affect the potential and performance available, then bring the budget to increase salaries and various welfare for the private. This is to motivate people to voluntarily entered military service. Consequently, the military conscription law of Thailand should have been modern and development abreast of the changing social and economic structure of the country.
