การศึกษาค้นคว้าอิสระเรื่องการคุ้มครองผู้ถูกกล่าวหาและจำเลยในกระบวนการพิจารณาคดีของศาลฎีกาแผนกคดีอาญาของผู้ดำรงตำแหน่งทางการเมือง มีวัตถุประสงค์เพื่อศึกษาแนวคิดเกี่ยวกับการคุ้มครองสิทธิเสรีภาพของผู้ถูกกล่าวหาหรือจำเลย แนวคิดการจัดตั้งศาลและกระบวนพิจารณาในระบบไต่สวนของไทยเปรียบเทียบกับระบบไต่สวนที่ใช้ในศาลต่างประเทศ และศึกษาหลักเกณฑ์การอุทธรณ์คำพิพากษาศาลฎีกาแผนกคดีอาญาของผู้ดำรงตำแหน่งทาง การเมือง และวิธีพิจารณาชั้นอุทธรณ์ของที่ประชุมใหญ่ศาลฎีกากรณีการอุทธรณ์คำพิพากษาศาลฎีกาแผนกคดีอาญาของผู้ดำรงตำแหน่งทางการเมือง ในกรณีมีพยานหลักฐานใหม่ซึ่งอาจทำให้ข้อเท็จจริงเปลี่ยนแปลงไปในสาระสำคัญ พ.ศ. 2551 การวิจัยเรื่องนี้เป็นการวิจัยเชิงคุณภาพโดยวิธีการวิจัยทางเอกสาร จากการเก็บรวบรวม ข้อมูลจากตัวบทกฎหมาย หนังสือ บทความ เอกสารทางวิชาการ งานวิจัย วิทยานิพนธ์และข้อมูล จากเครือข่ายอินเตอร์เน็ตทั้งภาษาไทยและภาษาอังกฤษ ผลการศึกษาวิจัยผู้ศึกษาจึงเสนอแนวทางในการปรับปรุงแก้ไขกฎหมายที่เกี่ยวข้องกับหลักเกณฑ์การอุทธรณ์คำ พิพากษาของศาลฎีกาแผนกคดีอาญาของผู้ดำรงตำแหน่งทางการเมือง
The objectives of the independent study titled “Protection of The Accused or Defendant in Procedure of The Supreme Court’s Criminal Division for Person Holding Political Positions” were to study theories and rules in relation to the protection of individual rights and liberties of an accessed or defendant, study the idea of establishing the court and a comparative study between the inquisitorial procedure of Thailand and foreign counties, and study the appealing judgment of The Supreme Court’s Criminal Division for Person Holding Political Positions and the appealing procedure and the Appealing Regulation of The Supreme Court’s Criminal Division for Person Holding Political Positions in Relation to Newly-discovered Evidence that Impact the Principal Facts, B.E. 2551. The research is a qualitative and documentary research based on legal documents, law codes, books, articles, academic papers, researches, thesis and other documents from internet in Thai and English. The result of the study was to propose that there should be an amendment to the law and regulation on appealing procedure and relevant criteria of judgment of The Supreme Court’s Criminal Division for Person Holding Political Positions.
