Abstract
การศึกษาค้นคว้าอิสระนี้มีวัตถุประสงค์เพื่อศึกษาแนวคิดเกี่ยวกับวิชาชีพครู จรรยาบรรณวิชาชีพครู วินัยข้าราชการครู กฎหมายเกี่ยวกับการประกอบวิชาชีพครูและวินัยข้าราชการครู ปัญหา การจัดหาตำแหน่งอื่นให้แก่ข้าราชการครูที่ถูกเพิกถอนใบอนุญาตประกอบวิชาชีพทางการศึกษา ตามมาตรา 109 แห่งพระราชบัญญัติระเบียบข้าราชการครูและบุคลากรทางการศึกษา พ.ศ. 2547 และเสนอแนวทางแก้ไขปัญหา การศึกษาค้นคว้าอิสระนี้ เป็นการเชิงคุณภาพ ด้วยวิธีวิจัยเอกสาร โดยศึกษา ค้นคว้า รวบรวมข้อมูลจากบทบัญญัติแห่งกฎหมายที่เกี่ยวข้อง ตำราทางวิชาการ วิทยานิพนธ์ สารนิพนธ์ บทความทางกฎหมาย รวมทั้งข้อมูลอื่น ๆ ทางอิเล็กทรอนิกส์ ผลการศึกษาพบว่า ตามมาตรา 109 แห่งพระราชบัญญัติระเบียบข้าราชการครูและบุคลากรทางการศึกษา พ.ศ. 2547 ไม่ได้กำหนดรายละเอียดเกี่ยวกับกรณีข้าราชการครู ถูกเพิกถอนใบอนุญาตประกอบวิชาชีพทางการศึกษาและเป็นความผิดวินัยไว้ ซึ่งความผิดทางจรรยาบรรณวิชาชีพครูอาจเข้าข่ายความผิดทางวินัยได้หลายลักษณะทั้งร้ายแรงหรือไม่ร้ายแรงและเกี่ยวพันกับคุณสมบัติของตำแหน่งที่จะจัดหาให้ ผู้ศึกษามีข้อเสนอแนะในการแก้ไขปัญหา คือ แก้ไขเพิ่มเติมมาตรา 109 แห่งพระราชบัญญัติระเบียบข้าราชการครูและบุคลากรทางการศึกษา พ.ศ. 2547 โดยกำหนดให้มีการดำเนินการทางวินัยก่อนการจัดหาตำแหน่งอื่นที่ไม่ต้องมีใบอนุญาตประกอบวิชาชีพทางการศึกษา และกำหนดยกเว้นกรณีเป็นความผิดวินัยอย่างร้ายแรงที่ไม่ต้องจัดหาตำแหน่งอื่นที่ไม่ต้องมีใบอนุญาตประกอบวิชาชีพทางการศึกษา นอกจากนี้ ยังควรกำหนดให้ข้าราชการของคุรุสภาที่ได้รับมอบหมายเข้าร่วมเป็นกรรมการในคณะกรรมการสอบสวนวินัย และเข้าร่วมเป็นกรรมการในชั้นพิจารณาอุทธรณ์ โดยเข้าร่วมเป็นกรรมการในคณะกรรมการศึกษาธิการจังหวัด (กศจ.) หรือ อ.ก.ค.ศ. เขตพื้นที่การศึกษา ที่คณะกรรมการข้าราชการครูและบุคลากรทางการศึกษา (ก.ค.ศ.) ตั้ง หรือ ก.ค.ศ. แล้วแต่กรณี และนำผลการพิจารณาความผิดวินัยผูกพันเป็นผลการพิจารณาความผิดจรรยาบรรณของวิชาชีพ เพื่อแก้ไขปัญหาการทับซ้อนของการบังคับใช้กฎหมายว่าด้วยข้าราชการครูและบุคลากรทางการศึกษาและกฎหมายว่าด้วยสภาครูและบุคลากรทางการศึกษาในเรื่องการเพิกถอนใบอนุญาตที่เกี่ยวเนื่องกับความผิดทางวินัยต่อไป
This independent study aims to study the concept of teacher profession, code of conduct for teachers, disciplinary provisions and the related law on teacher profession and teacher discipline, the problem of providing other positions to teachers whose licenses to conduct professional education have been revoked under Section 109 of the Teachers and Educational Personnel Act B.E. 2547, and to propose solutions to the problem. The study was a qualitative and documentary research by analyzing provisions of the relevant legislation, academic texts, theses, dissertations, legal articles, as well as other electronic information. The study found that Section 109 of the Teachers and Educational Personnel Act B.E. 2547 stipulates no details about the case of teachers whose educational licenses have been revoked and disciplinary offenses. Since the causes to revoke the licenses may be the same as those of disciplinary offenses, misconduct or gross misconduct and relates to qualifications of the provided positions. The study suggested that Section 109 of the Teachers and Educational Personnel Act B.E. 2547 should be amended to include disciplinary action before the provision of other positions to those teachers and it should not provide them other positions in the case of a serious disciplinary offense. Moreover, the personnel of the Teachers Council should be assigned to be a member of the discipline investigation committee and a member of the appellate body, that is, a member of the Provincial Education Commission or Teachers and Educational Personnel (TEP) subcommittee in educational service area established by the Commission for Teacher Education and Educational Personnel (TEPC), as the case may be. The results of the disciplinary offense decision should also be considered as the result of professional misconduct in order to solve the problem on overlapping enforcement of the law on teachers and educational personnel and the law on teacher profession on the matter of revocation of licenses on the ground of disciplinary offences.
