Abstract
การศึกษาก้นคว้าอิสระนี้มีวัตถุประสงค์เพื่อศึกษาความเป็นมาและของกฎหมายและการบังคับใช้กฎหมายที่มีผลกระทบกับผู้ขับขี่รถจักรยานยนต์ในประเทศไทย ศึกษาและวิเคราะห์ ปัญหาของกฎหมายและการบังคับใช้กฎหมายที่มีผลกระทบกับผู้ขับขี่รถจักรยานยนต์ในประเทศไทย และเสนอแนวทางที่เหมาะสมในการปรับปรุงแก้ไขกฎหมายและการบังคับใช้กฎหมายที่มี ผลกระทบกับผู้ขับขี่รถจักรยานยนต์ในประเทศไทย การศึกษาค้นคว้าอิสระนี้เป็นการวิจัยเชิงคุณภาพด้วยการวิจัยทางเอกสารจากการเก็บ รวบรวมข้อมูลจากตัวบทกฎหมาย หนังสือบทความ เอกสารทางวิชาการ งานวิจัย วิทยานิพนธ์ และ ข้อมูลจากเครือข่ายอินเตอร์เน็ตทั้งภาษาไทยและภาษาอังกฤษ ผลการศึกษาพบว่า เนื่องจากกฎหมายที่มีผลกระทบกับผู้ขับขี่รถจักรยานยนต์ ในประเทศไทยไม่ได้รับการแก้ไขปรับปรุงมาเป็นระยะเวลานาน แม้จะเคยมีการแก้ไขปรับปรุง ในส่วนอื่น ๆ มาหลายครั้งแต่กฎหมายในส่วนที่เกี่ยวกับผู้ขับขี่จักยานยนต์ให้เหมาะสมกับสภาพ การในปัจจุบันอย่างจริงจัง โดยกกฎหมายที่บังคับใช้อย่างไม่เหมาะสมกับสภาพการในปัจจุบันนั้น ก่อให้เกิดช่องทางในการแสวงหาผลประโยชน์สำหรับเจ้าหน้าที่รัฐอันจะทำให้ประชาชนไม่ยอมรับ ต่อกระบวนการยุติธรรมและก่อให้เกิดความไม่สงบเรียบร้อยในสังคม
The objectives of the research on Enforcement Affecting Motorcycle Riders are to study the importance of laws and its enforcement to motorists in Thailand, to study and analyze the problems of laws and its enforcement affecting motorcycle riders in Thailand and Proposing appropriate guidelines to improve the laws and its enforcement affecting motorcyclists in Thailand. This independent study was a qualitative research, with documentary research collected from the law. Article Books Research papers, dissertations, and information from the Internet in both Thai and English. The results indicated that the law that affects motorcycle riders in Thailand has not been amended for a long period of time. However, many other amendments have been made in the past, the law that apply to the current conditions is not suitable for the current situation. Consequently, provides channels for corruption by some state officers and the public will not accept the justice process and cause unrest in society.
