Abstract
การวิจัยครั้งนี้มีวัตถุประสงค์เพื่อ (1) ศึกษาประวัติความเป็นมาของนโยบายการบริหารจัดการที่ดินในประเทศไทยตั้งแต่ครั้งโบราณ ตลอดจนมูลเหตุของการเปลี่ยนแปลงระบบการจัดการที่ดินมาสู่รูปแบบในปัจจุบัน (2) ศึกษาปัญหาราษฎรเข้ายึดถือครอบครองที่ดินสงวนหวงห้ามของรัฐ (3) วิเคราะห์ความล้มเหลวของนโยบายการแก้ไขปัญหาการบุกรุกและการจัดการที่ดินของรัฐ (4) วิเคราะห์ร่างพระราชบัญญัติการบริหารจัดการที่ดินสงวนหวงห้ามของรัฐ พ.ศ. .... ว่าจะสามารถแก้ไขปัญหาการบุกรุกและการจัดการที่ดินของรัฐได้ภายในเวลาที่กาหนดหรือไม่หากไม่สำเร็จควรมีแนวทางแก้ไขปัญหาอย่างไร โดยศึกษาอ้างอิงจากเอกสารข้อมูลทางประวัติศาสตร์ ประชากรศาสตร์ การตั้งถิ่นฐานบ้านเรือน ตลอดจนข้อมูลทางด้านเศรษฐกิจ นโยบายของรัฐ และกฎหมายของไทยเกี่ยวกับระบบกรรมสิทธิ์ที่ดินและการจัดการที่ดินของรัฐจากอดีตถึงปัจจุบัน ประกอบการวิเคราะห์ร่างพระราชบัญญัติการบริหารจัดการที่ดินสงวนหวงห้ามของรัฐ พ.ศ. .... และสรุปผลการศึกษาเสนอแนะแนวทางการแกไข้ ผลการวิจัยพบว่า ปัญหาเรื่องที่ดินทำกินและการบุกรุกที่ดินของรัฐเกิดจากปัญหาด้านสังคมเศรษฐกิจประชากร ข้อผิดพลาดจากการกำหนดนโยบายของรัฐในการกระจายการถือครองที่ดิน ปัญหาความไม่เป็นเอกภาพขององค์กรบริหารจัดการที่ดินของรัฐ และปัญหากฎหมายที่ใช้บังคับ โดยการวิจัยในครั้งนี้สนับสนุนให้มีกฎหมายเกี่ยวกับการจัดการที่ดินเพื่อการแก้ไขปัญหาการบุกรุกที่ดินของรัฐเนื่องจากขณะนี้ยังไม่มีกฎหมายที่ใช้ในการแก้ไขปัญหาดังกล่าวโดยตรง
The objectives of this study were: (1) to study the history of land management law in Thailand since ancient times and cause of land management system changing at the present (2) to study the naked possession of the land reserves of the state (3) to analyze the failure policies in case of land management law and prohibit possession of the state (4) to analyze Conserved Land Management Act, B.E. ……….. can solve the encroachment and land management within a specific time or not. If it was not, what the solution is. The research was studied from historical data, demography, house settlement as well as economic data, government policy and Thai law about land ownership and land management of the state from the past to present. Also analyzing Conserved Land Management Act, B.E………….. and conclusion about the suggestion. The results of the study have shown that the problems of land and land invasion were occurred by social, economic, population issues the mistake of the policy about land distribution, the heterogeneity of the organization for land management and applicable law. This research was supported by the law on land management to solve the encroachment issue in the government land because there are currently no laws to resolve these issues.
