Abstract
การศึกษาค้นคว้าอิสระ เรื่องการใช้บังคับกฎหมายควบคุมอาคารกับอาคารชุดนี้ มีวัตถุประสงค์เพื่อได้ทราบถึงความเป็นมา ของการบังคับใช้กฎหมายควบคุมอาคารกับอาคารชุด ซึ่งโดยทั่วไปเป็นอาคารสูงเพื่อศึกษาถึงมาตรการทางกฎหมายควบคุมอาคารกับอาคารชุดศึกษาปัญหาและวิเคราะห์ปัญหาเกี่ยวกับกฎหมายควบคุมอาคารกับอาคารชุดศึกษาหาแนวทางในการแก้ไขปัญหาการบังคับใช้กฎหมายควบคุมอาคารกับอาคารชุด การศึกษาค้นคว้าอิสระเรื่องนี้ เป็นการวิจัยเชิงคุณภาพ ด้วยวิธีการวิจัยทางเอกสารโดยการศึกษาค้นคว้าและรวบรวมจาก งานวิจัยทางกฎหมายต่าง ๆ ที่เกี่ยวข้อง รวมถึงหนังสือ บทความ รายงาน จากห้องสมุดสถาบันต่าง ๆ ทั้งหน่วยของรัฐและเอกชน เอกสารทางราชการ เอกสารเข้าร่วมสัมมนา ข้อมูลที่ค้นคว้าและรวบรวมทางอินเตอร์เน็ต ประกาศของทางราชการ รายงานการวิจัย วิทยานิพนธ์ที่เกี่ยวข้องกับกฎหมายควบคุมอาคาร ผลการศึกษาพบว่ากฎหมายควบคุมอาคาร ที่ออกมาบังคับใช้ในรูปของพระราชบัญญัติควบคุมอาคาร พ.ศ. 2522 กฎกระทรวง และข้อบัญญัติท้องถิ่น เพื่อควบคุมการก่อสร้างอาคารชุด ซึ่งส่วนใหญ่เป็นอาคารสูง ยังมีประเด็นปัญหา คือ ปัญหาการขยายเวลาใบอนุญาตก่อสร้างอาคารชุด วิธีการแก้ไขคือให้ขยายเวลาเพิ่มได้เท่าที่อนุญาตในครั้งแรก ปัญหาระบบความปลอดภัยจากอัคคีภัยในอาคารชุด วิธีการแก้ไขคือให้นิติบุคคลอาคารชุดดำเนินการติดตั้งเครื่องดับเพลิงตามขนาด ที่เหมาะสมหนึ่งเครื่องต่อหนึ่งห้องชุดปัญหาการใช้มาตรฐานในการคำนวณการออกแบบอาคารเพื่อต่อต้านการสั่นสะเทือนของแผ่นดินไหว วิธีการแก้ไขโดยให้เพิ่มมาตรฐานในการคำนวณการออกแบบอาคารเพื่อต่อต้านการสั่นสะเทือนของแผ่นดินไหว ในนิยาม “รายการประกอบแบบแปลน” และปัญหาเรื่องอาคารเก่าชำรุดทรุดโทรม วิธีการแก้ไขโดยให้เพิ่มนิยาม “อาคารเก่าชำรุดทรุดโทรม” และกำหนดหมวดเพิ่มเติมในกฎหมายควบคุมอาคาร พร้อมกำหนดบทลงโทษ
This independent study on “Enforcement of Building and Condominium Control Act” aims to study the history of the enforcement laws on the control of buildings and condominiums, which are generally vertical buildings, including studying legal measures concerning the control of buildings and condominiums, studying and analyzing the problems relating to building and condominium control law enforcement, and determining proper solutions for such problems. This study is a qualitative and documentary research by collecting data from relevant researches, including books, articles and reports from both private and public institutions, official documents, seminar materials, internet sources, official notifications, study reports and dissertations relevant to Building Control Act. According to study results, building control laws are currently enforced in a form of Building Control Act B.E.2522, Ministerial regulations and local legislation to control the construction of condominiums which are vertical buildings. However, several problems can still be found namely the extension of permit for construction of condominiums which can be solved by allowing the same period of permit extension as the first extension, problem concerning fire protection system among condominiums which can be solved by requiring installation of suitable fire extinguisher in every unit, problem concerning seismic design requirements for buildings (Seismic Design Code) which can be solved by including seismic design requirements in “Specifications” and lastly the problem of degraded/damaged condominium buildings which can be solved by including the definition of “degraded/damaged condominium building” and incorporating additional section in Building Control Act including with related penalty.
