Abstract
การวิจัยเรื่อง พระราชบัญญัติข้อมูลข่าวสารของราชการ พ.ศ.2540 กับการเปิดเผยสํานวนการสอบสวน คดีอาญา มีวัตถุประสงค์เพื่อศึกษาขอบเขตและสิทธิของผู้เสียหาย ผู้ต้องหา จําเลย ผู้มีส่วนได้เสียในการเข้าถึงข้อมูล ข่าวสารของราชการในรูปสํานวนการสอบสวนในชั้นพนักงานอัยการ ตามพระราชบัญญัติข้อมูลข่าวสารของราชการ พ.ศ. 2540 และกฎหมายอื่น ปัญหาที่เกิดจากการบังคับใช้กฎหมายและการใช้ดุลพินิจของพนักงานอัยการในกรณีที่มีผู้ยื่นคําขอ ข้อมูลข่าวสารในรูปสํานวนการสอบสวน และหาแนวทางที่เหมาะสมในการบังคับใช้กฎหมายและการใช้ดุลพินิจของ พนักงานอัยการในกรณีการเข้าถึงข้อมูลข่าวสารของราชการดังกล่าว งานวิจัยเรื่องนี้เป็นการวิจัยทางกฎหมาย โดยการวิจัยเชิงคุณภาพ ด้วยการวิจัยทางเอกสาร จากข้อมูลคําวินิจฉัยของคณะกรรมการวินิจฉัยการเปิดเผยข้อมูลข่าวสารสาขาสังคม การบริหารราชการแผ่นดินและการบังคับใช้ กฎหมายในส่วนที่เกี่ยวข้องกับพนักงานสอบสวนและพนักงานอัยการในการอุทธรณ์ขอให้เปิดเผยสํานวนการสอบสวนเป็นหลัก ผลการวิจัยพบว่าสํานวนการสอบสวนที่พนักงานอัยการยังไม่มีคําสั่งเด็ดขาดทางคดีนั้นเป็นข้อมูลข่าวสารที่ ไม่สมควรเปิดเผย เพราะการเปิดเผยอาจทําให้การบังคับใช้กฎหมายเสื่อมประสิทธิภาพหรือไม่อาจสําเร็จตามวัตถุประสงค์ได้ แต่ถ้าคดีนั้นมีคําสั่งเด็ดขาดไม่ฟ้องหรือคําสั่งยุติคดีแล้ว การเปิดเผยย่อมไม่ทําให้การบังคับใช้กฎหมายเสื่อม ประสิทธิภาพหรือไม่บรรลุวัตถุประสงค์ดังกล่าวแต่อย่างใด ยกเว้น การเปิดเผยจะก่อให้เกิดความเสียหายต่อความมั่นคงของประเทศ เพื่อรักษาความสงบเรียบร้อยหรือเป็นข้อมูลข่าวสารส่วนบุคคล ส่วนปัญหาการบังคับใช้กฎหมายและการใช้ดุลพินิจของพนักงานอัยการในกรณีนี้พบว่าพนักงานอัยการจะใช้ดุลพินิจเปิดเผยโดยพิจารณาในเชิงผู้มีสิทธิเข้าถึงสํานวน การสอบสวนและเนื้อหาในสํานวนการสอบสวนที่เข้าถึงได้ตามเงื่อนไขในประมวลกฎหมายวิธีพิจารณาความอาญาเป็นสําคัญ แต่อย่างไรก็ตามสิทธิของผู้เสียหาย ผู้ต้องหา จําเลยหรือผู้มีส่วนได้เสีย ตามมาตรา 8(6) วรรคสามและมาตรา 146 วรรคสอง แห่งประมวลกฎหมายวิธีพิจารณาความอาญานั้นเป็นเพียงสิทธิขั้นพื้นฐาน บุคคลเหล่านั้นอาจใช้สิทธิตาม พระราชบัญญัติข้อมูลข่าวสารของราชการ พ.ศ.2540 ซึ่งเป็นกฎหมายที่รองรับสิทธิของบุคคลตามรัฐธรรมนูญที่ขยายสิทธิ ของประชาชนในการเข้าถึงข้อมูลข่าวสารของราชการให้กว้างขวางยิ่งกว่าได้ สําหรับแนวทางที่เหมาะสมในการบังคับใช้กฎหมายและการใช้ดุลพินิจของพนักงานอัยการนั้น ควรมีการพัฒนาองค์ความรู้และความเข้าใจในหลักการของกฎหมาย ว่าด้วยข้อมูลข่าวสารของราชการแก่พนักงานอัยการ และแก้ไขเพิ่มเติมประมวลกฎหมายวิธีพิจารณาความอาญาขยายสิทธิ ของประชาชนในการเข้าถึงสํานวนการสอบสวนให้กว้างขวางยิ่งขึ้นและกำหนดนิยามคําว่า “ผู้มีส่วนได้เสีย” ไว้ในระเบียบ ภายในของสํานักงานอัยการสูงสุดให้ชัดเจนเพื่อความสะดวกในการใช้ดุลพินิจของพนักงานอัยการ
The purpose of this research is to study the limitations and rights of the injured person, alleged offender, accused and interested person to acquire official information in the filing of inquiry during public prosecution under the Official Information Act, B.E. 2540. Also, the study aims to examine other laws and problems which occur by legal enforcement and the exercise of discretion by public prosecutor when official information disclosure is requested in the filing of inquiry. Altogether, the study seeks to find an appropriate way to enforce the law and for the public prosecutor to exercise the discretion in such case This research is a legal research using documentary research methods from the decisions of the Information Disclosure Tribunal for Social Affairs, Public Administration and Law Enforcement in parts that involve the discretion of inquiry officials and public prosecutors when faced with appeals for disclosing the file of inquiry. The result of this research finds that the file of inquiry, in which the public prosecutor does not yet have a decision, should not be disclosed because it will make the legal enforcement less efficient or incomplete. Whereas, the file of inquiry, in which the public prosecutor has already made the final decision to decline prosecution or terminate the case, can be disclosed without any effects of the legal enforcement, except where information is personal or is a matter of national security. Moreover, on the subject of legal enforcement and the exercise of discretion by public prosecutor, the public prosecutor will exercise his discretion to disclose the file of inquiry by considering the applicant and the content in that file under the Criminal Procedure Code of Thailand. However, the rights of the victim, accused offender, defendant and interested person under Section 8(6) and Section 146 of the Criminal Procedure Code of Thailand are just primary rights which these individuals are able to exercise under the Official Information Act, B.E. 2540, the law which affirms the rights of Thai people as stated in the Constitution of the Kingdom of Thailand. In summary, for appropriate law enforcement and discretion of the public prosecutor in this area, we should develop the perception and knowledge of the principle of official information law for public prosecutors, amend the Criminal Procedure Code of Thailand by extending the right to access the file of inquiry, and clearly define “interested person” in the Attorney General regulation.
