Abstract
วิิทยานิพนธ์ฉบับนี้ทำการศึกษา เพื่อทราบถึงแนวความคิดทางด้านนิติศาสตร์ โดยเฉพาะด้านกฎหมายมหาชน ด้านนิติปรัชญา และแนวคิด ทฤษฎี ในทางรัฐศาสตร์ ที่เกี่ยวข้องกับสิทธิของประชาชนในการปกป้องตนเองจากการปกครองที่ไม่เป็นธรรม รวมถึงเพื่อทราบถึงขอบเขตสิทธิพิทักษ์รัฐธรรมนูญของชนชาวไทย ที่บัญญัติรับรองไว้ในรัฐธรรมนูญฯ ฉบับปัจจุบัน และในอดีต ว่ามีขอบเขตเพียงใด อีกทั้งเพื่อเสนอถึงความเหมาะสมของขอบเขตสิทธิพิทักษ์รัฐธรรมนูญของชนชาวไทยที่มีอยู่ในปัจจุบันว่าควรมีลักษณะเช่นใด การศึกษาวิจัยวิทยานิพนธ์นี้ ใช้วิธีวิจัยในเชิงคุณภาพโดยวิจัยจากเอกสาร เพื่อนำแนวคิดและข้อมูลที่เกี่ยวข้อมานำเสนอในลักษณะพรรณนาและวิเคราะห์ ผลการศึกษาพบว่า บทบัญญัติแห่งรัฐธรรมนูญแห่งราชอาณาจักรไทย (ฉบับ พ.ศ. 2550) มาตรา 69 เกี่ยวกับสิทธิในการพิทักษ์รัฐธรรมนูญ โดยมีสิทธิต่อต้านโดยสันติวิธีนั้นไม่เพียงพอและเหมาะสม จึงเสนอให้แก้ไขจากเดิมที่รับรองขอบเขตให้ปวงชนชาวไทยพิทักษ์รัฐธรรมนูญได้โดยสันติวิธีเท่านั้น เป็นการรับรองสิทธิโดยไม่จำกัดวิธีการที่จะใช้พิทักษ์ เพียงแต่่วิธีการนั้น ต้องสมควรแก่เหตุและสมควรแก่กรณี
The main purpose of this thesis is to study about jurisprudence, especially; public law, legal philosophy and political theories which relate to the rights of people to protect themselves from the unfairness. It is also study the confinement of the right to protect the constitution of the Thai people that was and is provided in the previous and current Constitutions. In addition, it is to propose the proper way that how the right to protect the constitution should be. The study of this Thesis is based on documentary research method in order to convey the concepts and related information and propose them as a descriptive and analysis approach. From the study, it is found that Section 69 in the Constitution of the Kingdom of Thailand, B.E. 2550 which is about the right to protect the constitution that vest the Thai people their right to resist peacefully, is not sufficient details and inappropriate as it should be. So, this thesis is proposing an amendment in the current Constitution from that it assures the right to resist peacefully only, to the principle that assure the right to resist by all means as long as those means are reasonable and appropriate.
