Abstract
การศึกษาค้นคว้าอิสระนี้มีวัตถุประสงค์เพื่อศึกษาแนวคิดและทฤษฎีเกี่ยวกับหลักความเสมอภาค ศึกษาหลักการ แนวคิด เกี่ยวกับการคุ้มครองผู้บริโภค และกฎหมายวิธีพิจารณา คดีผู้บริโภค รวมถึงการคุ้มครองผู้บริโภคตามประมวลกฎหมายวิธีพิจารณาความแพ่ง ศึกษาความหมายของคดีผู้บริโภคตามพระราชบัญญัติวิธีพิจารณาคดีผู้บริโภค พ.ศ. 2551 และตามกฎหมายต่างประเทศ และศึกษาและวิเคราะห์ปัญหาเกี่ยวกับความหมายของคดีผู้บริโภคกับหลักความ เสมอภาค เพื่อนามาสู่ข้อเสนอแนะแนวทางแก้ไขปัญหา การศึกษาค้นคว้าอิสระนี้เป็นการวิจัยทางนิติศาสตร์โดยการวิจัยเชิงคุณภาพ โดยการศึกษาค้นคว้าและวิเคราะห์เอกสารต่าง ๆ ที่เกี่ยวข้อง เช่น ตำรา บทความทางวิชาการ วิทยานิพนธ์ สารนิพนธ์ รวมทั้งบทบัญญัติของกฎหมาย พร้อมทั้งศึกษาเปรียบเทียบกับต่างประเทศ ผลจากการศึกษาพบว่า พระราชบัญญัติวิธีพิจารณาคดีผู้บริโภค พ.ศ. 2551 มาตรา 3 (1) ที่บัญญัติให้สิทธิแก่ผู้ประกอบธุรกิจให้สามารถฟ้องผู้บริโภคได้นั้น พบว่ายังมีปัญหาทางกฎหมายที่ทำให้บทบัญญัติดังกล่าวไม่สอดคล้องกับเจตนารมณ์ของพระราชบัญญัติฉบับนี้ที่มีวัตถุประสงค์เพื่อมุ่งคุ้มครองผู้บริโภค และไม่สอดคล้องกับหลักความเสมอภาค เป็นการปฏิบัติต่อบุคคลที่แตกต่างกันในสาระสำคัญอย่างเดียวกัน ดังนั้น จึงเห็นควรแก้ไขนิยามความหมายของ คำว่า “คดีผู้บริโภค” ตามมาตรา 3 (1) โดยกำหนดให้เฉพาะแต่ผู้บริโภคเท่านั้นที่สามารถฟ้อง ผู้ประกอบธุรกิจเป็นคดีผู้บริโภคได้ และยกเลิกบทบัญญัติมาตรา 17 และเห็นควรกำหนดประเภทคดีผู้บริโภคให้มีความชัดเจนยิ่งขึ้น รวมถึงให้นำมูลค่าของจำนวนเงินมาใช้เป็นเกณฑ์ประกอบการพิจารณาความหมายของผู้บริโภคเพื่อคุ้มครองผู้ประกอบธุรกิจรายย่อย ดังเช่นเดียวกันกับในประเทศออสเตรเลีย
The objectives of this independent study are to: study principles and theories of equality; study concepts and principles of consumer protection, laws on consumer trial procedure, and consumer protection in accordance with the civil code; study meanings and implications of consumer lawsuits stipulated in the Consumer Trial Procedure Act, B.E. 2551 (2008) and related foreign laws; and analyzes problems of the conflicting meanings and implications of consumer lawsuits and equality in order to find solutions. This independent study is a legal, qualitative, documentary study with collection and analysis of information from various sources, namely, related textbooks, articles, thesis, independent studies, and comparison with foreign laws on consumer protection. Findings indicated that Section 3(1) of the Consumer Trial Procedure Act, B.E. 2551 (2008), which gave rights to business operators to prosecute cases against consumers, has legal problems which cause this act in conflict with the intention of the act to protect consumers and give them legal equality. This showed different practices for the same intention. It is, therefore, recommended to redefine a consumer lawsuit in Section 3(1) by giving rights to only consumers to prosecute business operators in consumer lawsuits. In addition, it is recommended to cancel Section 17 and set clear classification of consumer lawsuits. Also, the amount of the incurred damages should be used as a criterion to define consumers in order to protect small business operators like in Australia.
