Abstract
การศึกษาค้นคว้าอิสระ เรื่อง ปัญหาวิธีพิจารณาเกี่ยวกับการคุ้มครองชั่วคราวก่อนการพิพากษาในคดีปกครองเกี่ยวกับคดีสิ่งแวดล้อม มีวัตถุประสงค์ ดังนี้ 1) เพื่อศึกษาถึงแนวความคิด และหลักการเกี่ยวกับการดำเนินคดีปกครองเกี่ยวกับคดีสิ่งแวดล้อม 2) เพื่อวิเคราะห์ความแตกต่างระหว่างการทุเลาการบังคับตามกฎหรือคาสั่งทางปกครองกับการบรรเทาทุกข์ชั่วคราว 3) เพื่อวิเคราะห์วิธีพิจารณาการคุ้มชั่วคราวก่อนการพิพากษาในคดีปกครองเกี่ยวกับคดีสิ่งแวดล้อมของประเทศไทย และต่างประเทศ 4) เพื่อศึกษาสภาพปัญหาเกี่ยวกับวิธีพิจารณาการคุ้มครองชั่วคราวก่อนการพิพากษาในคดีปกครองเกี่ยวกับคดีสิ่งแวดล้อม และ 5) เพื่อหาแนวทางแก้ไขปัญหาวิธีพิจารณาการคุ้มครองชั่วคราวก่อนการพิพากษาในคดีปกครองเกี่ยวกับคดีสิ่งแวดล้อม การศึกษาค้นคว้าอิสระครั้งนี้ เป็นการวิจัยเชิงคุณภาพ โดยการศึกษาวิจัยเอกสาร จากบทบัญญัติของกฎหมายที่เกี่ยวข้อง รวมทั้งข้อมูลต่าง ๆ ที่ได้จากตำรา บทความทางวิชาการ งานวิจัย วิทยานิพนธ์ และข้อมูลที่เกี่ยวข้องที่สามารถค้นคว้าได้จากอินเตอร์เน็ต จากนั้นนำข้อมูลทั้งหมดมาตรวจสอบเพื่อให้เป็นการแน่ใจว่าข้อมูลที่ได้มานั้นเป็นข้อมูลที่ถูกต้องและเชื่อถือได้ จึงนำมาวิเคราะห์อย่างเป็นระบบ เพื่อนำมาใช้เป็นข้อมูลในการศึกษา ผลการศึกษาพบว่า ระเบียบของที่ประชุมใหญ่ตุลาการในศาลปกครองสูงสุด ว่าด้วยวิธีพิจารณาคดีปกครอง พ.ศ. 2543 เกี่ยวกับการยื่นคำขอทุเลาการบังคับตามกฎหรือคำสั่งทางปกครองที่กำหนดให้ต้องระบุโดยชัดแจ้งว่าประสงค์จะขอทุเลาการบังคับตามกฎหรือคำสั่งทางปกครองใด การยื่นคำขอบรรเทาทุกข์ชั่วคราวจะต้องยื่นแยกต่างหากจากคำฟ้อง การมีคำสั่งทุเลาการบังคับตามกฎหรือคำสั่งทางปกครองจะต้องพิจารณาตามหลักเกณฑ์หรือเงื่อนไขที่กฎหมายกำหนดให้ครบทุกเงื่อนไข และการมีคำสั่งคุ้มครองชั่วคราวนั้นจะต้องกระทำ โดยองค์คณะ จากที่กล่าวมานี้ ยังไม่เอื้อต่อการเข้าถึงความยุติธรรม และเป็นการสร้างภาระหรือสร้างขั้นตอนในการเข้าถึงความยุติธรรม ผู้ศึกษาจึงเสนอแนวทางในการแก้ไขไว้ ดังนี้ 1) การยื่นคำขอทุเลาการบังคับตามกฎหรือคำสั่งทางปกครองไม่จำต้องระบุคำขอโดยชัดแจ้งว่าประสงค์จะขอทุเลาการบังคับตามกฎหรือคำสั่งทางปกครองใด ควรเป็นดุลพินิจของศาลในกำหนดคำขอตามเหตุพิพาทนั้น ๆ 2) การยื่นคำขอบรรเทาทุกข์ชั่วคราวสามารถยื่นคำขอมาพร้อมกับคำฟ้องได้ดังเช่นเดียวกันกับการยื่นคำขอทุเลาการบังคับตามกฎหรือคำสั่งทางปกครอง 3) การมีคำสั่งคุ้มครองชั่วคราวนั้นสามารถทำโดยตุลาการนายเดียวได้
This independent study subject is problem procedure on temporary protection before judgment of environmental related administrative case. The purposes of this study are as follows : 1) to study the concept and principles about the environmental administrative case 2) to analyze the differences of abatement law and administrative order for temporary relief 3) to analyze the procedure for temporary before the judgement in the case of Thailand and foreign country 4) to study the procedure problem on temporary protection before judgment of environmental administrative case and 5) to search for the solutions of procedure on temporary protection before judgment of environmental administrative case. This independent study is qualitative research which bases on conducting the documentary through provisions of relevant legislation including information obtained from various texts, academic research and thesis and relate information on the internet. The data is verified for their accuracy and reliability and analyzed in a systematic way. The study found that the rules of the Judicial Conference of the Supreme Administrative Court in the year 2000 with a part of the application for abatement of the administrative rule order or the claimant’s law which requires states expressly that suspend the enforcement of any law or administrative order. The application for interim relief must be filed separately from the indictment. The order of an abatement laws or administrative order must be consider under the rules or conditions prescribed by law for all conditions and the injunction order is made by the tribunal. From the foregoing, the facilitates is not access to justice and this creates a burden of a procedure for access to justice. The study, therefore, proposed to amend as follows: 1) the application force relief according to the rules or administrative orders does not specify explicitly request by any law enforcement or administrative order however, it should be determined according to the discretion of the court request dispute cuisine 2) Application of temporary relief can be submitting with an indictment as an a application relief according to the rules or administrative orders and 3) the injunction order can be made only by judicial officers.
