Abstract
การศึกษาค้นคว้าอิสระเรื่องนี้มีวัตถุประสงค์เพื่อ (1) ศึกษาถึงความหมายของคุณธรรมและจริยธรรมของผู้ดำรงตำแหน่งทางการเมือง (2) ศึกษาถึงบทบาทของคณะกรรมการป้องกันและปราบปรามการทุจริตแห่งชาติ ตามรัฐธรรมนูญแห่งราชอาณาจักรไทย พุทธศักราช 2550 และตามพระราชบัญญัติประกอบรัฐธรรมนูญว่าด้วยการป้องกันและปราบปรามการทุจริต พ.ศ. 2542 (3) ศึกษาหลักการที่เกี่ยวกับกำกับดูแลคุณธรรมและจริยธรรมของผู้ดำรงตำแหน่งทางการเมืองของคณะกรรมการป้องกันและปราบปรามการทุจริตแห่งชาติ ให้มีกลไกบังคับใช้กฎหมายอย่างมีประสิทธิภาพและเหมาะสมกับสภาพสังคมและการเมืองของไทย การศึกษาค้นคว้าอิสระนี้ เป็นการวิจัยทางกฎหมาย โดยการวิจัยเชิงคุณภาพ ด้วยวิธีการการวิจัยเอกสาร จากรัฐธรรมนูญแห่งราชอาณาจักรไทย พุทธศักราช 2550 พระราชบัญญัติประกอบรัฐธรรมนูญว่าด้วยการป้องกันและปราบปรามการทุจริต พ.ศ. 2542 วิทยานิพนธ์ รายงานการวิจัย บทความ เอกสารราชการ และสิ่งพิมพ์ฉบับต่าง ๆ ตลอดจนการศึกษาข้อมูลจากเครือข่ายทางอินเทอร์เน็ต จากการศึกษาพบว่า กระบวนการร้องเรียนคำร้องกรณีการฝ่าฝืนคุณธรรมและจริยธรรมของผู้ดำรงตำแหน่งทางการเมืองต่อผู้ตรวจการแผ่นดินก่อนส่งเรื่องหรือไม่ส่งเรื่องให้คณะกรรมการป้องกันและปราบปรามการทุจริตแห่งชาติ ดำเนินการไต่สวนข้อเท็จจริงต่อไปนั้นเป็นกระบวนการที่สำคัญ แต่ยังไม่มีกฎหมายหรือระเบียบกำหนดขั้นตอนและวิธีการในการตรวจสอบและพิจารณาคำร้องขอดังกล่าวของผู้ตรวจการแผ่นดิน ทำให้การดำเนินการตามกลไกลการตรวจสอบหรือการบังคับใช้กฎหมายของคณะกรรมการป้องกันและปราบปรามการทุจริตแห่งชาติ กรณีการฝ่าฝืนคุณธรรมและจริยธรรมของผู้ดำรงตำแหน่งทางการเมือง ไม่มีผลในทางปฏิบัติ ซึ่งสามารถแก้ไขได้โดยการแก้ไขเพิ่มเติมรัฐธรรมนูญแห่งราชอาณาจักรไทย พุทธศักราช 2550 และพระราชบัญญัติประกอบรัฐธรรมนูญว่าด้วยการป้องกันและปราบปรามการทุจริต พ.ศ. 2542 กำหนดให้ผู้ตรวจการแผ่นดินมีอำนาจออกระเบียบหรือข้อบังคับกำหนดขั้นตอนและวิธีการตรวจสอบและพิจารณาความถูกต้องครบถ้วนของคำร้องการฝ่าฝืนคุณธรรมและจริยธรรมของผู้ดำรงตำแหน่งทางการเมืองให้ชัดเจน ทั้งนี้ เพื่อให้การตรวจสอบคำร้องและการบังคับใช้กฎหมายให้มีความรวดเร็วและมีประสิทธิภาพมากยิ่งขึ้น
This independence study has objectives to: (1) study the definition of moral and ethics of a person holding political position; (2) study the role National Anti-Corruption Commission according to the Constitution of the Kingdom of Thailand, B.E. 2550 and the Organic Act on Counter Corruption, B.E. 2542; (3) study principle related to authority of the National Anti-Corruption Commission in monitoring a person holding political position’s moral and ethics in order to enhance law enforcement efficiently and consistently to Thai society and political situation. This independence study is a legal qualitative research conducted through documentary research by analyzing the provisions of the Constitution of The Kingdom of Thailand, B.E. 2550 and the Organic Act on Counter Corruption, B.E. 2542, thesis, articles, official documents, other publishing and information searched from internet network. The research founded that in the complaint procedure in case moral and ethics violated by a person holding political position submitted to the Office of the Ombudsman of Thailand before passing a decision forward or not to forward the case to the office of the National Anti-Corruption Commission (NACC), is very important stage. However, there is no law or regulations to set up a clear procedure and method of inspection and consideration of the said complaint by the Office of the Ombudsman. This causes ineffectiveness in practice to the NACC performance if there is violation of moral and ethics of a person holding political position. In this regard, the Constitution of The Kingdom of Thailand, B.E. 2550 and the Organic Act on Counter Corruption, B.E. 2542 need to be amended by authorize the Office of the Ombudsman to institute regulations on procedure, inspection method and consideration whether the allegation against a person holding political position that violates moral and ethics contains a particular information required by law. This will make complaint inspection at the stage of the NACC and its law enforcement fast and efficiently.
