ปัญหาการจัดตั้งและควบคุมการดำเนินงานสถานตรวจสภาพรถเอกชน

Abstract

การวิจัยครั้งนี้มีวัตถุประสงค์เพื่อ (1) วิเคราะห์แนวความคิดเกี่ยวกับสิทธิและเสรีภาพในการประกอบอาชีพ ตามหลักความชอบด้วยรัฐธรรมนูญของกฎหมาย (2) วิเคราะห์เปรียบเทียบกฎหมายที่เกี่ยวข้องกับการจัดตั้ง และควบคุมการดำเนินงานสถานตรวจสภาพรถเอกชนของประเทศไทย กับต่างประเทศ (3) ศึกษาวิเคราะห์สภาพทางกฎหมายของการจัดตั้งการดำเนินการ และผลของคำสั่งต่างๆ ของสถานตรวจสภาพรถเอกชน (4) วิเคราะห์และเปรียบเทียบการประกอบกิจการสถานตรวจสภาพรถเอกชน กับหลักเรื่องเสรีภาพในการประกอบอาชีพ (5) เสนอแนะแนวทางในการกำหนดมาตรการจัดตั้งสถานตรวจสภาพรถเอกชน ให้มีประสิทธิภาพและประสิทธิผลและมีความสอดคล้องกับสังคมไทย การวิจัยครั้งนี้เป็นการวิจัยเชิงคุณภาพด้วยการวิจัยทางเอกสาร โดยการศึกษาแนวความคิด และทฤษฎีที่เกี่ยวข้องกับสิทธิและเสรีภาพและรูปแบบของการดำเนินการจัดตั้งสถานตรวจสภาพรถเอกชนของต่างประเทศ คือ สหรัฐอเมริกา อังกฤษ มาเลเซีย หรือสิงคโปร์ กับประเทศไทยเพื่อสร้างข้อความคิดทางกฎหมายอันเป็นแนวทางสำหรับการปรับปรุงกฎหมาย และ กฎที่เกี่ยวข้องกับการจัดตั้งการกำหนดมาตรฐานและการควบคุมกำกับดูแล สถานตรวจสภาพรถเอกชน ให้มีประสิทธิภาพ และประสิทธิผลและมีความสอดคล้องกับสังคมไทยต่อไป ผลการวิจัยพบว่ามีเพียงประเทศไทยประเทศเดียวที่กฎหมายในระดับพระราชบัญญัติ ใช้ถ้อยคำที่กว้าง ขาดความแน่นอนชัดเจนในการกำหนดสิทธิของประชาชนที่จะเป็นผู้ได้รับอนุญาต ให้ดำเนินการจัดตั้ง เพื่อจัดระเบียบการใช้สิทธิและเสรีภาพของประชาชนในการประกอบกิจการ สถานตรวจสภาพรถเอกชน รวมถึงการควบคุมการดำเนินงาน เพื่อควบคุมคุณภาพ

The objectives of this study were to (1) analyze the concept of rights and freedom of occupation under the constitutional law; (2) comparative analysis of laws relating to the establishment and control of the vehicle inspection stations of the country with those of other countries; (3) analyze the legal status of the establishment of, operation and effect of the various command orders regarding the vehicle inspection stations; (4) analyze and make a comparative study on the operation of the vehicle inspection stations according to the principles of freedom of occupation; and (5) suggest measures to establish the vehicle inspection stations so as to be effective, efficient and in accordance with the Thai society.The research in this thesis was a qualitative research methods by studying concepts and theories related to the rights and freedoms as well as forms of the establishment of the vehicle inspection stations under the law of U.S., UK, Malaysia or Singapore, and Thailand to establish a legal concepts as the guidelines for improving the laws and rules related to the establishment standards and supervisory control of the vehicle inspection stations so as to be effective, efficient and in accordance with the Thai society.Research Findings were that Thailand is the only country that the provisions of the related legislation are lack of precise scope and details of the rights of citizens to be allowed to establish, to regulate the operation, and the quality control of the vehicle inspection stations
