Abstract
การศึกษาค้นคว้าอิสระเรื่อง ปัญหากฎหมายการปล่อยตัวชั่วคราวในคดีอาญา มีวัตถุประสงค์เพื่อ 1) เพื่อศึกษาความเป็นมา หลักการ แนวคิดและทฤษฎีที่เกี่ยวข้องกับการปล่อยตัวชั่วคราวในคดีอาญา 2) เพื่อศึกษาถึงหลักเกณฑ์เกี่ยวกับการปล่อยตัวชั่วคราวในคดีอาญาตามประมวลกฎหมายวิธีพิจารณาความอาญา 3) เพื่อหาแนวทางในการแก้ไขปัญหากฎหมายที่เกี่ยวข้องกับการปล่อยชั่วคราวในคดีอาญา การศึกษาค้นคว้าอิสระนี้ เป็นการวิจัยเชิงคุณภาพ ด้วยวิธีการวิจัยทางเอกสาร โดยศึกษาจาก ตำรา เอกสาร วิทยานิพนธ์ บทความ รวมทั้งข้อมูลจากในอินเทอร์เน็ต โดยนำมาจัดทำรวบรวมข้อมูล ค้นคว้าและวิเคราะห์ข้อมูลเพื่อชี้ให้เห็นถึงประเด็นปัญหาตามหลักเกณฑ์ทางกฎหมายที่เกี่ยวข้อง ผลการศึกษาพบว่า รัฐธรรมนูญแห่งราชอาณาจักรไทย ได้บัญญัติเพื่อคุ้มครองสิทธิของผู้ต้องหา หรือจำเลยในคดีอาญา ตามมาตรา 39 วรรคสอง ที่กำหนดว่า "...ต้องสันนิษฐานไว้ก่อนว่าผู้ต้องหาหรือจำเลยยังไม่มีความผิดและก่อนมีคำพิพากษาถึงที่สุดแสดงว่าบุคคลใดได้กระทำความผิด จะปฏิบัติต่อบุคคลนั้นเสมือนเป็น ผู้กระทำความผิดมิได้" เพื่อให้สอดคล้องกับมาตรฐานสากลด้านสิทธิมนูษยชน และเป็นหลักประกันสิทธิของผู้ด้องหาหรือจำเลยในคดีอาญา ในการที่จะได้รับอิสรภาพหากมีสถานะเพียงแค่ผู้ถูกกล่าวหา ผู้ต้องหา หรือจำเลย ที่ศาลยังไม่ได้พิพากษาว่าบุคคลเหล่านี้ได้กระทำผิดจริง ซึ้งกฎหมายเกี่ยวกับเรื่องปล่อยตัวชั่วคราวของประเทศไทยได้ให้ความคุ้มครองสิทธิเสรีภาพของผู้ต้องหาและจำเลยมากขึ้น แต่ก็ยังมีความไม่ชัดเจนอยู่หลายประการ ได้แก่ ปัญหาเกี่ยวกับการประกันและหลักประกันในการปล่อยตัวชั่วคราว ศาลจะใช้ดุลพินิจในการปล่อยตัว ชั่วคราวเป็นไปตามวงเงินที่กฎหมายกำหนด หากมีการให้ประกันตัวโดยถือตัวเงินเป็นเกณฑ์ในการประกันตัว หรือกำหนดวงเงินประกันตายตัวอย่างเคร่งครัดเกินไป โดยไม่คำนึงถึงโอกาสในการหาหลักประกันของผู้ด้องหา หรือจำเลยที่เป็นคนยากจน ปัญหาเกี่ยวกับการสั่งไม่ให้ปล่อยตัวชั่วคราว ตามมาตรา 108/1 วรรคสอง ที่ให้ศาล สามารถใช้ดุลพินิจอย่างไม่มีขอบเขตในการให้เหตุผลประกอบการสั่งไม่อนุญาตให้ปล่อยตัวชั่วคราว อาจทำให้ ผู้ต้องหาหรือจำเลยได้รับความเสียหาย ปัญหาเกี่ยวกับการขังจำเลยระหว่างคดียังไม่ถึงที่สุด ตามมาตรา 185 วรรค หนี่ง ถือเป็นการบัญญัติกฎหมายให้อำนาจศาลสั่งขังจำเลยไว้ในระหว่างคดียังไม่ถึงที่สุดโดยไม่เป็นธรรม ถือเป็น การริดรอนสิทธิและเสรีภาพของบุคคล และปัญหาเกี่ยวกับการขังผู้ต้องหาหรือจำเลยไว้ในสถานที่อื่นนอกจากเรือนจำ ซึ่งตามมาตรา 89/1 เป็นบทบัญญํติที่ให้สิท่ธิในการร้องขอเพียงเฉพาะบุคคล แต่ไม่ได้ให้สิทธิแก่ผู้ต้องหา หรือจำเลยที่กฎหมายสันนิษฐานว่ายังไม่มีความผิดจนกว่าศาลจะมีคำพิพากษา ในการร้องขอให้ขังตนไว้ในสถานที่อื่นที่มิใช่เรือนจำ ดังนั้น สมควรแก้ไขกฎหมายที่เกี่ยวข้องกับการปล่อยตัวชั่วคราวในคดีอาญา เพื่อเป็นหลักประกันสิทธิและเสรีภาพของบุคคลไปพร้อมกับการอำนวยความยุติธรรมให้แก่ผู้เสียหายในคดีอาญา
The purposes of this independent research is to study: (1) the theoretical concepts and principles concerning the legal problems which related to release in criminal cases; (2) the law which related to release in criminal cases; (3) analyze the problem related to release in criminal cases and propose recommendation to amend the law which related to release in criminal cases. This research is a qualitative research based on documentary study on a data compilation and analysis of related provision of law, legislation, research reports, journal articles, various electronic data, internet and legal concept on Thai law and Foreign Law. The research found that article 39, paragraph 2 of the Thai constitution protects the rights of suspects and defendants in criminal cases, which stated that “the presumption is that until the final judgment of the court is made, suspects and defendants are innocent and they shall not be treated as if they are guilty.” This provision is in accordance with the international human rights standards and acts as a guarantee of the rights of suspects and defendants in criminal cases. In cases where the court has yet to pass a judgment, Thai law governing provisional release increasingly protects the rights of defendants , however, there are some points still ambiguous To illustrate, the court may use its judgment in deciding at what level to set bail and it is possible which may result in the court may fail adequately to take into account the financial status of the accused, setting bail too high and poor defendants cannot afford bail . Moreover, other provisions are too strict. Provisional release may be denied under article 108/1, paragraph 2, which gives courts unlimited powers in justifying the refusal of bail. This may affect to the accused or defendant’s rights. Other Problems is detention when awaiting final judgments, according to article 185, paragraph one provides courts with the legal ability to order continued detention in this situation. This is unfair and deprive of the rights and freedoms of the individual. Furthermore, article 89/1 allows for individuals to request detention in a place other than in a recognized prison but this right is denied to defendants since they are assumed, prior to a guilty verdict, to be innocent. Thus, these problems with the granting of bail should be amended to protect individuals’ rights and freedoms for those who have experienced personal loss or damage in criminal cases.
