Abstract
การศึกษาค้นคว้าอิสระนี้มีวัตถุประสงค์เพื่อศึกษาความเป็นมาแนวคิดในการควบคุมตรวจสอบเจ้าหน้าที่ของรัฐตามกฎหมายของประเทศไทยเปรียบเทียบกับกลไกการควบคุมตรวจสอบเจ้าหน้าที่ของรัฐตามกฎหมายว่าด้วยการพัสดุภาครัฐของประเทศสหรัฐอเมริกาและต้นแบบกฎหมายการจัดซื้อจัดจ้างของภาครัฐตามมติคณะกรรมาธิการสหประชาชาติว่าด้วยการค้าระหว่างประเทศเพื่อให้ทราบปัญหาที่ทำให้การใช้บังคับพระราชบัญญัติการจัดซื้อจัดจ้างและการบริหารพัสดุภาครัฐ พ.ศ. 2560 ไม่มีประสิทธิภาพรัฐจัดหาพัสดุได้ราคาแพงไม่ตรงกับความต้องการและได้แนวทางการแก้ไขเพิ่มเติมกฎหมายให้ใช้บังคับอย่างมีประสิทธิภาพเพิ่มมากขึ้น การศึกษาค้นคว้าอิสระนี้เป็นการวิจัยเชิงคุณภาพ ด้วยวิธีวิจัยเอกสาร จากตัวบทกฎหมาย หนังสือตารา บทความ ผลงานทางวิชาการ เอกสารสิ่งพิมพ์ และข้อมูลข่าวสารอิเล็กทรอนิกส์ในทางกฎหมายจากเว็บไซต์ต่างๆ ของประเทศไทย และประเทศสหรัฐอเมริกา ผลการศึกษาพบว่าพระราชบัญญัติการจัดซื้อจัดจ้างและการบริหารพัสดุภาครัฐ พ.ศ. 2560 ไม่เปิดโอกาสให้เอกชนสามารถอุทธรณ์ร้องเรียนการบริหารสัญญาและการตรวจรับพัสดุของเจ้าหน้าที่ของรัฐไม่ฐได้อีกทั้งยังทั้งยังไม่ให้คณะกรรมการพิจารณาอุทธรณ์และข้อร้องเรียนซึ่งมีอำนาจไต่สวนเจ้าหน้าที่ของรัฐที่ถูกอุทธรณ์ร้องเรียนว่าทุจริตหรือปฏิบัติหน้าที่โดยมิชอบด้วยกฎหมายมีหน้าที่ร้องทุกข์กล่าวโทษฟ้องคดีหรือส่งสำนวนการไต่สวนข้อเท็จจริงพร้อมทั้งความเห็นเกี่ยวกับการกระทำความผิดและเอกสารหลักฐานที่รวบรวมมาได้ให้แก่พนักงานสอบสวนพนักงานอัยการหรือศาลเพื่อเริ่มต้นกระบวนการยุติธรรมทางอาญาในกรณีที่ไต่สวนแล้วเห็นวเห็นว่าเจ้าหน้าที่ของรัฐทุจริตหรือปฏิบัติหน้าที่โดยมิชอบด้วยกฎหมายซึ่งเป็นช่องทางให้เจ้าหน้าที่ของรัฐใช้อำนาจหน้าที่เกี่ยวกับการจัดซื้อจัดจ้างและการบริหารพัสดุแสวงหาประโยชน์ให้แก่ตนเองและพวกพ้องเช่นกำหนดรายละเอียดคุณลักษณะเฉพาะของพัสดุเป็นการเอื้อประโยชน์แก่เอกชนรายใดรายหนึ่งให้เข้ามาเป็นคู่สัญญารัฐหรือทำการบริหารสัญญาและตรวจรับพัสดุไม่เป็นไปตามที่กฎหมายกำหนดเป็นต้นและยังพบว่าเจ้าหน้าที่ของรัฐที่มีหน้าที่เกี่ยวข้องกับการจัดซื้อจัดจ้างและการบริหารพัสดุมักขาดความรู้ความเข้าใจเรื่องในทางเทคนิคของพัสดุที่จะจัดหาและขาดความรู้ความเข้าใจเกี่ยวกับกฎระเบียบที่เกี่ยวข้องทำให้วิตกกังวลในการปฏิบัติหน้าที่และไม่ปฏิบัติหน้าที่อย่างเต็มความสามารถ
The objective of this independent study are to study background, and concept in controlling and checking the government officials under the law of Thailand, in order to compar to the mechanism for controlling and checking thegovernment officials according to the Government Supplies Law of the United States of America and prototype of law on the Government Procurement under the resolution of the United Nations Committee on the International Trade to find out that the enforcement of the Government Procurement and Supplies Management Act B.E.2560is ineffective by allowing the governmental agencies to procure the supplies at higher prices and unconformable to the requirement and to find the way to amend the law for more effective enforcement. This independent study used the qualitative method by way of document research from the law text, textbooks, articles, academic performance, printing matters and e-information of law from websites. The study found that the Government Procurement and Supplies Management Act B.E. 2560 did not give the private party the opportunity to submit the appeal and complaint on the contract management and supplies acceptance test of the government officer and also it did not allow the appeal and complaint considering committee who has the authority to investigate the officers committing the evil corruption or performing the unlawful act to file the complaint, implead the case or deliver the indictment of the preliminary hearing together with opinion on the offence commitment and documentary evidences to the inquiry officer, public prosecutor or the court for the beginning of the criminal justice process in case the preliminary hearing was made to see that the government officer is committing the corruption or performing the unlawful act, giving the government officer the opportunity to use the competence in relation to the procurement and supplies management to seek the interest for himself/herself and friends, for example, to define the details of specifications of the supplies that can conduce to any private to enter into the contract with the government or manage the contract and perform the acceptance test that does not conform to the law as stipulated, etc., and also it is found that the government officers concerning the government procurement and supplies management often lack of technical understanding and knowledge on the supplies to be procured and lack of knowledge and understanding on the concerned regulations, causing them to be anxious about performing their duties and cannot work to the best of their ability.
