บทบาทและอำนาจหน้าที่ของเจ้าหน้าที่คดีพิเศษตามกฎหมายว่าด้วยการสอบสวนคดีพิเศษ

Abstract

การศึกษาค้นคว้าอิสระนี้มีวัตถุประสงค์เพื่อ 1) ศึกษาแนวคิด ทฤษฎีและบทบาทอำนาจหน้าที่ของพนักงานสอบสวนคดีพิเศษของหน่วยงานสืบสวนสอบสวนคดีพิเศษของต่างประเทศเปรียบเทียบกับประเทศไทย (2) ศึกษา วิเคราะห์บทบาทและอำนาจหน้าทีของพนักงานสอบสวนคดีพิเศษ และเจ้าหน้าที่คดีพิเศษตามพระราชบัญญัติการสอบสวนคดีพิเศษ พ.ศ. 2547 และ (3) วิเคราะห์และเสนอแนะแนวทางแก้ไขกฎหมายในส่วนที่เกี่ยวข้องกับบทบาทและอำนาจหน้าที่ของเจ้าหน้าที่ คดีพิเศษให้เหมาะสมและมีประสิทธิภาพ การศึกษาค้นคว้าอิสระนี้เป็นการวิจัยเชิงคุณภาพ โดยศึกษาจากบทบัญญัติของกฎหมายที่เกี่ยวข้อง ข้อมูลจากตำรา บทความวิชาการ วิทยานิพนธ์ สารนิพนธ์ ระเบียบ คำสั่ง คำพิพากษา ศาลฎีการวมทั้งข้อมูลอื่น ๆ ที่เป็นประโยชน์ และนำมาวิเคราะห์อย่างเป็นระบบเพื่อนำมาใช้เป็นข้อมูลในการศึกษา ผลการศึกษาพบว่า (1) หน่วยงานสืบสวนสอบสวนคดีพิเศษของต่างประเทศ เช่น ประเทศสหรัฐอเมริกาและประเทศญี่ปุ่น มีพนักงานอัยการเข้ามามีบทบาทสำคัญในการสอบสวนหรือนำคดีขึ้นสู่ศาล และหน่วยงานสืบสวนสอบสวนคดีพิเศษจะมีความเป็นอิสระปราศจากการแทรกแซงหรือถูกบีบคั้นจากนักการเมือง (2) พระราชบัญญัติการสอบสวนคดีพิเศษ พ.ศ. 2547 และที่แก้ไขเพิ่มเติมมิได้กำหนดบทบาทและอำนาจหน้าที่ของเจ้าหน้าที่คดีพิเศษไว้อย่างชัดแจ้ง ทำให้อำนาจหน้าที่ของเจ้าหน้าที่คดีพิเศษไม่มีขอบเขตแน่นอน (3) ผู้ศึกษาจึงเสนอแนะให้แก้ไขกฎหมายให้กำหนดบทบาทและอำนาจหน้าที่ของเจ้าหน้าที่คดีพิเศษให้เกิดความชัดเจนเพื่อให้การปฏิบัติงานเป็นไปอย่างเหมาะสมมีประสิทธิภาพ

The objective of this independent study is (1) to study the concepts, theories, role and authority of the special case inquiry official of the foreign special case investigation agency in comparison with Thailand, (2) to study and analyze the role and authority of the special case inquiry official and special case officer pursuant to the Special Case Investigation Act B.E. 2547 (2004), and (3) to analyze and propose the corrective guideline of the law in the relevant part of the role and authority of the special case officer to be proper and efficient. This independent study is a qualitative research through the study and systematic analysis on the legislation of the related laws, data from textbooks, academic journals, dissertations, thesis, regulations, orders, judgments of the Supreme Court, as well as other useful data, to be used as the studying data. The finding of the studying results indicated as follows: (1) the entry of the public prosecutor of the foreign special case investigation agency in United States of America and Japan, to play the key role in investigation or bringing the cases to the court, and the independence of the said agency and free from the intervention or oppression from the politicians; (2) a non-determination of the explicit role and authority of the special case officer in the special Case Investigation Act B.E. 2547 (2004) and the Amendment causing an indefinite scope of the authority of the special case officer; and (3) therefore, the researcher has suggested to amend the law prescribing the role and authority of the special case officer to be explicit for the proper and efficient operation.
