การคุ้มครองแรงงานหญิง ตามร่างประมวลกฎหมายแรงงาน

Abstract

การศึกษาค้นคว้าอิสระนี้มีวัตถุประสงค์เพื่อศึกษาร่างประมวลกฎหมายแรงงาน พ.ศ. 2558 ของคณะกรรมการปฏิรูปกฎหมายด้านแรงงาน ในการให้ความคุ้มครองแก่แรงงานหญิงผู้ทำงาน หญิงมีครรภ์ ในหลักของความเสมอภาค การคุกคามทางเพศ และงานอันตราย มาทำการเปรียบเทียบกับหลักในการให้ความคุ้มครองขององค์การแรงงานระหว่างประเทศ และพระราชบัญญัติคุ้มครอง แรงงาน พ.ศ. 2541 การศึกษาค้นคว้าอิสระนี้ เป็นการวิจัยเชิงคุณภาพ ด้วยวิธีการวิจัยเอกสารโดยศึกษา ค้นคว้า จากตำรา กฎหมาย บทความวารสาร วิทยานิพนธ์ ข้อมูลทางอินเทอร์เน็ต และเอกสารอื่นๆ ที่เกี่ยวข้อง ผลการศึกษาพบว่า ร่างประมวลกฎหมายแรงงานได้ให้ความคุ้มครอง ผู้ทำงานหญิง และผู้ทำงานหญิงมีครรภ์ อย่างเสมอภาคโดยไม่เลือกปฏิบัติ และอย่างเป็นการเฉพาะเจาะจง และยังทำการเรียบเรียงบทบัญญัติที่เป็นสาระสำคัญของกฎหมายว่าด้วยการคุ้มครองแรงงานจำนวนหลายฉบับโดยนำมาจัดเป็นหมวดหมู่ และคงไว้ซึ่งหลักการความเสมอภาคโดยไม่เลือกปฏิบัติ และคุ้มครองอย่างเฉพาะเจาะจงในงานอันตราย มาบัญญัติเพื่อให้สะดวกแก่การปรับใช้ และเพิ่มสวัสดิการให้แก่แรงงานหญิงที่ตั้งครรภ์และคลอดบุตร ให้ได้รับความคุ้มครองที่มากขึ้น ตามหลักการขององค์การแรงงานระหว่างประเทศ ข้อเสนอแนะ คือ ให้สามีที่ภรรยาคลอดบุตรมีสิทธิลาเพื่อเลี้ยงดูบุตรและได้รับค่าจ้างบางจำนวน กรณีเลิกจ้างผู้ทำงานหญิงมีครรภ์ต้องให้ลางานเพื่อการหางานทำใหม่ไม่น้อยกว่าสิบห้าวัน และเมื่อครบกำหนดเวลาตามบทเฉพาะกาล ห้ามมิให้ยกเลิกบทบัญญัติเดิมที่เป็นคุณต่อผู้ทำงานหญิงและผู้ทำงานหญิงมีครรภ์

This independent study aims to examine the drafted Labor Code 2015 (2558 B.E.)of the Labor Law Reform Commission in particular protection for female workers,pregnant workers with regard to its compliance with the principle of equality, sexualharassment and dangerous works as laid down in International Labor Organizationand the Labor Protection Act B.E. 2541.This independent study is a qualitative research drawing from relevantdocuments, legal texts, journal articles, thesis and internet data. The study finds that the drafted Code of Labor is in line with the provisions of the law on labor protection in the area of pregnant workers. These provisions which are at present can be found in different legal source are organized into categories for conveniency, while equality principles, sexual harassment and welfare for female workers are maintained. Welfare for pregnant female workers are also crease to be in line with the International Labor Organization standards. The suggestion is that the husband whose wife delivers a baby has the right to take care of the child and receive some wages. In case of termination of employment, the pregnant woman be entitled to a leave of absence to find a new job for at least 15 days. Upon the expiration of the period under the transitional provisions do not cancel the original provisions that are yours for female workers and pregnant women workers.
