Abstract
วัตถุประสงค์ในการวิจัย เรื่องการจัดการที่ดินของรัฐในโครงการจัดที่ดินผืนใหญ่ฯ นี้ เพื่อศึกษาค้นหาแนวคิดและทฤษฎีที่เกี่ยวข้องกับอำนาจหน้าที่ในการจัดการที่ดินของรัฐ รวมทั้งวิธีการแก้ไขปัญหาที่นำมาใช้ และการนำไปสู่ความสำเร็จของโครงการจัดที่ดินฯ ว่ามีความเหมาะสมหรือไม่ อย่างไร เพื่อให้ได้วิธีการที่เหมาะสมและสามารถนำไปใช้กับกรณีของที่ดินในโครงการจัดที่ดินผืนใหญ่ฯ แปลงอื่น ๆ ที่มีสภาพปัญหาเหมือนกันต่อไปในอนาคต การศึกษาค้นคว้าอิสระนี้ ใช้วิธีการศึกษาวิจัยเอกสาร (Documentary Research) และรวบรวมเอกสารกฎหมายต่าง ๆ ที่เป็นส่วนสำคัญหรือเป็นส่วนหลัก โดยศึกษาค้นคว้าเกี่ยวกับความเป็นมาของการจัดที่ดินผืนใหญ่ตามประมวลกฎหมายที่ดิน แนวคำพิพาษารวมทั้งผลการศึกษาวิจัยและบทความต่าง ๆ นำมาเปรียบเทียบวิเคราะห์หาผลสรุป และนำเสนอแนวทางในการแก้ไขปัญหาการจัดที่ดินผืนใหญ่ ผลการวิจัยพบว่า โครงการจัดที่ดินผืนใหญ่ตามประมวลกฎหมายที่ดิน ซึ่งผู้ที่ได้รับการจัดที่ดินยังไม่ได้รับหนังสือแสดงสิทธิในที่ดิน ย่อมถือว่าการจัดที่ดินยังไม่บรรลุผลสำเร็จ กรมที่ดินจึงยังคงมีอานาจหน้าที่ที่จะต้องดำเนินการให้สำเร็จ ตามหลักการบริหารกิจการบ้านเมืองที่ดี เมื่อมีปัญหาโครงการจัดที่ดินผืนใหญ่ฯ ที่ได้จัดไว้เดิม ได้ถูกทอดทิ้งกลับมาเป็นที่รกร้างว่างเปล่าและมีการบุกรุกเข้าถือครองที่ดินโดยบุคคลภายนอก แต่ปัจจุบันกรมที่ดินไม่มีการจัดที่ดินผืนใหญ่อีกต่อไป แนวทางที่ใช้ในการแก้ไขปัญหาคือ การออกหนังสือแสดงสิทธิในที่ดินให้แก่ผู้ที่ได้ครอบครองทำประโยชน์ในที่ดินจริง โดยถือว่าเป็นการจัดที่ดินประเภทหนึ่ง รวมทั้งควรแก้ไขกฎหมายยกเว้นการห้ามโอนที่ดิน เพื่อให้ผู้ที่ได้รับการจัดที่ดินโดยถูกต้องตามกฎหมายเกินสิบปีได้มาขอออกหนังสือแสดงสิทธิในที่ดิน และมีมาตรการในการป้องกันการถือครองที่ดินมากเกินความจำเป็นโดยกำหนดเงื่อนไขที่เห็นสมควรก่อนที่จะออกหนังสือแสดงสิทธิในที่ดินให้แก่ผู้ถือครองที่ดินที่มีเนื้อที่มากเกิน 100 ไร่
The objectives of land management and allocation project study were to study whether concepts and theories related to concerning land management authority of the state, solution to problems that was applied and, the success plan for land project was appropriated or not and how to go for success. This study tried to acquire proper land management method implementable to other land allocation projects with similar problems in the future. In this independent study, a documentary research was applied in order to collected major and important law documentations. Historical of land management and allocation project under the Land Code, judgments, research results as well as relevant article were studied and compared to find conclusion and suggestion to solve the problem of land management and allocation. The results of the study have shown that land management and allocation project under the Land Code; the person who had own land but they have not received the title deed yet so constitutes of land is not achieved. Department of Lands is still authorized to be carried out. Principles of good governance, when previously land problems for the project occurred and it has been abandoned to the wilderness so a land invasion by outsiders. However, at present, the Land Department no longer has big land plot allocation management and policies. The solved the problems by issuing land certificates to people who possessed and made use of those land plots considering this a kind of land allocation method. Moreover the law should be amended by prohibiting the transfer of land so that individuals who legally hold land for over ten years are able to request for land title certification and the measures preventing people from possessing more land than necessary should be issued by taking into account appropriate terms before issuance of rights in land certificates to those possessing over 100 acres of land.
