Abstract
การศึกษาค้นคว้าอิสระนี้มีวัตถุประสงค์เพื่อศึกษาแนวคิด ทฤษฎี และหลักกฎหมายเกี่ยวกับการจัดบริการสาธารณะ ศึกษาหลักการจัดทำบริการสาธารณะ กฎหมายจัดตั้งองค์กรปกครองส่วนท้องถิ่นและกฎหมายอื่นที่เกี่ยวข้องในการจัดทำบริการสาธารณะ ศึกษาวิเคราะห์ปัญหาข้อกฎหมายเกี่ยวกับความซ้ำซ้อนในอำนาจหน้าที่ในการจัดทำบริการสาธารณะ หาแนวทางทางแก้ไขปัญหาความซ้ำซ้อนในการจัดทำบริการสาธารณะให้มีความชัดเจนยิ่งขึ้น การศึกษาค้นคว้าอิสระฉบับนี้ใช้วิธีวิจัยเชิงคุณภาพ ด้วยวิธีการวิจัยเอกสาร โดยศึกษาค้นคว้า รวบรวมข้อมูลจากแหล่งต่าง ๆ ได้แก่ กฎหมาย หนังสือ ข้อหารือ ความเห็นทางกฎหมาย วิทยานิพนธ์ สารนิพนธ์ บทความต่าง ๆ ที่เกี่ยวกับการจัดทําบริการสาธารณะ ผลการศีกษาพบว่า ตามหลักการจัดทําบริการสาธารณะของราชการส่วนกลาง ราชการส่วนภูมิภาคและราชการส่วนท้องถิ่นนั้นมีการแบ่งอำานาจและกระจายอำนาจในการดำเนินการจัดทําบริการสาธารณะ แต่อย่างไรก็ดี ในการจัดทําบริการสาธารณะระหว่างราชการส่วนกลาง ราชการส่วนภูมิภาค และราชการส่วนท้องถิ่นนั้นก็ยังพบว่ามีความซ้ำซ้อนกันในหลายภารกิจจนเกิดปัญหาการเกี่ยวกันหรือแย่งกันในการจัดทำการจัดทำบริการสาธารณะ จึงเสนอแนะแนวทางแก้ไข คือ ความซ้ำซ้อนระหว่างราชการส่วนกลางกับราชการส่วนท้องถิ่นแก้ไขปัญหาโดยกำหนดให้ราชการส่วนกลางมีหน้าที่ในการกำหนดนโยบาย กําหนดมาตรฐานในการจัดทำ บริการสาธารณะ การฝึกอบรม งานวิชาการ และให้ราชการส่วนท้องถิ่นมีหน้าที่เป็นฝ่ายปฏิบัติการในการจัดทําบริการสาธารณะ หากปัญหาเกิดให้ผู้รักษาการตามกฎหมายของราชการส่วนกลางเป็นผู้วินิจฉัย และความซ้ำซ้อนระหว่างราชการส่วนภูมิภาคกับราชการส่วนท้องถิ่นนั้นแก้ไขปัญหาโดยกำหนดให้ราชการส่วนภูมิภาคมีหน้าที่กํากับดูแลราชการส่วนท้องถิ่นและราชการส่วนภูมิภาคเป็นผู้จัดทําบริการสาธารณะที่เกินศักยภาพของราชการส่วนท้องถิ่น และให้ราชการส่วนท้องถิ่นมีหน้าที่จัดทําบริการสาธารณะตามศักยภาพ หากมีข้อพิพาทให้ผู้กำกับดูแลราชการส่วนท้องถิ่นเป็นผู้วินิจฉัย และให้มีผลผูกพัน โดยไม่ต้องนำคดีขึ้นสู่ศาล
This independent study aims (1) to study concepts, theories and principles of law relating to public services, (2) to study principle of public services, local government organization establishment law and other relevant public service laws, (3) to study and analyze the problems of matters of law relating to redundancy of authority in providing public services, and (4) to find solution for redundancy problem of public services for more clarity. This independent study applied qualitative research method through documentary research procedure by studying, researching and collecting data from sources such as laws, books, consulted issues, legal opinions, thesis, dissertations, and articles relating to public services. The finding of the studying results indicated that public services between the central government, provincial government, and local government are provided in accordance with deconcentration and decentralization. However, those public services have been redundant in various missions and causing certain problems. Therefore, in case of redundancy between the central goverment service and local government service shall be solved by determining the duty of the central government to establish policies and public service standards and training; and determining the duty of local government to operate public services. If any problems occur, the person in charge of control of such relevant acts shall make decisions. In case of redundancy between the provincial govemment and local olved by determining the duty of provincial government to supervise government shall be the local govemment, and to provide public services exceeding the potential of the local government. The duty of local government is to provide public services in accordance with its potential. If there is any dispute, the person in charge of supervision of such local government shall make decision and it shall be binding without requiring legal proceeding to courts.
