การนำโทษปรับทางปกครองมาใช้แทนโทษอาญาในกฎหมายที่ท้องถิ่นบังคับใช้

Abstract

การศึกษาค้นคว้าอิสระเรื่องนี้มีวัตถุประสงค์ (1) เพื่อศึกษาแนวคิดทฤษฎีเกี่ยวกับการปกครองส่วนท้องถิ่น สภาพบังคับของกฎหมายท้องถิ่น โทษปรับทางปกครองตามกฎหมายไทยและกฎหมายต่างประเทศ (2) เพื่อศึกษาวิเคราะห์ปัญหาการนำโทษปรับทางปกครองมาใช้แทนโทษทางอาญาในกฎหมายที่องค์กรปกครองท้องถิ่นบังคับใช้ และเสนอแนะแนวทางการใช้โทษปรับทางปกครองแทนโทษอาญาในกฎหมายที่ท้องถิ่นบังคับใช้การศึกษาค้นคว้าอิสระนี้เป็นการวิจัยทางกฎหมายเชิงคุณภาพด้วยวิธีการวิจัยทางเอกสารจากตัวบทกฎหมาย ตำรา บทความ และเอกสารทางกฎหมายอื่นที่เกี่ยวข้อง ผลการศึกษาพบว่า องค์กรปกครองส่วนท้องถิ่นได้จัดตั้งขึ้นตามหลักการกระจายอำนาจทางปกครองและมีการบังคับใช้กฎหมายในเขตพื้นที่กฎหมายของท้องถิ่นส่วนใหญ่มีสภาพบังคับที่มีลักษณะเป็นโทษทางอาญา คือ โทษจำคุกและโทษปรับ แต่มีข้อจำกัดในการนำมาใช้กล่าวคือโทษจำคุกเป็นโทษที่กระทบต่อเสรีภาพของผู้กระทำผิดและกระบวนการลงโทษมีความยุ่งยากและซับซ้อน ส่วนโทษปรับไม่อาจนำมาใช้ได้อย่างมีประสิทธิภาพโดยเฉพาะกับผู้ที่มีฐานะทางการเงินดีย่อมไม่กลัวต่อการลงโทษปรับ ซึ่งมาตรการที่เหมาะสมกับการกระทำความผิดบางลักษณะที่มีโทษทางอาญา คือ โทษปรับทางปกครอง ซึ่งเป็นมาตรการที่นำมาใช้ในกฎหมายของต่างประเทศแทนการใช้โทษทางอาญา ทั้งนี้ การนำโทษปรับทางปกครองมาใช้แทนโทษอาญา ควรนำมาใช้กับกรณีที่มีลักษณะเป็นการกระทำความผิดที่มีกำหนดบทลงโทษไม่รุนแรง หรือกรณีการกระทำความผิดที่มีโทษลหุโทษตามประมวลกฎหมายอาญา คือ จำคุกไม่เกินหนึ่งเดือน หรือปรับไม่เกินหนึ่งหมื่นบาท หรือทั้งจำทั้งปรับ

The objectives of independent study are to study concepts and theories relating to local governments, sanctions of the laws enforced by local governments, administrative fines under the law of Thailand and those of foreign countries; to study and analyze the problems on application of administrative fines in place of penal fines under the laws enforced by local governments; and to propose suggestions to those problems. This independent study applied qualitative legal research through documentary research by collecting data from such sources as provisions of law, books, articles and relevant documents. The study found that local government organizations established under decentralization principle and enforces relevant laws within their administration areas. Many laws that enforced by local government organizations impose penal sanctions such as imprisonment and fine. Certain wrongdoings under those laws may be enforced with other proper sanction that is administrative fine which is applied in place of penal sanction in some other countries. Provided that the administrative fine should be applied to offences equal to cases of not serious offences or petty offences under the Penal Code that are imprisonment of not more than one month or fine of not more than ten thousand baht or to both.
