Abstract
การศึกษาค้นคว้าอิสระนี้มีวัตถุประสงค์เพื่อ 1) ศึกษาแนวคิดที่เกี่ยวข้องในการกำหนดความรับผิดทางอาญาและเทคโนโลยีช่วยการเจริญพันธุ์ทางการแพทย์ (2) ศึกษา วิเคราะห์ถึงการกำหนดโทษของความรับผิดทางอาญาเกี่ยวกับการรับตั้งครรภ์แทนตามพระราชบัญญัติคุ้มครองเด็กที่เกิดโดยอาศัยเทคโนโลยีช่วยการเจริญพันธุ์ทางการแพทย์ พ.ศ. 2558 (3) ศึกษา วิเคราะห์ความแตกต่าง ข้อดีและข้อเสียของกฎหมายที่เกี่ยวข้องกับการคุ้มครองเด็กที่เกิดโดยอาศัยเทคโนโลยีช่วยการเจริญพันธุ์ทางการแพทย์ระหว่างประเทศไทย ประเทศอังกฤษ และประเทศสหพันธ์สาธารณรัฐเยอรมนี (4) เสนอแนะแนวทางแก้ไขกฎหมายที่เกี่ยวกับการรับตั้งครรภ์แทนตามกฎหมายคุ้มครองเด็กที่เกิดโดยเทคโนโลยีช่วยการเจริญพันธุ์ทางการแพทย์ของประเทศไทยให้เหมาะสม การศึกษาค้นคว้าอิสระนี้เป็นการวิจัยเชิงคุณภาพ โดยศึกษาจากบทบัญญัติของกฎหมายที่เกี่ยวข้อง ข้อมูลจากตำรา บทความวิชาการ วิทยานิพนธ์ สารนิพนธ์ ระเบียบ คำสั่ง คำพิพากษาศาลฎีกา รวมทั้งข้อมูลอื่นๆ ที่เป็นประโยชน์ และนำมาวิเคราะห์อย่างเป็นระบบเพื่อนำมาใช้เป็นข้อมูลในการศึกษา จากผลการศึกษาพบว่า (1) แนวคิดที่เกี่ยวข้องในการกำหนดความรับผิดทางอาญาและเทคโนโลยีช่วยการเจริญพันธุ์ทางการแพทย์ ได้แก่ หลักศักดิ์ศรีความเป็นมนุษย์ หลักนิติธรรมและหลักกฎหมายเกี่ยวกับสิทธิของสามีและภริยาโดยชอบด้วยกฎหมาย (2) พระราชบัญญัติคุ้มครองเด็กที่เกิดโดยอาศัยเทคโนโลยีช่วยการเจริญพันธุ์ทางการแพทย์ พ.ศ. 2558 มีข้อบกพร่องในตัวบทกฎหมายอันอาจนำไปสู่ปัญหาความรับผิดทางอาญาบางประการตามมาภายหลังการบังคับใช้ และเป็นหลักกฎหมายที่มิใช่หลักการที่สอดคล้องกับสภาพสังคมไทย ทำให้เกิดกรณีการดำเนินการรับจ้างตั้งครรภ์แทนอย่างไม่เปิดเผย (3) จากการศึกษากฎหมายประเทศอังกฤษ และประเทศสหพันธ์สาธารณรัฐเยอรมนีพบว่า ทั้งสองประเทศให้ความสำคัญกับเทคโนโลยีช่วยการเจริญพันธุ์ในการบำบัดรักษาบุคคลที่ไม่สามารถมีบุตรได้หรือมีบุตรได้ยากกว่าปกติตามธรรมชาติ (4) ข้อเสนอแนะของงานวิจัย คือ การแก้ไขบทบัญญัติ หลักเกณฑ์การให้บริการเทคโนโลยีช่วยการเจริญพันธุ์ทางการแพทย์ อนุญาตให้มีการตั้งครรภ์แทนภายใต้เงื่อนไขที่กฎหมายกำหนด เพื่อให้ขบวนการที่หลบเลี่ยงอยู่นอกเหนือกฎหมายเข้ามาอยู่ในความควบคุมดูแลของรัฐต่อไป
This independent study aims to (1) study the concepts involved in the formulation of criminal liability and assisted reproductive technologies in medicine. (2) study, analyze Prescribing the Penalty for Criminal Liability in Surrogacy under the Protection of Children Born Using Assisted Reproductive Technology Act 2015 (3) Study, analyze Differences, pros and cons of laws relating to the protection of children born through international and foreign assisted reproductive technologies. and (4) To recommend solutions to the law related to surrogacy under the law on the protection of children born by assisted technology. Fertility medical treatment of Thailand. This independent study is a qualitative research. By studying the provisions of the relevant laws Information from textbooks Academic articles, Thesis, Thesis, Regulations, Orders, Judgment of the Supreme Court, and other information Helpful And analyzed in a systematic manner to be used as data in the study From the results of the study, it was found that (1) the concepts involved in the determination of criminal liability and assistive technology for medical prosperity were principles of human dignity, rule of law and Legal basis on the rights of lawful husbands and wives. (2) Child Protection Act Born under Assisted Reproductive Technology 2015, there are deficiencies in the law that could lead to some serious criminal liability following its enforcement. And is a legal principle which is not a principle that is consistent with the Thai society Causing an undisclosed surrogacy operation. (3) From a study of foreign law, it was found that All countries place great importance on assisted reproductive technology in the treatment of incapable individuals. Or having more difficult than usual children naturally and (4) The research suggestion is to amend the provisions. Criteria for providing assisted reproductive technology services Surrogacy is allowed under the conditions stipulated by law. So that the movement that evades outside the law into the custody of the state.
