Abstract
การศึกษาค้นคว้าอิสระนี้ มีวัตถุประสงค์เพื่อศึกษาเพื่อ (1) ศึกษาถึงแนวคิด ทฤษฎีเกี่ยวกับการกระจายอำนาจทางปกครอง และการปกครองท้องถิ่นของไทย (2) ศึกษาถึงกระบวนการการจัดทำข้อบัญญัติท้องถิ่นโดยเฉพาะกรณีองค์การบริหารส่วนตำบล (3) ศึกษาวิเคราะห์ปัญหาเกี่ยวกับกระบวนการจัดทำข้อบัญญัติองค์การบริหารส่วนตำบล และ (4) เสนอแนะแนวทางในการแก้ไขปัญหาการตราข้อบัญญัติองค์การบริหารส่วนตำบล ให้ถูกต้องและเหมาะสมกับสภาพพื้นที่และความต้องการของประชาชนได้อย่างมีประสิทธิภาพต่อไป การศึกษาค้นความอิสระนี้ครั้งนี้ เป็นการศึกษาวิจัยเชิงคุณภาพ ด้วยวิธีวิจัยเอกสาร โดยการศึกษาค้นคว้าจากตำรา รายงานการวิจัย วิทยานิพนธ์ ระเบียบข้อบังคับ ตัวบทกฎหมายที่เกี่ยวข้องในการยกร่างข้อบัญญัติองค์การบริหารส่วนตำบล และเอกสารอื่นที่เกี่ยวข้อง ผลการศึกษาพบว่า (1) จากแนวคิดทฤษฎี องค์กรปกครองท้องถิ่นเกิดขึ้นตามหลักการกระจายอำนาจทางปกครอง มีหน้าที่ในการจัดทำบริการสาธารณะในเขตพื้นที่ โดยสามารถจัดทำข้อบัญญัติท้องถิ่นเพื่อให้บริการสาธารณะบรรลุผลได้ภายใต้การกำกับดูแลของรัฐ (2) กระบวนการสำคัญในการจัดทำข้อบัญญัติของท้องถิ่น โดยเฉพาะกรณีขององค์การบริหารส่วนตำบล ได้แก่ การยกร่าง การเสนอ การพิจารณา และการประกาศใช้ข้อบัญญัติ (3) จากการวิเคราะห์ปัญหา กระบวนการ
ยกร่างและการเสนอข้อบัญญัติจะต้องมีการตรวจสอบอย่างถูกต้องและเหมาะสม การพิจารณาจะต้องพิจารณาอย่างรอบคอบ และควรให้ประชาชนและทุกภาคส่วนมีส่วนร่วมในกระบวนการในทุกขั้นตอนให้มากยิ่งขึ้น เพื่อให้สามารถบังคับใช้อย่างเหมาะสมกับความต้องการและสภาพพื้นที่ที่องค์กรปกครองส่วนท้องถิ่นนั้นตั้งอยู่ และ (4) ผู้ศึกษาขอเสนอแนะให้เจ้าหน้าที่ขององค์กรปกครองส่วนท้องถิ่นหรือนิติกรต้องร่วมตรวจสอบในกระบวนการยกร่างให้ถูกต้องตามหลักการร่างกฎหมาย ให้ประชาชนมีส่วนร่วมในการจัดทำข้อบัญญัติขององค์การบริหารส่วนตำบลทุกครั้งที่ดำเนินการ เพื่อให้ได้ข้อบัญญัติที่ถูกต้องสมบูรณ์ตรงตามเจตนารมณ์ของกฎหมายที่ตั้งไว้ และการบังคับใช้ข้อบัญญัติในเรื่องใดเรื่องหนึ่งควรใช้วิธีประกาศให้ทราบทั่วถึงในพื้นที่แทนการส่งประกาศในราชกิจจานุเบกษาเพื่อความรวดเร็วในการดำเนินงาน
The objectives of this independent study are to (1) study theoretical concepts of decentralization and local government in Thailand, (2) study the process of drafting local ordinances especially those of the subdistrict administrative organizations, (3) analytical study the problems in law drafting process of the ordinances of subdistrict administrative organizations, and (4) propose the guidelines for issuing local ordinances of the subdistrict administrative organizations to be more effective for the people in the area. This independent study is qualitative research by method of documentary research on legal textbooks, research works, theses, rules and regulations, related provisions of law in drafting local ordinances, and other related documents. The results showed that: (1) According to principle of decentralization, local government organizations are established with the authority to provide public services within their areas. In this regard, they shall have power to issue local ordinances to fulfill the objectives under supervision of the State. (2) The important process of drafting local ordinances especially those of the subdistrict administrative organizations are drafting, submitting draft ordinances, consideration and publication of the ordinances. (3) According to the analytical study, the problems are that the drafting and initiating ordinances should be under lawfully examination. The consideration of the draft ordinances should be done with more careful scrutiny and the people participation should be more promoted in every step to suit the needs and the nature of the areas. And (4) the author proposes that the officials or legal officials of the subdistrict administrative organizations must follow strictly to the law drafting rules and to seek public participation in all respects in order to make the ordinances lawful and in accordance with the real objectives. In addition, the enforcement of the ordinances should be done by publication to be known thoroughly in the area rather than to publish in the Government Gazette for speedy implementation.
