สิทธิประโยชน์ของข้าราชการพลเรือนสามัญภายหลังกลับคืนตำแหน่งเดิมตามคำพิพากษาศาลปกครอง

Abstract

การศึกษาค้นคว้าอิสระเรื่อง “สิทธิประโยชน์ของข้าราชการพลเรือนสามัญภายหลังกลับคืนตำแหน่งเดิมตามคำพิพากษาศาลปกครอง” มีวัตถุประสงค์เพื่อศึกษาแนวคิด ทฤษฎี และการกลับคืนสู่ตำแหน่งเดิมของข้าราชการพลเรือนของต่างประเทศ หลักเกณฑ์และวิธีการกลับคืนสู่ตำแหน่งเดิมของข้าราชการพลเรือนสามัญของประเทศไทย ศึกษามาตรการทางกฎหมายเพื่อเยียวยาแก่ข้าราชการพลเรือนที่กลับคืนสู่ฐานะเดิม การศึกษาค้นคว้าอิสระนี้เป็นการวิจัยเชิงคุณภาพด้วยวิธีการวิจัยทางเอกสาร โดยศึกษาจากแนวคิด ทฤษฎี บทบัญญัติของกฎหมาย และคำพิพากษาหรือคำสั่งของศาลปกครองสูงสุด รวมทั้งข้อมูลต่าง ๆ จากตำรา บทความทางวิชาการ งานวิจัย หรือวิทยานิพนธ์และสื่ออิเล็กทรอนิกส์ ที่เป็นประโยชน์ต่อการศึกษาค้นคว้าอิสระในครั้งนี้ ผลการศึกษาพบว่า การกลับคืนสู่ตำแหน่งเดิมและได้รับคืนซึ่งสิทธิประโยชน์ต่าง ๆ ของข้าราชการพลเรือนสามัญตามคำพิพากษาศาลปกครอง ยังคงมีปัญหาในทางปฏิบัติ ซึ่งอาจเกิดจากคำบังคับของศาลปกครอง การไม่มีกฎหมายกำหนดวิธีการและหลักเกณฑ์ไว้ชัดแจ้งเกี่ยวกับการดำเนินการดังกล่าว และปัญหาข้อกฎหมายเกี่ยวกับมาตรการปรับกรณีหน่วยงานทางปกครองเพิกเฉยไม่ดำเนินการตามคำพิพากษาหรือดำเนินการล่าช้าเกินสมควร ซึ่งจากการศึกษาวิจัยได้เสนอแนะแนวทางในการแก้ไขปัญหาในการดำเนินการบรรจุให้ข้าราชการพลเรือนสามัญกลับคืนสู่ตำแหน่งเดิมและได้รับคืนสิทธิประโยชน์ต่าง ๆ ตามสิทธิ เพื่อให้สามารถเยียวยาแก้ไขความเดือดร้อนเสียหายของข้าราชการพลเรือนสามัญ โดยเสนอให้มีการปรับปรุงแก้ไขกฎหมายว่าด้วยการจัดตั้งศาลปกครองและวิธีพิจารณาคดีปกครอง กฎหมายว่าด้วยระเบียบข้าราชการพลเรือน กฎหมายว่าด้วยการเลื่อนขั้นเงินเดือน

The objective of this independent study on “The Benefits of Civil Servants after Returning to the Original Positions by Judgments of the Administrative Court” were to study the theoretical concepts and rules relating to the returning to the original positions of civil servants in foreign countries, the rules and procedures for returning to the original positions of the Thai civil servants and to study legal measures to remedy the civil servants restored to the original positions. This independent study was a qualitative research based on documentary research covering concepts, theories, laws, rulings and judgments of the Supreme Administrative Court, as well as relevant data from textbooks, academic journal articles, research reports, theses, and electronic media. The research results indicated that the returning to the original positions and benefits of the civil servants according to the judgment of Administrative Court still has problems on implementation in practice resulting from the decrees of Administrative Court and having no rule and measure of implementation, as well as the legal problem of penalty in cases where the government agencies ignore the judgment or improper delay process of implementation. From the research, there are suggestions for resolving the issues to relieve the damage of the civil servants and restoring their benefits by making proposal to amend the act on establishment of Administrative Court and Administrative Court procedure, the civil service act and the rules on salary promotion.
