Abstract
การศึกษาครั้งนี้มีวัตถุประสงค์เพื่อ (1) ศึกษาบทบัญญัติของกฎหมายจัดตั้งองค์การอุตสาหกรรมป่าไม้ (2) ศึกษาแนวคิดและหลักการของรัฐวิสาหกิจตามหลักกฎหมายมหาชน (3) ศึกษาแนวคิดในการจัดตั้งรัฐวิสาหกิจในประเทศไทยและแนวความคิดในการจัดตั้งองค์การอุตสาหกรรมป่าไม้ (4) ศึกษารูปแบบอำนาจหน้าที่และการควบคุมกำกับดูแลรัฐวิสาหกิจทั้งในประเทศและต่างประเทศ โดยเฉพาะองค์การอุตสาหกรรมป่าไม้ และ (5) ศึกษาและหาหลักเกณฑ์ทางกฎหมายที่เหมาะสม เพื่อนำมาใช้แก้ปัญหาที่เกิดขึ้นกับองค์การอุตสาหกรรมป่าไม้ โดยวิธีการศึกษาเปรียบเทียบกับหลักเกณฑ์ทางกฎหมายในต่างประเทศ การศึกษาค้นคว้าอิสระนี้เป็นการวิจัยเชิงคุณภาพด้วยวิธีการแบบวิจัยเอกสาร (Documentary Research) โดยวิเคราะห์จากพระราชบัญญัติ มติคณะรัฐมนตรีและระเบียบข้อบังคับต่าง ๆ ขององค์การอุตสาหกรรมป่าไม้ ผลการศึกษาพบว่า กฎหมายจัดตั้งองค์การอุตสาหกรรมป่าไม้ในปัจจุบันซึ่งบังคับใช้มานานและมิได้มีการแก้ไขหลักการในกฎหมายที่สำคัญเพื่อให้เอื้อต่อการดำเนินงานและสนองนโยบายของรัฐบาล จึงสมควรแก้ไขเพิ่มเติมกฎหมายเพื่อประโยชน์ต่อการดำเนินงานในปัจจุบันและอนาคตต่อไป ดังนี้ (1) ในเรื่องผู้อำนวยการองค์การอุตสาหกรรมป่าไม้ที่มาจากวิธีการสรรหา (2) ในเรื่องความรู้ ประสบการณ์และวาระการดำรงตำแหน่งของกรรมการบริหารกิจการขององค์การอุตสาหกรรมป่าไม้ (3) ในเรื่องรายได้และค่าใช้จ่ายขององค์การอุตสาหกรรมป่าไม้ (4) ในเรื่องการกู้ยืมเงิน (5) ในเรื่องการร่วมการงานหรือสมทบกับบุคคลอื่น (6) ในเรื่องการออกพันธบัตรหรือตราสารอื่นใดเพื่อการลงทุน และ (7) ในเรื่องการแต่งตั้งและถอดถอนรองผู้อานวยการองค์การอุตสาหกรรมป่าไม้
The objectives of this study were: (1) to study provisions of the law to establish the Forest Industry Organization; (2) to study concepts and principles of state enterprises under the public law; (3) to study the concepts of establishing some other state enterprises in Thailand and also the Forest Industry Organization; (4) to study the administration and supervision of State enterprises and authority, both domestic and extraneous state enterprises, and especially the Forest Industry Organization; and (5) to study and search for an appropriate legal basis in order to solve the problems for the Forest Industry Organization by comparison with laws of foreign countries. This Independent Study is a qualitative research and conducted through a document research by studying and analyzing the Acts, resolutions of the cabinet, and rules and regulations of the Forest Industry Organization. The results showed that the law establishing the Forest Industry Organization has been used for a long time and has not resolved any principles for facilitating the implementation of government policy. So, improvement of that law is needed for a better implementation from now on such as (1) the method used to recruit the director of Forest Industry Organization, (2) the knowledge, experiences and the term of office for the board of Forest Industry Organization, (3) incomes and expenses, (4) loaning, (5) cooperation with other entities, (6) bond or other instruments for investment purposes, and (7) appointment and dismissal of a deputy director of the Forest Industry Organization.
