Abstract
การศึกษาค้นคว้าอิสระเรื่องการปล่อยชั่วคราวในชั้นสอบสวนและในชั้นศาลโดยใช้หลักประกันร่วมกัน มีวัตถุประสงค์เพื่อ (1) เพื่อศึกษาวิวัฒนาการ แนวคิดทฤษฎีและหลักการเกี่ยวกับการปล่อยชั่วคราวในชั้นศาลโดยใช้หลักประกันชั้นสอบสวน (2) เพื่อศึกษากฎหมาย เกี่ยวกับการปล่อยชั่วคราวโดยมีหลักประกันตามกฎหมายของไทยและกฎหมายของต่างประเทศ ได้แก่ ประเทศอังกฤษและประเทศสหรัฐอเมริกา (3) เพื่อวิเคราะห์ปัญหาเกี่ยวกับการปล่อยชั่วคราวในชั้นศาลโดยใช้หลักประกันชั้นสอบสวน (4) เพื่อนำผลการศึกษาวิเคราะห์มาเสนอเป็นแนวทางการ ปรับปรุงแก้ไขปัญหากฎหมายเกี่ยวกับการปล่อยชั่วคราวในชั้นศาลโดยใช้หลักประกันชั้นสอบสวน
การศึกษาก้นคว้าอิสระนี้เป็นการวิจัยเชิงคุณภาพ ด้วยการวิจัยจากเอกสารและรวบรวม ข้อมูลต่างๆ จากตำราทางวิชาการ งานวิจัย วิทยานิพนธ์ บทความ วารสารทางกฎหมาย คำพิพากษา ศาลฎีกา ข้อมูลอิเล็กทรอนิกส์ทางอินเทอร์เน็ต เพื่อนำเสนอแนวทางการปรับปรุงและพัฒนากฎหมาย ต่อไป ผลจากการศึกษาพบว่า แม้การปล่อยชั่วคราวในชั้นสอบสวนและในชั้นศาลจะมี หลักเกณฑ์ทางกฎหมายเช่นเดียวกัน แต่ศาลก็ยังไม่ยอมรับหลักประกันในชั้นสอบสวน เนื่องจากปัญหาการปล่อยชั่วคราวในชั้นสอบสวนและในชั้นศาลไม่ต่อเนื่องกัน ปัญหาการกำหนดวงเงิน ประกันที่มีความแตกต่างกันและปัญหาการพิจารณาหลักประกันในชั้นศาลที่เคร่งครัดกว่าในชั้นสอบสวน ส่งผลกระทบให้ผู้ต้องหาหรือจำเลยในคดีอาญาไม่ได้ความคุ้มครองสิทธิในการปล่อยชั่วคราวตามกฎหมายและต้องถูกควบคุมระหว่างการขอให้ปล่อยชั่วคราวในชั้นศาลขัดต่อหลักการ ตามปฏิญญาสากลว่าด้วยสิทธิมนุษยชนที่กำหนดว่าทุกคนที่ถูกกล่าวหาว่ากระทำผิดทางอาญามีสิทธิได้รับการสันนิษฐานไว้ก่อนว่าบริสุทธิ์ เพื่อให้การปล่อยชั่วคราวในชั้นสอบสวนและในชั้นศาล สามารถใช้หลักประกันร่วมกันได้จึงได้เสนอแนะแนวทางเพื่อปรับปรุงกฎหมายให้การปล่อยชั่วคราว ในชั้นสอบสวนและในชั้นศาลให้มีความต่อเนื่องเป็นกระบวนการเดียวกัน โดยกำหนดหลักเกณฑ์กลางเพื่อใช้สำหรับการปล่อยชั่วคราวทั้งในชั้นสอบสวนและในชั้นศาลร่วมกัน
The objectives of this research were (1) to study the evolution, concepts, theories and principles of provisional release of the accused in a court case using the same surety that was posted for provisional release during the investigative stage; (2 ) to study laws related to provisional release of the accused in Thailand and compare them to similar laws in England and the USA; (3) to analyze problems with the provisional release of the accused in the court stage using the surety that was posted for provisional release during the investigative stage; and (4) to use the conclusions to form recommendations for revising related laws. This was a qualitative research based on documentary research. Data were compiled from textbooks, research reports, theses, articles, essays, legal journals, Supreme Court rulings, and the Internet. Data were analyzed for the aim of forming conclusions and recommendations. The research showed that although the same legal principles apply to provisional release of the accused during the investigation stage and during the court stage, court officials in Thailand do not accept the surety posted for provisional release during the investigation stage for use as the surety for release during the court stage. This is due to a lack of continuity between the two stages, because the amount of surety required during the court stage is higher, and because the court officials are more stringent in their inspection of the surety. As a result, the accused in a criminal case may not receive his or her rights to be provisionally released and may have to be incarcerated while waiting. This is not in compliance with the international convention on human rights, which states that anyone accused of a criminal offense has the right to be considered innocent until proven guilty. In order to allow the accused to use the same surety to obtain provisional release during the investigation stage and the court stage, the researcher suggests that the laws should be amended to make provisional release the same continuous process during both stages, with common principles governing the posting of surety for provisional release during both stages.
