Abstract
การศึกษาค้นคว้าอิสระเรื่องนี้มีวัตถุประสงค์เพื่อ (1) ศึกษาความหมาย ความเป็นมา แนวคิดและทฤษฎีเกี่ยวกับกลไกคุ้มครองผู้บริโภคในยุคดิจิทัล (2) ศึกษากฎหมายที่เกี่ยวข้องกับกลไกคุ้มครองผู้บริโภคในยุคดิจิทัลของประเทศไทย (3) ศึกษากฎหมายที่เกี่ยวข้องกับกลไกคุ้มครองผู้บริโภคในยุคดิจิทัลของต่างประเทศ (4) ศึกษาวิเคราะห์ปัญหากฎหมายเกี่ยวกับกลไกคุ้มครองผู้บริโภคในยุคดิจิทัล (5) ศึกษาหาแนวทางการพัฒนากลไกคุ้มครองผู้บริโภคในยุคดิจิทัลของประเทศไทยให้มีประสิทธิภาพมากยิ่งขึ้น ผลการศึกษาพบว่า (1) การคุ้มครองผู้บริโภคในยุคดิจิทัลเป็นการคุ้มครองผลประโยชน์ของผู้ซื้อสินค้าหรือบริการจากผู้ประกอบการธุรกิจผ่านแพลตฟอร์มออนไลน์ทั้งในประเทศและต่างประเทศ โดยมีแนวคิดที่สำคัญ ได้แก่ แนวคิดเกี่ยวกับการคุ้มครองผู้บริโภค แนวคิดเกี่ยวกับการระงับข้อพิพาททางออนไลน์ (2) กฎหมายที่เกี่ยวข้องกับกลไกการคุ้มครองผู้บริโภคในยุคดิจิทัลของประเทศไทยได้แก่ พระราชบัญญัติคุ้มครองผู้บริโภค พ.ศ. 2522 ระเบียบคณะกรรมการคุ้มครองผู้บริโภค ว่าด้วยหลักเกณฑ์การไกล่เกลี่ยหรือประนอมข้อพิพาทเกี่ยวกับการละเมิดสิทธิของผู้บริโภค พ.ศ. 2559 พระราชบัญญัติวิธีพิจารณาคดีผู้บริโภค พ.ศ. 2551 และพระราชบัญญัติการจัดตั้งสภาองค์กรของผู้บริโภค พ.ศ. 2562 (3) กฎหมายที่เกี่ยวข้องกับกลไกคุ้มครองผู้บริโภคในยุคดิจิทัลของต่างประเทศ ได้แก่ บันทึกทางเทคนิคว่าด้วยการระงับข้อพิพาทออนไลน์ของสหประชาชาติ กฎหมายว่าด้วยสิทธิของผู้บริโภคของสหภาพยุโรป แผนปฏิบัติการเชิงกลยุทธ์ของอาเซียน เพื่อการคุ้มครองผู้บริโภคของอาเซียน ตรากฎหมายว่าด้วยเว็บ ที่ปลอดภัยของสหรัฐอเมริกาของสหรัฐอเมริกา พระราชบัญญัติสิทธิผู้บริโภคและระเบียบว่าด้วยสัญญาผู้บริโภคของสหราชอาณาจักร (4) ปัญหากฎหมายเกี่ยวกับกลไกคุ้มครองผู้บริโภคในยุคดิจิทัลมีปัญหา 3 ประการได้แก่ 1) ปัญหาเกี่ยวกับกลไกคุ้มครองผู้บริโภคด้านการกากับดูแลผู้ประกอบการขายสินค้า 2) ปัญหาเกี่ยวกับกลไกการกาหนดองค์กรที่ทำหน้าที่คุ้มครองผู้บริโภคจากการซื้อสินค้าทางออนไลน์ และ 3) ปัญหาเกี่ยวกับกลไกการระงับข้อพิพาทที่เกิดขึ้นจากการซื้อขายสินค้าออนไลน์ (5) ผู้ศึกษาเห็นควรแก้ไข ดังนี้ 1) ควรเพิ่มเติมอานาจของสภาองค์กรของผู้บริโภคในการจัดให้มีความร่วมมือระหว่างองค์กรคุ้มครองผู้บริโภค ผู้ประกอบธุรกิจ และหน่วยงานของรัฐ ในการกำกับดูแลกันเองภายใต้ข้อกำหนด 2) ควรกำหนดให้คณะกรรมการคุ้มครองผู้บริโภคมีอำนาจ และหน้าที่พิจารณาการร้องทุกข์จากผู้บริโภคที่ได้รับความเสียหายอันเนื่องมาจากการ กระทำของผู้ประกอบธุรกิจที่จดทะเบียนพาณิชย์ทั้งในประเทศ และต่างประเทศ เพื่อให้เกิดกลไกการคุ้มครองผู้บริโภคข้ามพรมแดนเป็นไปอย่างมีประสิทธิภาพ และ 3) ควรกำหนดให้คณะกรรมการคุ้มครองผู้บริโภคมีอำนาจและหน้าที่ประสานความร่วมมือกับหน่วยงานคุ้มครองผู้บริโภคในต่างประเทศ เพื่อให้เกิดกระบวนการไกล่เกลี่ย หรือประนีประนอมข้อพิพาทเกี่ยวกับการละเมิดสิทธิของผู้บริโภคข้ามพรมแดน รวมถึงการบังคับใช้กฎหมาย
The objectives of this Independent Study are to: (1) study the meaning, background, concepts and theories about consumer protection mechanisms in Digital age (2) Study laws related to consumer protection mechanisms in the digital age of Thailand (3) Study laws related to consumer protection mechanisms in the digital age in foreign countries (4) Study and analyze legal problems related to consumer protection mechanisms in the digital age (5) Study and counsel to develop consumer protection mechanisms in the digital age of Thailand for more efficiency.. This Independent Study employs qualitative research by a method of documentary research, which the author gathered from literature in both Thai language and English language, information from text books and commentaries, information from law text books, articles, research papers, theses, as well as printing materials and online electronic media. Results of the study show that Guidelines for the Development of Consumer Protection Mechanisms in Digital age still features some problems, including: (1) Problems with consumer protection mechanisms in the aspect of regulating merchandisers (2) Problems with mechanisms for determining organizations that protect consumers from online purchases (3) Problems with suspension mechanisms Disputes arising from online purchases. the author, thus, recommends to solve them as follows: (1) Should amend the Notification of the Ministry of Commerce Re: Requires Commercial Operators to Register Commercial (No. 11) B.E. when applying for commercial registration Disseminate the following information in electronic media accompanying the sale of goods or services : information about the company Information, about products or services Information, about the goods Information, and about consumer protection. (2) The Consumer Protection Board should have the power and duty to consider complaints from consumers who have suffered or damaged as a result of the actions of business operators registered in foreign countries. and coordinate with consumer protection agencies in foreign countries. To create an effective mechanism for cross-border consumer protection (3) The Consumer Protection Board should have the powers and duties to coordinate with the consumer protection agencies in foreign countries. To establish a mediation or conciliation process for cross-border consumer rights violations. including law enforcement.
