Abstract
การศึกษาวิจัยครั้งนี้มีวัตถุประสงค์เพื่อ (1) เพื่อศึกษามูลเหตุของการถอดถอนผู้บริหารท้องถิ่นโดยประชาชนตามพระราชบัญญัติว่าด้วยการลงคะแนนเสียงเพื่อถอดถอนสมาชิกสภาท้องถิ่นหรือผู้บริหารท้องถิ่น พ.ศ. 2542 (2) เพื่อศึกษาปัจจัยความสำเร็จในการถอดถอนผู้บริหารท้องถิ่นโดยประชาชน (3) เพื่อศึกษาวิธีดำเนินการถอดถอนผู้บริหารท้องถิ่นโดยประชาชน (4) เพื่อศึกษาปัญหาอุปสรรคและแนวทางแก้ไขปัญหาของการถอดถอนผู้บริหารท้องถิ่นโดยประชาชน
ผลการวิจัยพบว่า (1) มูลเหตุสำหรับของการถูกถอดถอน คือ การถูกกล่าวหาด้านต่างๆ อาทิความประพฤติและการปฏิบัติหน้าที่ ความขัดแย้งระหว่างภาคราชการและผู้นำชุบชนท้องถิ่น (2) ปัจจัยความสำเร็จ คือ การรับรู้ข้อมูลข่าวสาร การมีส่วนร่วมทางการเมืองของประชาชน การสนับสนุนของภาคราชการและกลุ่มผู้นำชุมชนท้องถิ่น วัฒนธรรมการเชื่อผู้นำของประชาชน การประชาสัมพันธ์วิธีการลงคะแนนเสียงให้ประชาชนได้รับทราบ และความถูกต้องในการปฏิบัติหน้าทีของผู้มีอำนาจ
(3) วิธีดำเนินการมีกระบวนการดำเนินการหลายขั้นตอน ที่สำคัญคือ การยื่นคำร้องขอถอดถอน การลงคะแนนเสียง และการประกาศผลการลงคะแนนเสียง (4) ปัญหา อุปสรรค คือ ปัญหาความรู้ความเข้าใจของประชาชนปัญหาเกี่ยวกับบทบัญญัติของกฎหมาย ปัญหาค่าใช้จ่ายในการดำเนินการ และปัญหาของผู้มีหน้าที่รับผิดชอบ
ในการดำเนินการ ส่วนแนวทางแก้ไขปัญหา คือ การส่งเสริมความรู้เกี่ยวกับสิทธิหน้าที่และการมีส่วนร่วมทางการเมืองให้ประชาชนทราบ การบรรจุวิชาการปกครองท้องถิ่นให้เด็กและเยาวชนได้รับตั้งแต่เยาว์วัยการปรับปรุงแก้ไขกฎหมายเกี่ยวกับการทำเครื่องหมายการลงคะแนนเสียง การกำหนดสัดส่วนการลงคะแนนเสียง ค่าใช้จ่ายในการดำเนินการ การหยุดพักการปฏิบัติหน้าที่ของผู้ถูกถอดถอน และการมอบหมายผู้กำกับดูแลองค์กรปกครองส่วนท้องถิ่นเป็นผู้รับผิดชอบในการดำเนินการหัวหน้าพนักงานท้องถิ่น
The objectives of this research were to study the following aspects of the impeachment of local administrators by the people under the Local Council Member or Local Administrator Impeachment Act of 1999: (I) the reasons for impeachment; (2) factors of success; (3) methods of impeachment; and (4) problems and recommended ways to solve them. This was a qualitative research based on a review of the literature, document research and interviews with 14 individuals involved with the impeachment of the chairman of the Huay Gone Sub-district Administrative Organization, comprising government employees, local leaders, and voters. The results were analyzed descriptively. The results showed that: (1) the main reasons for the impeachment were that the local administrator was accused of misbehavior and misuse of power, as well as conflicts between government officials and community leaders. (2) the factors of success in the impeachment effort were awareness of news and information, public participation in politics, support from the government and local leaders, the culture of belief in leaders, public relations about the impeachment method, and the correct fulfillment of their duties by people in power. (3) the impeachment process comprised several steps including submission of a complaint, voting, and announcement of the voting results. (4) problems in the impeachment process included lack of know ledge and understanding among the people, problems with the law, the costs involved, and problems with the responsible officials. Recommended ways to solve these problems arc to educate the people on their rights and responsibilities and on political participation; to include education on local administration in school curricula; to revise the laws regarding ballot marking, vote proportions, and operational costs; to require administrators facing impeachment to be suspended until the results of the voting arc known; and to assign the person in charge of the local administrative organization to be responsible for taking over operations in place of the local head executor.
