การศึกษาค้นคว้าอิสระเรื่องนี้ มีวัตถุประสงค์เพื่อ ศึกษาแนวคิด ทฤษฎี ในการกระ
จายอำนาจและการถ่ายโอนภารกิจให้แก่องค์กรปกครองส่วนท้องถิ่น โดยเฉพาะที่เกี่ยวข้องกับด้านการบริหารจัดการและอนุรักษ์ทรัพยากรธรรมชาติ สิ่งแวดล้อม ศึกษาสภาพปัญหาและข้อจำกัดในการดำเนินภารกิจควบคุมไฟป่าขององค์กรปกครองส่วนท้องถิ่น ศึกษาวิเคราะห์เปรียบเทียบการใช้อำนาจขององค์กรปกครองส่วนท้องถิ่นตาม
พระราชบัญญัติป่าไม้ พุทธศักราช 2484 และพระราชบัญญัติป่าสงวน แห่งชาติ พ.ศ.2507 กับ การใช้อำนาจขององค์กรปกครองส่วนท้องถิ่น ตามพระราชบัญญัติการสาธารณสุข พ.ศ.2535 และเสนอข้อคิดเห็นและข้อเสนอแนะแนวทางแก้ไขปัญหาการดำเนินภารกิจควบคุมไฟป่าขององค์กรปกครองส่วนท้องถิ่น ผลการศึกษาพบว่า ปัญหาในการดำเนินภารกิจควบคุมไฟป่าขององค์กรปกครองส่วนท้องถิ่นนั้น
มีปัญหาและข้อจำกัดหลายประการ อาทิเช่น กฎหมายที่ให้อำนาจองค์กรปกครองส่วนท้องถิ่นมีอำนาจในการจัดการทรัพยากรธรรมชาติและสิ่งแวดล้อม รวมถึงการดำเนินภารกิจควบคุมไฟป่า แต่การกำหนดอำนาจหน้าที่ยังไม่ชัดเจน มาตรการทางกฎหมายในการควบคุมไฟป่า กระจัดกระจายอยู่ในกฎหมายหลายฉบับ และไม่ได้ระบุ
รายละเอียดเกี่ยวกับมาตรการที่ให้ท้องถิ่นในการป้องกันและควบคุมไฟป่าไว้โดยเฉพาะ ปัจจุบันองค์กรปกครองส่วนท้องถิ่น จึงต้องปฏิบัติหน้าที่โดยอาศัยกฎหมายของหน่วยงานอื่น และในการตราข้อกำหนดท้องถิ่น ไม่ได้มีกฎหมายบัญญัติรองรับให้องค์กรปกครองส่วนท้องถิ่น สามารถออกข้อกำหนดท้องถิ่นที่เกี่ยวกับการควบคุมไฟป่าได้
ผู้ศึกษาจึงได้เสนอแนะการแก้ไขเพิ่มเติมกฎหมาย เพื่อให้เกิดความชัดเจนยิ่งขึ้นเกี่ยวกับอำนาจหน้าที่ขององค์กรปกครองส่วนท้องถิ่นในการควบคุมไฟป่า ทั้งการแก้ไขเพิ่มเติมพระราชบัญญัติกำหนดแผนและขั้นตอนการกระจายอำนาจให้แก่องค์กรปกครองส่วนท้องถิ่น พ.ศ.2542 ให้ระบุอำนาจหน้าที่ขององค์กรปกครองส่วนท้องถิ่น
ให้ชัดเจนในการดำเนินภารกิจควบคุมไฟป่าด้วย ทั้งให้เจ้าหน้าที่ขององค์กรปกครองส่วนท้องถิ่นเป็นพนักงานเจ้าหน้าที่ตามพระราชบัญญัติป่าไม้ พุทธศักราช 2484 และพระราชบัญญัติป่าสงวนแห่งชาติ พ.ศ.2507 เพื่อสามารถปฏิบัติภารกิจควบคุมไฟป่าและตอบสนองการแก้ไขปัญหาไฟป่าในท้องถิ่นได้อย่างจริงจัง รวมถึงปรับปรุงเพิ่มเติมมาตรการทางกฎหมายเกี่ยวกับการป้องกันไฟป่าให้ครอบคลุมมากกว่าเดิม และแก้ไขเพิ่มเติมให้ท้องถิ่นมีอำนาจตรากฎหมายลำดับรอง เพื่อใช้มาตรการป้องกันและควบคุมไฟป่าที่เหมาะสมสำหรับแต่ละท้องถิ่น
This independent study on challenges and problems faced by Local Administrative Offices (LAO) for wildfire control and management aims to study concepts and theories of decentralization and transfer of missions to Local Administrative Offices (LAOs), especially in the aspect of management and preservation of environmental and natural resources, study problems and limitations of LAOs’ wildfire management, analyze and compare implementation and administration of LAOs according to the Forest Act, B.E. 2484 (1941), and the National Forest Preservation Act, B.E. 2507 (1964) and local authorization of LAOs under the Public Health Act, B.E. 2535 (1992), and propose recommendations and solutions to effective wildfire management by LAOs.This study is a qualitative research project. Data were collected from legal textbooks on concepts, theories, judgments, case studies and relevant issues. Findings of the study revealed that LAOs faced many challenges. For instance, LAOs are legally authorized manage environmental and natural resources and control wildfires. However, authority delegation is not clear and wildfire control measures are stated in many laws and details of local measures for preventing and controlling wildfires are not stated. At present, LAOs need to use other laws to protect and manage wildfires. There is no designated law to allow LAOs to independently authorize regulation for wildfire management at the local level. Thus, the author recommends a review and amendment of the current act, allowing the LAOs to have clear procedures to manage wildfires. The Act Prescribing Plan and Procedure for the Decentralization of Power to Local B.E. 2542 (1999) should also be amended by clearly prescribing LAOs to have authority to control wildfires. Moreover, LAO staff should be considered as an official according to the Forest Act, B.E. 2484 (1941), and the National Forest Preservation Act, B.E. 2507 (1964) in order to truly control wildfires and respond to resolve local wildfires problems. Furthermore, legal measures to prevent wildfires should cover more areas and LAO’s should have secondary authority to appropriately prevent and control local wildfires.
