Abstract
การศึกษาค้นคว้าอิสระนี้มีวัตถุประสงค์เพื่อ 1) ศึกษาหลักการในการดำเนินการทางวินัยข้าราชการครู (2) ศึกษาหลักการในการใช้ดุลพินิจลงโทษทางวินัยข้าราชการครู (3) ศึกษาหลักเกณฑ์การใช้ดุลพินิจลงโทษวินัยข้าราชการครูของไทยและสาธารณรัฐสิงค์โปร์ สหรัฐอเมริกา ฟินแลนด์ และสาธารณรัฐฝรั่งเศส (4) วิเคราะห์เปรียบเทียบการใช้ดุลพินิจลงโทษวินัยข้าราชการครูไทย และสาธารณรัฐสิงค์โปร์ สหรัฐอเมริกา ฟินแลนด์ และสาธารณรัฐฝรั่งเศส (5) เสนอแนะในการใช้ดุลพินิจลงโทษวินัยข้าราชการครูอย่างถูกต้องเหมาะสม การค้นคว้าอิสระฉบับนี้เป็นการศึกษาวิจัยเชิงคุณภาพ ด้วยวิธีวิจัยเอกสาร รวบรวมเอกสารกฎหมาย ทั้งในประเทศไทย และต่างประเทศ วิทยานิพนธ์ การศึกษาอิสระ คำพิพากษาของศาลปกครองสูงสุด กฎ ก.ค.ศ. ตัวอย่างโทษทางวินัยข้าราชการครู พร้อมนำมาวิเคราะห์เปรียบเทียบในการใช้ดุลพินิจลงโทษทางวินัยข้าราชการครู ผลการศึกษาพบว่า (1) การดำเนินการทางวินัยข้าราชการครู ได้มีกฎหมายกำหนดไว้ซึ่งสามารถใช้ดุลพินิจในการลงโทษได้ (2) การใช้ดุลพินิจลงโทษวินัยราชการครู มีการใช้ดุลพินิจผูกพันและดุลพินิจวินิจฉัยในการลงโทษวินัยราชการครู (3) การใช้ดุลพินิจลงโทษวินัยต้องเหมาะสมกับความผิด สอดคล้องกับหลักนิติธรรมและหลักมโนธรรม โดยยึดหลักกฎหมายที่เกี่ยวข้องอย่างเคร่งครัด (4) การใช้ดุลพินิจการลงโทษทางวินัยราชการครูของไทยและของสาธารณรัฐสิงค์โปร์ สหรัฐอเมริกา ฟินแลนด์ และสาธารณรัฐฝรั่งเศสนั้น พบว่าของประเทศไทยดำเนินการล่าช้า ลงโทษทางวินัยไม่เหมาะสมกับความผิด ทำให้ครูไม่เกรงกลัวต่อการกระทำผิดทางวินัย ซึ่งแตกต่างจากสาธารณรัฐสิงค์โปร์ สหรัฐอเมริกา ฟินแลนด์ และสาธารณรัฐฝรั่งเศสที่ดำเนินการด้วยความรวดเร็วและลงโทษเหมาะสมกับความผิด ทำให้ครูเกรงกลัวต่อการกระทำผิดทางวินัย (5) การใช้ดุลพินิจการลงโทษวินัยราชการครูต้องยึดดุลพินิจผูกพันและดุลพินิจวินิจฉัยตามหลักกฎหมายและควรปรับปรุงแก้ไขกฎหมายพระราชบัญญัติระเบียบข้าราชการครูและบุคลากรทางการศึกษา พ.ศ. 2547 มาตรา 96 และมาตรา 97 และกฎ กคศ. ว่าด้วยความผิดชัดแจ้ง พ.ศ. 2549
The objectives of this independent study are (1) to study the principle in processes on discipline for teachers (2) to study concept in using discretion to punish on discipline for teachers (3) to study concept in using discretion to punish on discipline for teachers in Thailand and Republic of Singapore, United States of America, Finland and France Republic (4) to analyze comparing in using discretion to punish on discipline for teachers in Thailand and Republic of Singapore, United States of America, Finland and France Republic (5) to suggest the guideline in using discretion to punish on discipline for teachers correctly and suitably. This independent study is the qualitative research conducted based on documentary research by collecting the law legal document in Thailand and other countries, researches, independent study, judgment of court orders, rules of Officials of Office of the Teacher Civil Services and Educational Personnel Commission (OTEPC), examples of punishing in discipline for teachers and analyze for comparing in using discretion to punish on discipline for teachers. The results showed (1) processing on discipline for teachers has the law specify that can use discretion to punish (2) discretion to punish on discipline for teachers can use mandatory and judge discretion to punish on discipline for teachers (3) using discretion must be suitable in mistake, conforming in concepts of jurisprudence and conscience based on relating law fixedly (4)using discretion to punish on discipline for Thai teachers and teachers of Republic of Singapore, United States of America, Finland and France Republic as follows; Thailand was late in process and did not punish in suitable for mistake that made the teachers to unfear in making disciplines which was different from Republic of Singapore, United States of America, Finland and France Republic which did rapidly and punished for suitable mistake that made the teachers to fear in making disciplines (5) using discretion to punish on discipline for teachers must use mandatory and judge discretion based on law and should be adjust the Act of Teachers and Personnel B.E.2547 section 96 and 97 and rules of Officials of Office of the Teacher Civil Services and Educational Personnel Commission (OTEPC) B.E. 2549.
