Abstract
การศึกษาค้นคว้าอิสระนี้มีวัตถุประสงค์เพื่อ (1) ศึกษาความหมาย แนวคิด ทฤษฎี และหลักการที่เกี่ยวข้องกับมาตรการในการควบคุมกัญชาและผลิตภัณฑ์ที่มาจากกัญชา (2) ศึกษากฎหมายที่เกี่ยวข้องกับมาตรการในการควบคุมกัญชาและผลิตภัณฑ์ที่มาจากกัญชา ทั้งในประเทศไทยและต่างประเทศ (3) วิเคราะห์ปัญหาและเปรียบเทียบกฎหมายที่เกี่ยวข้องกับมาตรการในการควบคุมกัญชาและผลิตภัณฑ์ที่มาจากกัญชา และ (4) เสนอแนวทางการแก้ไขปัญหาที่เกี่ยวข้องกับมาตรการในการควบคุมกัญชาและผลิตภัณฑ์ที่มาจากกัญชาในประเทศไทย การศึกษาค้นคว้าอิสระนี้เป็นการวิจัยเชิงคุณภาพ ด้วยวิธีการวิจัยเอกสาร ผู้ศึกษาได้ทำการรวบรวมข้อมูลทั้งหมดที่เกี่ยวข้อง รวมถึงหนังสือ บทความทางวิชาการ วารสาร ผลงานวิจัย วิทยานิพนธ์ และข้อมูลจากสื่ออิเล็กทรอนิกส์ทั้งในภาษาไทยและภาษาอังกฤษ เพื่อนำมารวบรวมและวิเคราะห์อย่างเป็นระบบ เพื่อทำการศึกษาหาข้อสรุปและข้อเสนอแนะ ผลการศึกษาพบว่า (1) ประเทศไทยได้ถอดพืชกัญชาจากการเป็นยาเสพติดประเภท 5 (2) ปัจจุบันประเทศไทยยังไม่มีกฎหมายที่เกี่ยวข้องโดยตรงในการควบคุมการจำหน่าย การบริโภคพืชกัญชา (3) ประเทศไทยยังขาดมาตรการควบคุมกัญชาและผลิตภัณฑ์ที่มาจากการกัญชา เช่น การโฆษณา หลักเกณฑ์การบรรจุหีบห่อ การกำหนดเขตหรือบริเวณห้ามจำหน่าย การกำหนดเขตหรือบริเวณเสพกัญชาหรือผลิตภัณฑ์ที่มาจากกัญชา การจำกัดอายุ แต่เมื่อเปรียบเทียบกับประเทศแคนาดาและสหรัฐอเมริกาแล้ว มีการกำหนดห้ามโฆษณาซึ่งมีลักษณะที่เป็นเท็จ ทำให้หลงเข้าใจผิดหรือหลอกลวงซึ่งคุณลักษณะที่แท้จริงของกัญชา หรือโฆษณาที่เป็นการดึงดูดเยาวชน มีการกำหนดให้หีบห่อกัญชาจะต้องไม่มีเหตุอันควรเชื่อว่าดึงดูดเยาวชนและต้องกำหนดข้อเท็จจริงทางคุณลักษณะของกัญชาภายในหีบห่อ มีการกำหนดห้ามจำหน่ายหรือเสพกัญชาในสถานศึกษา สถานพยาบาลสถานีบริการน้ำมันเชื้อเพลิง หอพัก สถานที่ราชการ สวนสาธารณะ วัด เป็นต้น นอกจากนี้ประเทศแคนาดายังกำหนดให้ผู้ซื้อต้องแสดงบัตรประชาชน และกำหนดมิให้ผู้ขับขี่พกพากัญชาหรือเสพกัญชาขณะขับขี่ยานพาหนะ ส่วนสหรัฐอเมริกามีการกำหนดห้ามจำหน่ายกัญชาหรือผลิตภัณฑ์ที่มาจากกัญชาโดยใช้เครื่องจำหน่ายสินค้าอัตโนมัติ (4) เสนอแนะให้มีการกำหนดมาตรการทางกฎหมายที่เกี่ยวข้องกับการควบคุมการจำหน่าย การบริโภคพืชกัญชาเป็นการเฉพาะ
This independent study purposes (1) to study meanings, concepts, theories and the principles related to measures to control marijuana and marijuana-derived products (2) to study domestic regulations along with international laws related to protection and law enforcement to control marijuana and marijuana-derived products (3) to analyze problems and compare laws related to control marijuana and marijuana-derived products (4) to propose solutions related to measures to control marijuana and marijuana-derived products in Thailand This independent study is qualitative research. with document research methods The study has collected all relevant data. including books Academic articles, journals, research results, theses, and information from electronic media in both Thai and English languages. For collecting and analyzing systematically to conduct a study to draw conclusions and recommendations The study found that (1) Thailand has removed marijuana from narcotic category V. (2) Currently, Thailand does not have any laws directly related to its distribution. Consumption of marijuana (3) Thailand still lacks measures to control marijuana and marijuana-derived products such as advertising, and packaging regulations. designation of areas or areas where distribution is prohibited. Defining areas or areas where marijuana or marijuana-derived products are consumed age limit By comparing to Canada and the United States. Advertisements in those countries that contain false statements are prohibited.
