Abstract
การศึกษาค้นคว้าอิสระเรื่องนี้มีวัตถุประสงค์เพื่อศึกษาถึงอำนาจหน้าที่คณะกรรมการป้องกันและปราบปรามการทุจริตแห่งชาติ (ป.ป.ช.) ตามรัฐธรรมนูญแห่งราชอาณาจักรไทย พุทธศักราช 2560 และศึกษาถึงมาตรการยื่นบัญชีทรัพย์สินและหนี้สิน ตั้งแต่อดีตจนถึงปัจจุบันตามร่างพระราชบัญญัติประกอบรัฐธรรมนูญว่าด้วยการปราบปรามการทุจริต พ.ศ. .... รวมทั้งศึกษาถึงปัญหามาตรการการยื่นบัญชีทรัพย์สินและหนี้สินรวมทั้งศึกษาเปรียบเทียบกฎหมายต่างประเทศ ทั้งนี้เพื่อเป็นแนวทางในการปรับปรุง แก้ไขเพิ่มเติมมาตรการการยื่นบัญชีทรัพย์สินและหนี้สิน การศึกษาค้นคว้าอิสระนี้เป็นการวิจัยเชิงคุณภาพโดยการวิจัยเอกสาร ใช้ข้อมูลจากเอกสารเป็นหลักในการวิจัย อันได้แก่ เอกสารที่เป็นข้อมูลปฐมภูมิ อาทิเช่น รัฐธรรมนูญ พระราชบัญญัติ ประกาศ ระเบียบ คำสั่งและมติของ ป.ป.ช. และเอกสารอื่นที่เกี่ยวข้อง และเอกสารที่เป็นข้อมูลทุติยภูมิ อาทิ เช่น วิทยานิพนธ์ สารนิพนธ์ บทความ รายงานการวิจัย รายงานผลการปฏิบัติการประจำปี ตลอดจนข้อมูลสถิติต่าง ๆ ที่เกี่ยวข้อง ผลการศึกษาพบว่า มาตรการนี้มีความมุ่งหมายต้องการให้เกิดความโปร่งใสของเจ้าหน้าที่รัฐ แต่อย่างไรก็ตามควรคำนึงถึงหลักการที่สำคัญอย่างอื่นด้วย ไม่ว่าจะเป็นหลักความคุ้มค่า หลักประโยชน์สาธารณะ และที่สำคัญต้องไม่เป็นการสร้างภาระเกินความจำเป็นแก่เจ้าหน้าที่รัฐจนเกินไป ดังนั้น ตำแหน่งเจ้าหน้าที่รัฐที่ถูกกำหนดให้มีหน้าที่ยื่นบัญชีทรัพย์สินและหนี้สินนั้น ควรมีการแบ่งแยกประเภทโดยวิเคราะห์ถึงตำแหน่งที่มีความสำคัญและสุ่มเสี่ยงต่อการทุจริต เพื่อไม่ให้เป็นการสร้างภาระแก่ข้าราชการระดับล่างเกินความจำเป็น นอกจากนี้ยังพบว่ามาตรการดังกล่าวยังไม่มีความเหมาะสมเท่าที่ควร หากต้องการให้มีผลประสิทธิภาพของมาตรการ ควรแก้ปัญหาที่ระบบการตรวจสอบมากกว่า อันได้แก่ วิธีการตรวจสอบบัญชีทรัพย์สินและหนี้สิน ไม่ควรใช้วิธีตรวจสอบทุกบัญชี แต่ควรมีการเปิดเผยให้สาธารณะชนได้มีส่วนร่วมในการตรวจสอบและการนำระบบเทคโนโลยีสารสนเทศมาใช้เพื่อเพิ่มประสิทธิภาพในการตรวจสอบ รวมทั้งข้อมูลที่จะต้องแสดงในบัญชีทรัพย์สินและหนี้สิน ควรกำหนดเพิ่มในส่วนการแจ้งข้อมูลผลประโยชน์ และการเข้าไปลงทุนหรือมีส่วนร่วม เพื่อตรวจสอบเรื่องการขัดกันของผลประโยชน์ด้วย โดยนำระบบการตรวจสอบทรัพย์สินของสาธารณรัฐจอร์เจียและเขตบริการพิเศษฮ่องกงแห่งสาธารณรัฐประชาชนจีน มาปรับปรุงให้เหมาะสมกับระบบตรวจสอบทรัพย์สินของไทย
The objectives of this independent study were to study the authority and function of The National Anti-Corruption Commission (NACC) in line with the constitution of the kingdom of Thailand, B.E 2017, to explore the measures on declaration of assets and liabilities from past to now, especially under the draft organic act on counter corruption B.E. …., and to investigate problems on declaration of assets and liabilities by comparing with those in foreign law to be a guideline for improvement and amendment of the measures on declaration of assets and liabilities. This independent study was qualitative research by documentary research. There were two types of document used in this research, i.e., primary documents such as the provisions of the Constitution, acts, rules and regulations, directives and decisions of the NACC and relevant documents, and secondary documents such as theses, dissertations, articles, research reports, annual performance reports and relevant statistical information. The findings revealed that this measure aimed to ensure the transparency of government officials. However, other important principles should be considered such as worthiness, public benefit and especially, should not create an unnecessary burden to low-level officials. Therefore, the position of the government official that was required to submit an account showing assets and liabilities should be classified by analyzing the importance of the position and the risk of corruption in order not to create too much burden. It also found that this measure was not appropriate as expected. To achieve the effectiveness of measures, problems should be resolved at the monitoring system, for example, auditing method of an account showing assets and liabilities without audit all accounts. In addition, the public should participate in the audit and information technology system should be used to improve the performance of the investigation. Information that must be shown in the account should include the information relevant ot any interest, investment or participation in order to investigate the conflict of interest. Moreover, the asset inspection system of the Republic of Georgia and Hong Kong Special Administrative Region of the People's Republic of China may be adopted for the asset inspection system of Thailand.
