Abstract
การศึกษาค้นคว้าอิสระนี้ มีวัตถุประสงค์เพื่อศึกษา (1) ปัญหาสิทธิมนุษยชนของผู้ใช้แรงงานของสหกรณ์โคนมวังน้ำเย็น จำกัด (2) บทบาทของสหกรณ์โคนมวังน้ำเย็น จำกัด ในการส่งเสริมสิทธิมนุษยชนของผู้ใช้แรงงาน (3) แนวทางการแก้ไข เพื่อส่งเสริมสิทธิมนุษยชนของผู้ใช้แรงงานของสหกรณ์โคนมวังน้ำเย็นจำกัด การศึกษานี้เป็นการศึกษาเชิงคุณภาพ ประชากร ได้แก่ พนักงานสหกรณ์โคนมวังน้ำเย็น จำกัด โดยเลือกแบบเจาะจง จำนวนทั้งหมด 16 คน เครื่องมือที่ใช้ในการศึกษา คือ การสัมภาษณ์เชิงลึกและวิเคราะห์ข้อมูลเชิงพรรณนา ผลการศึกษาพบว่า (1) ปัญหาสิทธิมนุษยชนของผู้ใช้แรงงานมีการถูกเลือกปฏิบัติระหว่างลูกจ้างรายวันและรายเดือน คือ พนักงานรายวันได้รับโอกาสในการฝึกอบรมศึกษาดูงาน และได้รับสิทธิสวัสดิการของ สหกรณ์ฯ น้อยกว่าพนักงานรายเดือน การเข้าถึงข้อมูลข่าวสารสิทธิประโยชน์ในการทำงานที่พึงมี การไม่ได้รับความปลอดภัยในการทำงานและขาดความพร้อมด้านบุคลากรและอุปกรณ์ดูแลความปลอดภัย และการขาดประสิทธิภาพของการบังคับใช้ระเบียบด้านสิทธิมนุษยชน (2) บทบาทของสหกรณ์โคนมวังน้ำเย็น จำกัดในการส่งเสริมสิทธิมนุษยชนคือพัฒนาศักยภาพของผู้ใช้แรงงานส่งเสริมให้พนักงานมีความก้าวหน้าในการทำงานโดยให้การฝึกอบรมศึกษาดูงาน ให้โอกาสในการศึกษาพัฒนาความรู้ได้อย่างเต็มที่ และด้านสวัสดิการค่าตอบแทนที่เน้นความเป็นธรรมให้แก่พนักงานตามมาตรฐานการจ้างงาน ความรู้ ความสามารถ และตามภาระหน้าที่ความรับผิดชอบของพนักงานรวมถึงมีการกำหนดและกระตุ้นให้ปฏิบัติตามกฎระเบียบด้านสิทธิมนุษยชน เพื่อป้องกันและส่งเสริมสิทธิมนุษยชนให้พนักงานได้รับความปลอดภัยในการทำงาน (3) แนวทางการแก้ไขคือการป้องกันดูแลไม่ให้เกิดการเลือกปฏิบัติกับพนักงานอันเกิดจากความแตกต่างใดก็ตาม และดูแลด้านความปลอดภัยในชีวิตและทรัพย์สินและด้านสุขภาพ และการเข้าถึงข้อมูลด้านความปลอดภัยให้กับพนักงานในการปฏิบัติงานในพื้นที่เสี่ยงได้รับอันตราย ให้โอกาสในการก้าวหน้าในการทำงานอย่างเสมอภาคโดยการป้องกันดูแลรักษาสิทธิเสรีภาพ สิทธิสวัสดิการให้กับพนักงานทุกคนอย่างเท่าเทียม ให้ความรู้ความเข้าใจเรื่องสิทธิมนุษยชนให้กับพนักงานทุกคนเพื่อได้รับโอกาสในการเข้าถึงสิทธิสวัสดิการ การปกป้องดูแลพนักงานได้อย่างเสมอภาค และไม่กระทำ หรือส่งเสริมให้มีการละเมิดสิทธิมนุษยชนของผู้ใช้แรงงานอย่างทั่วถึง ตลอดจนผู้มีส่วนเกี่ยวข้องกับสหกรณ์โคนมวังน้ำเย็น จำกัด
This research had the objectives to study (1) the problem of Human Rights of workers of Wangnamyen Dairy Co-operative., Ltd (2) role of Wangnamyen Dairy Co-operative., Ltd in promoting Human Rights of workers (3) solution guidelines for promoting Human Rights of workers of Wangnamyen Dairy Cooperative., Ltd This study was qualitative research. The samples of research were selected from 16 employees of Wangnamyen Dairy Co-operative., Ltd by using purposive sampling. The tools used in the study were indepth interview and descriptive data analysis. This study found that (1) The problem of workers’ Human Rights was a discrimination between daily and monthly employees. To be more specific, daily employees had opportunity for work field trip and had the rights for welfare of the cooperative less than monthly employees and access of the news and benefits in the work that they should have. They did not receive work safety properly and they lacked preparation on human resource and their safety equipment and also lacked efficiency of enforcing human rights. (2) The role of the cooperative of Wangnamyen Dairy Co-operative., Ltd to promote Human Rights was to develop potential of workers and to promote employees to have work development by providing training, providing opportunity to study, develop knowledge fully and regarding the welfare which would focus on fairness to employees, according to work standard, knowledge, ability, employee duty and responsibility and also to have specification, as well as a stimulation to follow the regulation on human right to prevent and promote human right for employees to receive work safety. (3) The solution guideline was to prevent discrimination from any difference of employee, to take care of the safety in lives, property and health and access of the safety to employees in the work operation in the risky area and to provide an opportunity for work advancement regularly by protecting, supervising the rights, freedom and welfare to every employee equally and to provide knowledge and understanding in Human Rights to all employee to have an opportunity in accessing welfare and to protect employees equally and do not act or allow violations of Human Rights of workers and steak holders concerning with Wangnamyen Dairy Co-operative., Ltd.
