Abstract
การศึกษาค้นคว้าอิสระนี้มีวัตถุประสงค์เพื่อ (1) ศึกษาความหมาย ความเป็นมา แนวคิด ทฤษฎี และกฎหมายเกี่ยวกับการประกันภัยรถยนต์ภาคบังคับ (2) ศึกษาและเปรียบเทียบกฎหมายต่างประเทศเกี่ยวกับการประกันภัยรถยนต์ภาคบังคับ (3) ศึกษาแนวทางการปรับปรุงกฎหมายเกี่ยวกับการประกันภัยรถยนต์ภาคบังคับ (4) แก้ไขเพิ่มเติมพระราชบัญญัติคุ้มครองผู้ประสบภัยจากรถ พ.ศ. 2535 ในส่วนมาตรการทางกฎหมาย และความคุ้มครองทรัพย์สินของผู้ประสบภัย การศึกษาค้นคว้าอิสระนี้เป็นการวิจัยทางกฎหมาย โดยการวิจัยเชิงคุณภาพ ด้วยการวิจัยเอกสารศึกษาและค้นคว้าข้อมูลที่เป็นเอกสารทั้งภาษาไทยและภาษาต่างประเทศในรูปแบบของตำรากฎหมาย บทความคำพิพากษาศาลฎีกา ความเห็นของนักนิติศาสตร์ และวิทยานิพนธ์ ตลอดจนศึกษาข้อมูลจากอินเตอร์เน็ตในส่วนการวิเคราะห์ข้อมูลงานวิจัย ผู้เขียนจะทำการสังเคราะห์และวิเคราะห์ข้อมูลเชิงคุณภาพ โดยวิเคราะห์จากเนื้อหาที่ได้จากการศึกษาเอกสารและการทบทวนวรรณกรรม เพื่อนำมาเป็นแนวทางในการจัดทำข้อเสนอแนะต่อไป ผลการศึกษาพบว่า (1) การสำรองจ่ายค่ารักษาพยาบาล ตามพระราชบัญญัติคุ้มครองผู้ประสบภัยจากรถ พ.ศ. 2535 ประเทศไทยเบิกค่ารักษาพยาบาลผ่านระบบสินไหมอัตโนมัติ ตั้งแต่ปี 2555 ซึ่งผู้ประสบภัยสามารถมอบอำนาจให้ทางโรงพยาบาลดำเนินการเบิกจ่ายค่ารักษาพยาบาลทำให้ผู้ประสบภัยไม่ต้องสำรองจ่ายค่ารักษาพยาบาล (2) การศึกษามาตรการทางกฎหมายของประเทศญี่ปุ่น ประเทศแคนาดา และประเทศสิงคโปร์มีอัตราโทษสูงกว่าประเทศไทย โดยประเทศญี่ปุ่นและประเทศสิงคโปร์มีทั้งโทษจำคุกและปรับ ส่วนประเทศแคนาดามีเพียงโทษปรับเช่นเดียวกับประเทศไทย ส่วนในเรื่องความคุ้มครองความเสียหายแก่ผู้ประสบภัยของประเทศญี่ปุ่นและประเทศสิงคโปร์มีความคล้ายคลึงกับประเทศไทยส่วนประเทศแคนาดาได้กำหนดให้มีความคุ้มครองความเสียหายต่อทรัพย์สิน (3) พระราชบัญญัติคุ้มครองผู้ประสบภัยจากรถ พ.ศ. 2535 มีปัญหาเกี่ยวกับมาตรการทางกฎหมายที่ไม่เหมาะสม เนื่องจากข้อมูลทางสถิติมีรถที่ไม่ทำประกันภัยรถภาคบังคับจำนวนมาก การนำมาตรการทางกฎหมายของประเทศญี่ปุ่นมาเป็นแนวทางในการแก้ไขกฎหมายย่อมมีส่วนควบคุมให้เจ้าของรถจัดทำประกันภัยรถภาคบังคับเพิ่มมากขึ้น และนำความคุ้มครองความเสียหายต่อทรัพย์สินของประเทศแคนาดามาเป็นแนวทางในการแก้ไขกฎหมายย่อมก่อให้เกิดประโยชน์และความเป็นธรรมต่อผู้ประสบภัย (4) ข้อเสนอแนะจากการศึกษาค้นคว้าอิสระนี้ คือ แก้ไขเพิ่มเติมพระราชบัญญัติคุ้มครองผู้ประสบภัยจากรถ พ.ศ. 2535 ในส่วนมาตรการทางกฎหมาย ตามมาตรา 37 และมาตรา 39 จากโทษปรับไม่เกินหนึ่งหมื่นบาท เป็นโทษจำคุกไม่เกินหนึ่งปี หรือปรับไม่เกินหนึ่งแสนบาทหรือทั้งจำทั้งปรับ และความคุ้มครองทรัพย์สินของผู้ประสบภัย ตามมาตรา 4 รวมทั้งกฎกระทรวงต่าง ๆ ที่เกี่ยวข้อง
The objectives of this independent study were to (1) study the meaning, background, concepts, theories and laws related to compulsory motor insurance, (2) study and compare foreign laws concerning compulsory motor insurance, (3) study guidelines for amendment of the laws relating to compulsory motor insurance, (4) amend the Road Accident Victim Protection Act, B.E. 2535 (1992) regarding legal measures and protection of victims’ properties. This independent study is a qualitative research focusing on legal study based on research and study of documents and data available in both Thai and foreign languages in the form of legal texts, articles, and judgments of the Supreme Court of Thailand, opinions of jurists, thesis as well as data available on the Internet. Regarding research data analysis, the authors have synthesized and analyzed qualitative data. The analysis was based on the contents obtained from document studies and literature reviews to be used as guidelines for preparation of further recommendations. The study results showed that (1) regarding advancement for medical expenses according to the Road Accident Victim Protection Act, B.E. 2535 (1992), Thailand has initiated reimbursement of medical expenses through the automatic compensation system since 2012. Road accident victims can authorize hospitals to reimburse medical expenses without having to make payment for medical expenses by themselves. (2) Legal measures of Japan, Canada and Singapore have more stringent penalties than Thailand. Japan and Singapore impose both imprisonment and fines punishment. Meanwhile, Canada has imposed only fines punishment similar to Thailand. Nonetheless, damage coverage for victims in Japan and Singapore are similar to Thailand. Meanwhile, Canada has also determined property damage protection requirement. (3) The Road Accident Victim Protection Act, B.E. 2535 (1992), has inappropriate legal measures because, according to statistical data, many automobile owners do not have compulsory motor insurance. Thailand should adopt Japanese legal measures as guidelines for its law amendment in order to have a greater control over automobile owners to obtain compulsory motor insurance. In addition, the adoption of property damage protection of Canada as guidelines for law amendment would bring benefits and fairness to the victims. (4) Suggestions from this independent study are the legal measures under section 37 and section 39 of the Road Accident Victim Protection Act, B.E. 2535 (1992), should be amended from a fine not exceeding ten thousand baht to imprisonment for not more than one year or a fine not exceeding one hundred thousand baht or both and protection of property of the victims under Section 4, including the relevant ministerial regulations should also be amended.
