Abstract
รัฐธรรมนูญนั้นมีบทบัญญัติกำหนดช่องทางการตรวจสอบความชอบด้วยรัฐธรรมนูญของกฎหมายไว้หลายช่องทาง ซึ่งช่องทางที่สำคัญต่อประชาชนมากที่สุดคือ ช่องทางตามมาตรา 211 ของรัฐธรรมนูญแห่งราชอาณาจักรไทย พุทธศักราช 2550 เนื่องจากเป็นช่องทางหลักในการที่ประชาชนจะเสนอเรื่องต่อศาลรัฐธรรมนูญ เพื่อให้ตรวจสอบความชอบด้วยรัฐธรรมนูญของกฎหมายได้ โดยมาตราดังกล่าวมีสาระสำคัญดังนี้ คือ หากศาลเห็นเองหรือคู่ความในคดี คู่ความโต้แย้งพร้อมด้วยเหตุผล ว่าบทบัญญัติแห่งกฎหมายขัดหรือแย้งกับรัฐธรรมนูญและยังไม่มีคำวินิจฉัยของศาลรัฐธรรมนูญเกี่ยวกับบทบัญญัตินั้น ศาลที่พิจารณาคดีมีหน้าที่ต้องส่งความเห็นหรือคำโต้แย้งของคู่ความเช่นว่านั้นไปให้ศาลรัฐธรรมนูญได้พิจารณาวินิจฉัยในประเด็นดังกล่าวและในระหว่างนั้นให้ศาลที่พิจารณาคดีดำเนินการพิจารณาต่อไปได้ แต่ให้รอการพิพากษาคดีไว้ชั่วคราวจนกว่าจะมีคำวินิจฉัยของศาลรัฐธรรมนูญ ทั้งนี้ จากการศึกษาบทบัญญัติและการบังคับใช้บทบัญญัติของกฎหมายดังกล่าว พบว่าก่อให้เกิดปัญหาสำคัญ 3 ประการ ได้แก่ ประการแรก คือ การถูกใช้เป็นช่องทางในการประวิงคดี เนื่องจากเมื่อคู่ความร้องต่อศาลว่าบทบัญญัติของกฎหมายที่จะบังคับใช้ในคดีขัดหรือแย้งกับรัฐธรรมนูญศาลจะต้องสั่งเรื่องไปให้ศาลรัฐธรรมนูญตัดสินเสมอ ประการที่สอง บทบัญญัติดังกล่าวบังคับศาล อาจเป็นเหตุให้มีคดีขึ้นสู่ศาลรัฐธรรมนูญมากเกินความจำเป็น ทำให้การตัดสินคดีในภาพรวมมีความล่าช้าออกไป ประการที่สาม ขั้นตอนวิธีการตามมาตรา 211 ดังกล่าว ทำให้มาตรา 212 (สิทธิฟ้องโดยตรงต่อศาลรัฐธรรมนูญ) ไม่มีที่ใช้เพราะไม่ว่ากรณีใด ประชาชนก็จำต้องฟ้องคดีต่อศาลเพื่อคุ้มครองสิทธิเสรีภาพของตน และโต้แย้งตามมาตรา 211 ตามที่กำหนดไว้ในบทบัญญัติดังกล่าว จากการศึกษาและวิเคราะห์บทบัญญัติดังกล่าว ปัญหาทั้งสามนั้นเกิดจากการที่รัฐธรรมนูญบังคับให้ศาลส่งเรื่องไปยังศาลรัฐธรรมนูญเสมอหากคู่ความโต้แย้ง ดังนั้น การแก้ปัญหาดังกล่าวต้องกระทำ โดยการแก้ไขมาตราดังกล่าว โดยให้ดุลยพินิจต่อศาลที่พิจารณาคดีในการตัดสินว่าบทบัญญัติกฎหมายซึ่งจะใช้บังคับในคดีที่คู่ความโต้แย้งนั้นขัดแย้งกบรัฐธรรมนูญหรือไม่หากเห็นว่าขัดกบรัฐธรรมนูญก็ให้ทำการส่งเรื่องไปยังศาลรัฐธรรมนูญ เพื่อพิจารณาวินิจฉัยต่อไป แต่ถ้าหากเห็นวาบทบัญญัติของกฎหมายดังกล่าวไม่ขัดต่อรัฐธรรมนูญยกคำร้องของคู่ความเสียและดำเนินกระบวนพิจารณาต่อไป
The constitutionality of laws principle is a significant element that support the “rechtsstaat” (and the rule of law) and democracy. Both principles has the important purpose to control the government power and protect right of all people. Therefore, the constitution provides various measures concerning the constitutionality of laws. Among the designated measures, this author believes that the measure under Article 211 of Constitution of Thailand B.C. 2550 is most important to people because it is the main method for people to bring the case regarding constitutionality of laws to the Constitutional Court. This article provides that if a court realizes or a litigant claims with solid reason that a law on whose validity its decision depends is unconstitutional, the court must refer the matter to the Constitutional Court and the decision shall be stayed until the decision is obtained from the Constitutional Court. After studying thoroughly both the law itself and the practical application, the author found that there are 3 problems arisen concerning this article. Firstly, it has been used to delayed court proceedings abusively because if there is the claim, the court must refer the matter, regardless the opinion of the court. Secondly, the mentioned condition can lead to the problem of court congestion and delay in the Constitutional Court because there is no any step to screen the claims. Lastly, the mandatory result in Article 211 makes the instrument in Article 212(an individual constitutional complaint straight to the Constitutional Court) has no place to apply. Because, in all cases, the injured people must first go through the mechanism in Article 211 and then the constitutional disputes direct to the Constitutional Court. The author analyzed that all three problems are brought about by the mandatory measure that court must refer the constitutional matter to the Constitutional Court. Therefore, the best solution is adapting the problematic matter in Article 211. The author suggests that this article should provide that the court has discretion concerning the constitutionality of the law which its decision depends on. If the court concludes that the law in a case is unconstitutional, the court then shall refer the matter to the Constitutional Court and stay its decision. If the court decides that the law in a case is constitutional, the court shall reject the claim and continue the proceeding.
