Abstract
การศึกษาค้นคว้าอิสระนี้มีวัตถุประสงค์เพื่อ 1) ศึกษาความหมาย แนวคิดทฤษฎีที่เกี่ยวข้องกับการป้องกัน และปราบปรามการทรมาน และการบังคับให้บุคคลสูญหาย โดยเจ้าหน้าที่รัฐ (2) ศึกษากฎหมายเกี่ยวกับการป้องกัน และปราบปรามการทรมาน และการบังคับให้บุคคลสูญหาย โดยเจ้าหน้าที่รัฐ (3) ศึกษาและวิเคราะห์ปัญหาเกี่ยวกับการป้องกัน และปราบปรามการทรมาน และการบังคับให้บุคคลสูญหาย โดยเจ้าหน้าที่รัฐของต่างประเทศและประเทศไทย (1) ศึกษาแนวทางในการแก้ไขปัญหาเกี่ยวกับการป้องกัน และปราบปรามการทรมาน และการบังคับให้บุคคลสูญหาย โดยเจ้าหน้าที่รัฐการศึกษาค้นคว้าอิสระนี้เป็นการวิจัยเชิงคุณภาพด้วยวิธีการวิจัยจากเอกสาร ซึ่งผู้ศึกษาได้ทำการรวบรวมข้อมูลจากเอกสารทั้งหมดที่เกี่ยวข้อง กฎหมาย ระเบียบ ประกาศและเอกสารราชการอื่น ๆ ที่เกี่ยวข้องกับการป้องกันและปราบปรามการทรมาน และการกระทำให้บุคคลสูญหาย โดยเจ้าหน้าที่รัฐ จากผลการศึกษาพบว่า (1) ยังคงไม่มีกฎหมายกำหนดให้กระทำทรมานที่เข้าเงื่อนไขตามอนุสัญญาฯ การบังคับบุคคลให้สูญหายเป็นความผิดเฉพาะตามกฎหมายอาญา เป็นเหตุให้ไม่สามารถดำเนินการตามกฎหมายเพื่อเร่งรัดกระบวนการสอบสวนหาข้อมูล และเป็นปัญหาต่อผู้เสียหายและครอบครัวในการเข้าถึงความยุติธรรม (2) ประมวลกฎหมายอาญายังไม่มีบทบัญญัติความผิดแยกต่างหากในกรณีเจ้าหน้าที่รัฐเป็นผู้กระทำซึ่งไม่อาจครอบคลุมถึงการลงโทษเจ้าหน้าที่อันเป็นวัตถุประสงค์สำคัญของอนุสัญญาได้ (3) ประมวลกฎหมายอาญาและประมวลกฎหมายวิธีพิจารณาความอาญา ยังไม่ปรากฏนิยามคำว่า “ทรมาน” การบังคับบุคคลให้สูญหายที่สอดคล้องตามอนุสัญญาฯ ผู้ศึกษาจึงขอเสนอให้มีการตรากฎหมายระดับพระราชบัญญัติขึ้นเป็นการเฉพาะ โดยให้กระทำทรมานที่เข้าเงื่อนไขตามอนุสัญญาฯ การบังคับบุคคลให้สูญหายเป็นความผิดในทางอาญา รวมถึงมีมาตรการอื่นๆ ที่เกี่ยวข้องกับการกระทำดังกล่าว ไม่ว่าจะเป็นมาตรการในด้านการสอบสวนมาตรการในการติดตามตัว มาตรการในการป้องกันและตรวจสอบและมาตรการในการเยียวยา เพื่อให้เจ้าหน้าที่รัฐอยู่ภายใต้การควบคุมตามกระบวนการยุติธรรมอย่างชัดเจนในทุกขั้นตอน
The purposes of this study were: 1) to study meanings and concepts regarding prevention and suppression of torture and enforced disappearance; 2) to study legal framework regarding prevention and suppression of torture and enforced disappearance; 3) to study and analyze issues regarding prevention and suppression of torture and enforced disappearance in national and international level; 4) to study a resolution regarding prevention and suppression of torture and enforced disappearance. This study was a qualitative research by using documentary approach. Data was collected via related documents, regulations, rules, notifications and other governmental documents regarding prevention and suppression of torture and enforced disappearance. The study revealed that 1) there is still no law that recognized torture and enforced disappearance, under the definition of Convention Against Torture and other Cruel, Inhuman or Degrading Treatment or Punishment (CAT) and International Convention for the Protection of All Persons from Enforced Disappearance (CED), as criminal offenses, resulted in incapable of prosecution against accused and preventing victim’s family from justice; 2) the Penal Code has no specific provisions for governmental agencies who exercised any action of torture or enforced disappearance, which are key purposes in the Conventions; 3) the Penal Code and the Criminal Procedure Code have no definition regarding “torture” and “enforced disappearance” satisfy to the Conventions. It is recommended that there should be a specific act recognizes acts of torture and enforced disappearance as criminal offenses. As well, there should be other measures related to the act, e.g., investigation measure, tracing measure, protection and inspection measure, and remedy measure, in order to make every process in juridical process more transparent and accountable.
