มาตรการพิเศษแทนการดำเนินคดีอาญาของเด็กและเยาวชนตามกฎหมายว่าด้วยพระราชบัญญัติศาลเยาวชนและครอบครัวและวิธีพิจารณาคดีเยาวชนและครอบครัว

Abstract

การศึกษาค้นคว้าอิสระนี้มีวัตถุประสงค์เพื่อ ศึกษาแนวคิดและทฤษฎีการใช้มาตรการพิเศษแทนการดำเนินคดีอาญาของเด็กและเยาวชน ศึกษาปัญหาการใช้มาตรการพิเศษแทนการดำเนินคดีอาญาของเด็กและเยาวชน ศึกษาเปรียบเทียบกฎหมายและมาตรการทางกฎหมายที่เกี่ยวข้องของประเทศไทยกับประเทศนิวซีแลนด์และประเท ออสเตรเลีย 4) หาแนวทางการแก้ไข ปรับปรุงการนำมาตรการพิเศษแทนการดำเนินคดีอาญามาใช้กับเด็กและเยาวชนให้มีความชัดเจน และเหมาะสมมากยิ่งขึ้น การศึกษาก้นคว้าอิสระนี้ เป็นวิจัยเชิงคุณภาพ โดยการวิจัยเอกสาร ด้วยการรวบรวมข้อมูล จากหนังสือ ตำรา วารสาร บทความ วิทยานิพนธ์ รายงานการวิจัย เอกสารทางวิชาการ การค้นคว้า ทางสารสนเทศบนอินเตอร์เน็ตและจากแหล่งข้อมูลอื่น ๆ ผลการศึกษา พบว่า มาตรการพิเศษแทนการดำเนินคดีอาญาตามกฎหมายว่าด้วย พระราชบัญญัติศาลเยาวชนและครอบครัวและวิธีพิจารณาคดีเยาวชนและครอบครัว มีการกำหนดผู้เข้าร่วมในการประชุมเพื่อจัดทำแผนฯ การกำหนดความผิดที่สามารถเข้าสู่กระบวนการเบี่ยงเบน คดีการพิจารณาในสำนึกในการกระทำของเด็กหรือเยาวชนที่กระทำความผิดยังไม่มีความชัดเจนและเหมาะสม โดยเห็นว่าควรมีการเชิญเจ้าหน้าที่ตำรวจเข้าร่วมประชุมในการจัดทำแผนกำหนด ประเภทของความผิดที่สามารถเข้าสู่กระบวนการเบี่ยงเบนคดีตามมาตรการพิเศษแทนการดำเนินคดีอาญาให้มีความชัดเจน และกำหนดความหมายของการสำนึกในการกระทำไว้ให้ชัดเจน และเป็นรูปธรรม

The objective of this independent study is to study concepts and theories of the application of special measure in replacement of criminal proceedings for children and juveniles, to study the problems of the application of special measure in replacement of criminal proceedings for children and juveniles, to conduct comparative study on relevant laws and legal measures of Thailand, New Zealand and Australia, and 4) to find more obvious and proper corrective and improving guideline for application of special measure in replacement of criminal proceedings with children and juveniles. This independent study is the qualitative research through documentary research from data collection from books, textbooks, journals, articles, thesis, research reports, academic documents, information search on internet and from other sources of data. The finding of the studying found that the special measures in replacement of the criminal proceedings under the Juvenile and Family Court Act are unobvious and improper in terms of the participants who responsible for preparing the Plan, the defining the offense that can lead to the process of diversion and also the meaning of become aware of the guilt of juvenile offenders were not clear. Researcher suggest that the Police officers should be invited to participate in preparing the Plan and to determine the types of offenses that could lead to the process of diversion in replace of criminal case and to definite the meaning of become aware of the guilt clearly and substantially
